Can and will you two file together? If yes, I recommend borrowing the money. Talk with your bank or credit union; they have better rates than credit card companies. They might get you an even lower rate if they see your documents and borrow only the money for the application.

If you won't file together, you have a bigger problem. Normally, I recommend seeing a lawyer, but if you don't have money, a charity should be your first contact. I have heard that some charities offer legal immigration consulting to poor people. They should be also more familiar with hardship waivers for fees than most people here.

Last, please avoid using ALL CAPITALS in your postings, shouting doesn't help.

I wanted to update the table of applications to the NSC and wondered, if we should add the transfers to the California Service Center in the last column - what are your opinions?

I received my physical Greencard yesterday, so my journey with the USCIS is over for now - sigh, it's about time. I will visit this site occasionally to help others, but surely won't be so often here as in the last fourteen months.

My green card is expired, but I have an extension letter which authorizes me to work and stay here until the end of August.

I am going to Australia (my country of citizenship) in 7 weeks and want to know if I should get the i551 stamp in my passport just to be on the safe side.

You don't need a stamp for traveling to Australia, if you come back, before the extension letter expires. You might not even get it, because the USCIS office could deny it, because you wouldn't need it.

If you come home later than planned and the extension has expired, remember that only your written proof of residentchip has expired - you are and remain a resident until the USCIS adjucates your case. You would be admitted at the border, after they checked your status on their online system. I wouldn't get myself intentionally into that situation though.

To the two names: You do the right thing by carrying the certified copy of your marriage license with you.

My I751 has been pending since 07/06. (...) I still have not received my 10 year green card but today I received a letter confirming my naturalization approval.

I find it ironic that you chose the nick Waiting4GC and that it seems now that you will NEVER get it

... all these documents I have to carry: the expired PRC, the extension letter, and the stamp!

Is the stamp you mentioned a I-551 stamp, in your passport or on a I-94(?) form? Then you wouldn't need to carry the expired PRC and the extension letter with you anymore, the stamp replaces both of them.

I got an email today that I was approved There seems to a bunch of us happy guys today - hi dee. I am especially happy, because we will move on May 31, and I was worried that letters from the USCIS might get lost. Now I just hope that the card will really reach me within 30 days.

Wait, you need to have a travel itinerary to get an extension stamp? I have no plans to travel anywhere but have an appt in Chicago to get an extension stamp next week. Will this be denied to me?

I didn't have any travel plans when I got my extension stamp. The USCIS officer asked me, however, after my passport was stamped and before it was handed to me if I was planning to travel. I answered No, but added that I need the stamp to get into some ITAR facilities of my company.

I went to the office close to the end of my written proof of residentship (actually I went the first business day afterwards), to make it more difficult for them to deny the stamp with the explanation that the card might come before the extension letter expired. I had read through the memorandum at least twice (check the memo attached to this thread), and I was prepared for their questions, because the memo mentioned the need for job and travel. It doesn't mention documents needed to show the need, but, if asked, you should answer something along the lines that you are looking at another job or at some travel plans - you should actually look on a job or a travel plan for that, but you don't have to go through with it. Be self-confident when speaking to them but not aggressive and ask for a supervisor if they deny a 12 months stamp. They have delayed the process, and you shouldn't be forced to get to their district office for another year.

Two recent lists recombined, also some details added like jennybrigitta's stamp etc. Many of us have received notices about a transfer of our applications from NSC to presumingly CSC, including me. I haven't added that information, because it is so common; I hope it will accelerate our adjucation.

Did you walk around with your Permanent Residence Card before? You don't need to carry that, either! Just bring it with you on the rare occasion that you need to show proof of legal residence.

Are you sure about that? I think I'ver read somewhere that we actually had to carry it with us, but because I fear loosing it, too, I just carry around a copy.

My daughter's Venezuelan passport is expired with threats to take away my wife's passport, we tried to renew our daughter's passport last year, what for, she isn't living in Venezuela, how do you answer that? Course, things can be done in Venezuela by depositing large sums of cash in a Miami bank account, they love US dollars. I did read about that I-551 stamp have to bring in a current valid foreign passport, isn't that asking a bit too much from people that have already lived here legally for four years now?

First, Venezuelans living abroad need the passport for travelling, e.g. to Europe - you already knew that I assume and so does the Venezuelan consulate, but they still want to be paid like their brethren in the consulate of Iran and other "liberated" nations. The memo attached to this thread (and to the fixed thread on top of the thread list) mentions a second possibility, to get the I-551 on a I-94 form, with you supplying the passport photos (two photos?). I got such a form when I got first approved for my conditional Green Card, because my passport wasn't valid much longer anymore. I used it for employment in the US and for travel to Canada.

It seems that, finally, NSC is getting its act together and is processing I-751 again.

What I'm wondering though is if USCIS will consider this a valid reason to give the stamp. Is it worth the 2 hr trip to San Antonio.

USCIS should consider this a valid reason, because the kids have the correct status and it's a matter of several hundred dollars for them; however, USCIS should do many things and is not doing them. I would make up a balance sheet between going and not-going and then decide what you will do. Sorry that I cannot be more helpful.

I got my infopass today but was denied with the I-551 extension stamp. The lady said I just have to show the expired green card and the I-751 letter and that I am valid until April 15, 2008. She said if I am planning to leave the country which I intend to do this August that I should come back one month before which would be July and that is the only time she is going to stamp my passport. So I ask her what is going to be my status from April to July 2008, she said it would be pending. I even show her the memo but she refuse to stamp my passport for the reason that its not expired yet.

I feel your anger:

- They should have given you the I-551 stamp for 12 month. If they don't next time either, demand to speak to a supervisor.

- Your status is NOT "pending" but "permanent legal resident" (until the USCIS adjucates your case, see memo).

- Next time you go, tell them that you are thinking about getting another job (and who doesn't sometimes) and that you need the stamp for starting one.

- The whole thing is only necessary because of the delay the USCIS has generated - they should accomodate you.

My attorney says that I cannot file by myself as we have not seperated and there has been no physical violence towards me, although a lot of emotional abuse on a daily basis.

I'm sorry to hear about your difficult marriage. You have, however, taken the right step already in consulting an attorney. Maybe you will get some more feedback here, but most people on this board file as a couple and have no direct experience with separate filing.

The sad thing is that I was supposed to take my GMAT yesterday, but they require to bring green card (mine is expired now). I could use my passport, but since my passport lists maiden name, they told me they can not allow me to take this exam!!!!!! After I screamed on the phone for half hour, they said that I might be admitted to exam if I bring the following:

ID, passport, expired extension letter, green card and marriage certificate, and then testing facility MIGHT (or might not) allow me to take the test.

Basically, I have to pay US$250 exam fee again, go to the testing center and pray that 5 documents proving my identity would be enough.

danutuke, that sucks. I'm sorry to hear that the disorganization or laziness at the USCIS has such consequences for you. I wish you Good Luck at the testing center - if they are only slightly more customer friendly there than at the USCIS, you shouldn't have a problem with proving who you are and which status you have.

You wrote once that you had received only a 2-month stamp into your passport - is that stamp still valid? Could you write your dates into this thread, please, that other readers can compare your dates with theirs?

Could you do us a favor, please, and post your data with the NSC in this thread, like date on NOA and of biometrics? I would like the readers to be able to estimate their own wait. From a previous post, I assume that the date on your NOA was close to 02/16/07, is that correct? (You quoted them: On February 16, 2007, we received this CRI89 PETITION ...)

The officer will review the petition to determine that it correct and complete, then adjudication officer will review the documentary evidence submitted and will determine whether or not to waive the requirement of an interview.

Wouldn't this be done before the I-797C extension notice is sent, find it difficult to believe they would even send that extension unless the application is complete with suitable supporting evidence. Seems like it should only take a couple of minutes to review the supporting evidence, I even highlighted all the important details.

I think that they check only a few formal things upon receiving the application: Is the application signed, has the check the right amount - yes, then send the check for cashing and the NOA to the applicant. The review of the evidence demands the judgement of an officer trained in detecting fraudulent applications, you cannot do that in ten minutes in the mailroom. I do not want to defend, however, the ridiculous processing times we have now - the USCIS is among the worst federal authorities, and little is done to improve that.

you might know that some cases at NSC have been pending for over a year, with absolutely no indication that they will be approved anytime soon. Indeed, someone just mentioned that they were told at an InfoPass that it might be at least 18 months total before their NSC I-751 is approved. Which means the OP will have to go back and get another stamp.

Not really. If he had to make an Infopass appointment to get an extension stamp, his 1-year extension letter had already expired, which means his case had already been pending for over a year. A year plus six months of the extension stamp - and there's your 18 months. Which means the OP will probably NOT have to go back and get another stamp.

I have to side with James on this one. He mentioned that the 18 months were given as a minimum time, at least was emphasized. Given the current inactivity of certain service centers, a further delay seems not excluded at all. More important, the memo mentioned explicitely 12 months as stamp duration - what does the USCIS lose by giving the 12 months? On the other hand, a shorter stamp leads to uncertainty if and when you have to go again to get another stamp. If the USCIS causes delays, then it should not put not more work and hassle on those whose applications are delayed.

I went with the memo to my infopass appointment, and I was prepared to argue for 12 months and, if necessary, speak to a supervisor. The memo is binding for the USCIS officers if not repealed. Fortunately, my stamp was for 12 months without discussion.
