    I only waited like two months, then they asked me to file 601, I just got my 601 approved . I'm waiting to see what is next

    yes I was. I was down visiting (from a visa exempt country and had valid passport, etc. ) and was offered a job. I went to CBP to apply for work in the US, but from exiting, then re entering to apply at the POE, they denied it and put me into holding.. saying I was attempting to immigrate, so they deported me.

    I believe you would have to file 601 and 212, but after interview if the officer gives you the option

    I have had multiple people give different answers.. Is there any way to know specifically from the government, prior to applying for any waiver ( visa application )

     

    I find this information is very hard to find online, its not black and white. There are so many gray areas that it is very challenging to figure it out. 

    I do not need the "ask a lawyer".. because I have done so and each one has a different say for which waiver will be needed.

     

    If its said, "you will need a 212.. but you MAY need a 601 also"... why is there no definite answer?

     

     

    You may need both 601 and 212 or 601a depending what is his inadmisability. If criminal first get it expunged, dismissed. Immigration will allow only certain expungement and certain dismissal. You can email me

    I'm assuming they are asking for you to give them explanation of how would you, your spouse and children would be affected if living separated or in another country. Also give them explanation of why your spouse needs to be with you or your kids, like school, doc appointment, medical conditions, psychological reasons  hope this helps.

    Yes. He needs to do get rehab, interview again and make sure he is clean. Medical exam will be needed.   If that is the only reason for denial, immigration will offer s 601 after second interview a year after first interview.

    You need to reapply. Provide document regarding risk for psychological problems. Stress overwork. Tell them how the kids will be affected emotionally, psychological. If any health problems or any medical problems. Does he help with doc appointment while you work. If kids older have them write a letter stating why they need and want father here and how they will feel if he is not here. Also go to an psychologist specialize in immigration.

    Request to expediate with a written letter and proffer of why is it emergent to expediate. Ect crime rate maybe one of you has medical condition, maybe no babysitter.

    My husband and I have a difficult case. We got a very complicated RFE. I have dual citizenship. I was born in Mexico and I am requesting a waiver for my husband who is also from Mexico. The RFE stated to have more information based on hardship and credibility. It wasn't believed that I would leave to Mexico with him and also staying in the u.s. Is what I would choose since I make more money than him. We sent a psych report which was never sent in the beginning (I know big mistake). 

     

    I know we haven't gotten approved but I am being hopeful that we provided a good RFE packet to get approved. The RFE requested more evidence supporting scenerio a) hardship if I stay in the U.S. without my husband and b) hardship if I leave and live in Mexico with him. We sent a new declaration letter supporting hardship. Talked about religious beliefs, family separation, safety, mental health. We sent a psych report with an assessment. Additional letter from family. I am a teacher so we also talked about wage differences and my principal wrote a letter and my co worker as well. Our original packet was highly picked at by the officer. I am hopeful that our packet is good enough to be approved but now I am scared about the interview for my husband. 

     

      I know I am thinking ahead since most people are saying that it is taking 6-7 months for an interview. I am worried that the questions will be regarding getting an RFE or asking about me being Mexican? Does anyone have a similar story as mine. I make more money than him so we focused more on the emotional and psychological health that I am experiencing currently that will experience if I leave with my husband to Mexico and also if I stay here without him. Just wondering if anyone has something similar.

    Leaving to Mexico should not be an option. If you have kids your kids have right to Education here and Medical health here. You and your kids and husband have better opportunities here. Both of you know only how to live in the USA. If 601a approved and your application is true and correct then your husband should not have problem answering correctly. Everything that is in your application should be answered same verbally. If he does not have any criminal history other than traffic tickets then their should not be any reason for denial at interview.
