  1. Meowboy has the RFE with him, so I don't have the exact language. WHen I get it back I'll try to remember to add something to the RFE thread.

The appointment is an Infopass appointment. I called the customer service line and they told me to make an appointment using infopass. So I set one up for Thursday.

I'm hoping this meeting will help clarify expectations for the next part of the process; the telephone customer service reps were not as helpful as I had hoped. For example, if the officer tells me that the date they use is the NOA1 date, then we might as well start working on the next petition. We don't want to waste time with the RFE/appeals if there is no hope whatsoever that these processes may result in success. We'll just get going on our next petition (which is certain to be approved).

  2. Since he is currently here, I think that would help a lot, also.

yes, meowboy is attending the meeting with me. I wonder if evidence can get any better than posing for a photo with an immigration officer and a dated newspaper?!? :)

  3. I'd be surprised if you had to start all over. When submitting proof for the RFE it would probably help to show that he's here now as proof of meeting also. But, of course, whatever the immigration officer tells you is what you should do! I'm just surmising. I've never see this situation before.

That's exactly what we're asking the immigration officer (whether we should include the current infrormation with our RFE).

  4. just to clear up a slight logical ambiguity... if someone would be so kind as to confirm or deny this...

when it says you must have met in the last two years, it means that you have had face-to-face contact in the last two years, not that you first met each other within two years.

you could have intially met and fallen in love 10 years ago, but as long as you've been together in the same place, within the last 2 years, you've satisfied the condition.

    anyone? anyone? :)

Exactly. If you met in 2000 at a party but did not become a couple until you ran into each other again in 2005, your first meeting was in 2000. But you would still need to show proof that you had physcially seen each other in the two years prior to filing.

Hard to understand why there would be an RFE to prove that you had met in the previous two years - sounds like you sent plenty of evidence. Then again, WHEN was the evidence from - when did you last meet in person?

The evidence was from December 04 and January 05, as well as boarding passes and itineraries from Feburary 1 2005. That was our last in-person meeting prior to his current visit.

  5. hmm, I wonder if USCIS used the NOA1 date?

I think they might. We had anticipated that this might happen, but it is still disappointing.

I sent boarding passes, itineraries, photos, and receipts from our last meeting, so I'm not sure what else they would want. I think the date might be the issue here...

That is how I understand it. Meowboy and I began our relationship in 1999, but our last meeting (prior to the current one since he is here now) was from mid-December-February 1 2005.

  6. USCIS guidelines state that the beneficiary and petitioner must meet in the two years prior to submission of the application. How is that two year time frame determined? Is it from the date of the NOA1, the postmark date, or some other date altogether?

    2 years prior to filing.

My question is, how is the date of filing defined? My paperwork was dated January 31, it was mailed February 1, it was received February 2, transferred and received at CSC Feburary 8, etc. Which date is applicable?

Um, the date you sent the forms.

So it would be February 1? We have a RFE and are down to a matter of days with the two-year requirement. I am trying to ascertain which date USCIS used.

I believe it would be 1/31, the date you wrote/signed all your forms.

    What's your RFE for?

Evidence of meeting in the last two years. We ahve a meeting with an immigration officer on Thursday so hopefully that will help.

is your meeting within 2 years that close to your filing date??? (As in, you met 1/31/05)?

Yes. I visited him from December o4- February 1 05.

He's actually here in the states now and I am trying to figure out if we will end up needing to reapply using this trip as primary evidence of meeting.

  9. Hi all,
Can you believe I got sunburnt yesterday when we went to the Garden of the Gods and it's hot here again today....the weather is just like Melbourne, so changeable!! bet Rings and Loke would agree! lol

I'm hoping I'll be qualified to agree or disagree over the next few weeks...first visit to Colorado approaching very soon.

Speaking of which...I'm due to fly out on Sunday and all of a sudden have hit panic mode. I have my passport, and am in the process of getting rent receipts and letter from my landlord and employer stating that they expect me back in the country after my two week stay in the States. Is there anything else I can do to try to ensure the Authorities in the States won't turn me aorund at the airport? I don't have a lease but I paid my rent two months in advance. I really couldn't bear it if I landed in LA only to find that they won't let me in the country.

I have read up on the visa waiver program and everything I have read indicates that the only documentation I need prior to traveling is my passport (it is an e-passport, which is required).

Can anyone set my mind at ease a little, or at the very least give me a valid reason for my panic? I suspect a lot of it might be unfounded but I feel awful for not panicking earlier, when it might have been useful if I have forgotten anything.

I was so worried about this as well! We are waiting for NOA 2 and Meowboy is here visiting me. He arrived April 3 and his POE was LAX. He had all of the paperwork as well, but said no one really questioned him about it. I was so relieved!

I hope that your travels are as smooth!

AND CONGRATS ON THE APPROVALS AND NEW ADVENTURES ABOUT TO BEGIN!

  10. Lots of people have mentioned expected NOA2 dates and approval dates specifically for their individual applications. It seems that these are generated on the information gathered through timelines, but I can only find the aggregate data on the stats and timelines pages.

Where can I find the timeline with the expected dates filled in? Thanks for your help.

  11. To those who asked, meowboy (David) is from Melbourne. He will be here in the States for April and May, if all goes as planned.

Pray that he'll make it through immigration for his visit. I'm just getting so nervous about it after reading all of the stories in the K-1 section about visiting on a tourist visa while applying for the fiance visa.

  12. My Aussie is visiting me on a tourist visa this week. We are waiting for NOA 2 for the K-1 visa. I told him to gather a bunch of supporting materials showing ties to Australia. Please pray that he doesn't get turned away at customs!

  13. hi and welcome meowgirl

damm all the melbournians come out the woodwork now i have left lol...

where are you in the states...???? please say up near lake erie lol lol its ok im the only one in toledo that is aussie im sure of it lol

LOL we'll be living in the Detroit area (at least for a while) so not far at all, only one hour from Toledo. There are some other Aussies in the Detroit area that I have heard of as well. I do miss Melbourne, especially with all of the snow here.

Today I got my official NOA1 in the mail. I'm hoping things will move quickly since meowboy lived here for a year in the late 90s on a student visa (that's how we met, actually). Could this have any effect on things? There are some potential issues with the visa (cutting the two year visit requirement VERY close) so I'm hoping and praying that there won't be RFEs or a flat out denial.

Thanks for the welcome everyone. Even though my friends and family are very supportive, no one can quite understand what it's like if they haven't been through this experience. Good luck to the others who are just starting out and those who are further along the path.

  14. Thanks for the well-wishes Meowgirl and likewise back to ya....where in Melbourne is your man from...?

    Meowboy is from Heidelberg.

Melbourne is truly an amazing place. I feel sad for him that he'll have to leave such a wonderful city to come here. The benefits outweigh the costs, though. :)
