I went to LA for my infopass to get the I-551 stamp, the officer that took my appointment called NSC and they said:
"Yes her file is still here, but no need for a special request for Transfer. They have a big pile -undetermined filing dates- that they are transferring to CSC soon b/c they can't get to them in NSC and need the help from CSC to process". She said that basically any expired file not sitting in front of an officer at the moment would be sent to CSC for processing. The Officer then told me to keep waiting for my I-751 approval"
Thank you for that information. When did you visit the office in LA? I hope CSC adjucates our applications until the end of this year.

Would be nice if we were in any service center, except Nebraska.
The "customers" of the TSC in the first half of 2007 are not very lucky either; their adjucations are delayed like ours. Their application got sent to VSC where they are processed after later direct applications to VSC.

without current documentation, my wife would neither have a drivers license nor a job. The day her PRC expired was the day her employers legal department called her in, she was so busy at work, she got permission for me to handle that end of it. Ironically on 03/27/2008 is the day that the NSCIS is drastically increasing the fines to employers that employ undocumented workers, and besides the feds, our state is taking a very active interest in additional fines.
The call of the legal department is interesting - what did they demand to see and why? If they wanted to see her permission to work to comply with the Labor Laws, someone in that legal department needs a refresher on Labor Law: Such demand is not allowed, all the employer can and must do is checking some documents at the beginning of an employment. It could be different, however, if the employer needed to see your wife's document to comply with some security regulation, like the rules of a federal customer (DoD?) or export control.
I haven't heard about state laws on employment of undocumented people, but they should not be in contradiction to federal law.

it's my understanding that you do not make an appointment until you are within 30 of your extension expiration date. Is this true?
I don't know if there is a certain limit like 30 days. I made my appointment 7 days before expiration to visit them 1 day after. Remember: You are not required to have a document to be a legal permanent resident, you can go days, weeks, even months without.
A month or less before the expiration of the extension seems to me a good time to visit them, with exceptions, of course: If you make a 3-week trip and come home one day after the NOA expired, I would visit them 35 days before the expiration and asked for a I-551 stamp, with travel documents in hand.

Yu and Dan, you misunderstood the question. tweety was asking about the time after the one-year extension has expired or is about to expire.
tweety, I guess the easiest thing is carrying an official document of your name change with you on flights, e.g. an official copy of your marriage license (in English). My wife had the reverse problem and carried her old, expired passport with her - her name was changed, but some frequent flier mile system still carried her under her old name and tickets got printed wrongly.

05/01/2007 to present, nothing.
You seem to be stuck in the same rut as the rest of us - the NSC has essentially stopped working on I-751 applications. You can contact your congressperson about it, but I wouldn't hold my breath for a speedy processing at NSC.

I can see it when I tried to add Declan's dates, but it does not show up on the thread. It might even be better to have one area of the thread which is only for updated lists as info comes in?I don't understand the technical problem that you are describing, but I have re-posted the table by clicking on the AddReply button instead of the reply-button of the last table. Does it work for you now?

My husband's GC will expired next year, im aware of filing I-751 within 90 days,
im a bit worried about his job they might question him in regards to his GC being expired?
Do they have any extension or do i need to apply for it.. he loves his job and i dont want him to be fired because of his status (GC being expired)
You can relax, it isn't half as bad as you seem to imagine now. Your husband has to file a I-751 for a removal of condition in a 90 day window before his Green Card expired. When he files, his legal status is automatically extended until the USCIS makes a decision on his application, that means he can legally work and travel like any other permanent resident. As proof of his filing, he should receive a Notice Of Action (NOA) from the USCIS that serves as official proof that his status has been extended for one year beyond the experiation date of his GC. His employer, however, is not allowed to ask to see the new papers; your husband needs them only if starting a new job (or crossing borders). (This is a truth with reservations - if the employer works in a security sensitive field, there might be overriding rules that force the employer to check the immigration papers of his employess regularly.) In the unlucky case that his status is still pending after one year, your husband can get a stamp at a local USCIS office that extend the written proof of his status for another year.

if there's any step of the process that doesn't call for an attorney, it's probably the I-751, or at least an I-751 filed by a couple who is living together in a bona fide relationship that's not on the verge of breaking up or anything.
That sums it up in my view. Get an attorney if your situation is non-standard, otherwise do it yourself (if you feel comfortable with filling out forms). We had an attorney for the conditional Green Card, but did the I-751 ourselves. By that time, I knew that I had to send all documentns by trackable mail to the USCIS - previously, an answer letter to a RFE got lost, and I was threatened with deportation.

is there a sense to apply for citizenship if it can't be approved before i-751 is approved?
You can apply for citizenship while the I-751 is pending. The application forces the adjucation of the I-751.

Yay!! That's great. Had you heard of St. Paul only giving out 2 or 6 month stamps? I've only heard that for Chicago so far.

I hadn't heard anything in beforehand about the standard practice in the Twin Cities (the website says St. Paul, but the office is actually in Bloomington). The USCIS is a federal authority, however, and I expect the various local office to follow the same federal law. The quoted memorandum, for example, is directed to ALL directors, regional, service centers etc. I don't understand why Chicago can have a deviating practice and wouldn't got called on it. If I would be denied in Chicago, I would contact my senator and asked why the people of Illinois get treated worse than those of Minnesota. I was prepared to contact my senator to complain, if they would have ignored the memorandum and not given me sufficient explanation why.

For I-751:
biographical data - fill out the I-751 form, that's all you need
passport photo page - not required
birth certificates - of you or of your common children? If you, not required; if the children, they are strong evidence.
divorce decree - not required, should have been part of first application for Green Card
new passport photos - not longer required outside the US, instead you undergo biometrics
still required: evidence of a bona fide marital relationship and copies of the temporary green cards (front and back).
Maybe that attorney has been a little too much out of the loop? I would discuss your concerns with the attorney, and if the reaction is unsatisfactory for you, change attorneys or go it alone - the I-751 is not difficult, if you're still a couple.

That you got a one-year extension gives me hope for Monday when I plan to visit our local office and ask for the stamp. I really don't want to go there every 2 month for a new stamp, but be done with it for this year.
Good news! I got my I-551 stamp today with 12-months duration.
I had made an Infopass appointment (reason: speak to an immigration officer) and brought with me the following documents:
- Infopass notice
- old Green Card
- NOA
- passport, valid for more than a year
As supporting documents, I had brought:

- table of NSC processing time w/ I-751 in jul06
I arrived 15min before my Infopass time, went thru security, and was called up 5min after the Infopass time. I gave the immigration officer my Green Card and said that I was a permanent resident. Then I gave him the NOA and told him that my proof of residence had just expired yesterday. Last I gave him my passport and asked for a 12-months extension of my proof of residence.
The immigration officer looked on the documents and entered something on his keyboard, presumingly checking my status online. He didn't ask any question at first, but disappeared into a back corner with my passport to stamp it. I thought, well, I get a stamp, but I cannot give him my spiel now that I want a 12-months duration and not some 2-months or so. When he came back, he wrote by hand into the fields of the stamp, and I saw that I got an extension until Mar 2009 - relieve! He tucked my old Green Card to a print-out and kept it. He then asked if I wanted to travel, which I denied, and I pointed out that I need the stamp instead to enter facilities of my company that are closed to foreigners without escort and where they don't know me personally. He didn't ask for any proof of that and didn't ask any further question. I thanked him and left with my passport with the stamp.

I wanted to show the table of current NSC processing times, from which I would expect another 6.5 month wait for my 10-year Green Card, leading to a repeated visit if given a stamp with 6 month duration or less. I tried to start out the conversation friendly, but I was tense, and my voice may have sounded demanding at the beginning. At the end, I was happy.

That is a very useful memorandum James! I hope that it can somehow be pinned since so many people are affected by the delays in processing of the I-751.

I went this monday to get my stamp at the St Louis office, I got the 1 year extention on the my passport (temporary I-551) but the officier took my old expired green card away. (...) Wanted to double check, is it normal that they took the card away?
Yes, it seems to be, compare for example with the memo, posted repeatedly in this thread.
That you got a one-year extension gives me hope for Monday when I plan to visit our local office and ask for the stamp. I really don't want to go there every 2 month for a new stamp, but be done with it for this year.

The two senators and the representative are obvious contacts for complaints. I had never heard of the USCIS Ombudsman before, what is his/her influence? And what is the job and the influence of the Inspector General? (I don't believe that the Secretary or the Director would react to our complaints if they are not brought forward by the other contacts on the list.)
