  1. If you have a USCIS account I think those updates have sort of slowed down for some reason. The updates that I have been receiving have been pretty consistent up until recently. We didn't get any notification on AOS GC approval or that the card was being produced. I got the card a little less than a week later and the system updated to card has been delivered. On top of that our initial interview was actually rescheduled but that did not update in the system either so it sounds like things are happening in the background but the system updates are lagging.   2. Hi fellow VJers

     

    I have a weird one - so we attended our interview this week but received an interview cancellation notice for the said interview after it was completed. Because we received the letter after the scheduled date we attended the interview as instructed and nothing was said about the cancellation when we checked-in at the USCIS center.

     

    Has anyone experienced anything similar - all I can think of is maybe there's an issue with their system...

    You'll get your EAD and AP first so should be able to apply for work as soon as you get it. Depending on what you do there's also a lot of jobs that are now offering remote work until the pandemic is over then it's back to the offices. If applying for such jobs just make sure it's not interstate otherwise they'll expect you to move.

    We're after some information / anyone with similar experience. So long story short we submitted our RFE reply for affidavit of support on forms with expiration date of March 31, this was a few days ago. Then we realized that USCIS have uploaded an updated form. Even if the forms get there by end of this week and assuming a case officer don't get to it till after March 31 would this trigger another RFE where we have to fill in new forms and send them through again or even potentially denial for sending in outdated forms?

    It won’t effect your AOS. You can file married separately and he doesn’t have to file anything unless he got a job and earned money in the US.  Did he?  You’ll pay more tax doing it that way. 

    Thank you - none of his income earned is US based, they were all isolated to Australia. Also will be filing Australian taxes when their fiscal year ends there in June.

    This is probably not a new thing but we were wondering if we should opt for married but filing separately? We got married in September and looking at the residency test my husband have not been in the country for more than 183 days. Does this mean he does not have to declare any income for US taxation purposes although we will be filing as a married couple but separately - not sure how this will affect the AOS process so any advice is most welcome.

    We live in Australia and your assets do count. No matter what you have to have the AOS but when you have income from abroad you have to have $72k in savings. We had half of that and the Consulate in Sydney told us our house would count as the rest. I got approved on the sale of our house.

    We did not need a joint sponsor, my husband (USC) just had to sponsor me even though we don't live ther but we had the cash or assets needed.

    Thanks for the above, I'm glad i came across your thread - we were wondering on using foreign assets for AOS, would USCIS require you to liquidate the assets as part of the condition for approval? I know it says can be converted in a year but it's not stating that we have to liquidate right? Weird if USCIS forces the immigrant to sell his or her assets if they use it in the I-864

    We're after some advice - when we filed AOS in 2019 (to meet the expiration of I-94) my spouse just started a new job. We met overseas in 2018 when he was on a holiday working visa. Needless to say the tax returns (2018) did not show that he made above the recommended poverty guideline. He currently makes above that however when we had to file the documents he only had his employment offer letter without pay stubs. Therefore we're expecting an RFE based on the current situation - almost a definite I would think.

     

    Hence our question is whether replying with most recent pay stubs with cover letter of the expected income for 2020 moving forward (to show above poverty) and a cover letter to further explain the situation (low 2018 tax returns, etc...) would suffice? Or do they only look at the previous year's tax return to make a decision? Understand that they only look at the petitioner's ability to support but I'm sure we'll be above poverty line when both of us are able to work - not sure  if that would make the case any better by including that in the cover letter.

     

    We're just staying calm at the moment and not panic when we do receive the RFE - understand that it can be other things on top of the above (missing paperwork, unfilled forms, etc...)

  10. Hi All!

     

    I'm a currently a little confused with the AOS forms. Long story short I have dual citizenship and I'm at the stage of filing the I-485 (AOS), I-131 (AP) and I-764 (EAD) from a K-1 Visa. The first two forms has only one field for nationality and the EAD form asks for more than 1.

     

    The question is how would one fill out the AOS and AP forms, do I list Country A / Country B as citizenship or just the passport that I used to apply for the K-1 Visa?

  11. Hi All

     

    Does anybody know if one can use an existing police clearance certificate? I have one obtained from Singapore back in early 2018 and by the time I get the NOA2 (hopefully we get approved) I would have had the certificate for over 12 months. I have not been to Singapore since the police check so logically it should still be valid?

     

    Also, can I start police checks from other countries early? Like way before I receive the NOA2? Some may take a while...

    I'm probably a little paranoid but we forgot to number the pages and add in the total number of pages on the cover letter with the application. We did however put colored tabs to each section and bind it at the top. Will this cause issues? I'd imagine it might slow down the process but will it lead to a possible rejection?
