We filed my husbands I601A waiver Nebraska
April 2019
May 2020 asked for more evidence
Aug 2020 approved.

Hello everyone, I just wanted to update on my case. CC with NVC - March 4, 2020. Interview - July 24, 2020. Now I am back in the U.S.  I wanted to thank to this group for the support and to send a special thanks to Jane88 for her guidance. Good luck to all of you who are still waiting!

Hey Everyone ! 
Here’s a video I did regarding this whole mess we are in. I’ve sent it to a few local News Stations around Los Angeles. I’ve heard back from 2 already. They would like to talk over the phone to get an actual in person interview.... let’s cross our fingers it happens! We need all the news to hear about this!!! 

I haven't heard of 601a denials due to public charge. I've seen an approval of 601a that couldn't move forward b/c beneficiary couldn't find a co-sponsor . The only denial of 601a I saw when applicant was in deportation proceedings. It seems the new rule applies to adjustment of status applicants only; I am guessing there should be some rules for consular officer to determine if Visa applicant is public charge. In 2013-2014 there was a "reason to believe" rule to deny 601a if there were other inadmissibilities of the applicant, later this rule was cancelled to simplify the process. I don't see why they would deny 601a based on public charge (in some cases hardship is only medical or it's about relocating so they don't have evidence of using government assistance anyway).

After 11 long lovely months I received my interview appt for February 4th 👏

In my RFE I was asked for proof of hardship in separation scenario - more evidence of emotional/psych hardship. They said that statements in psychol. report didn't raise to the level of the extreme. So we submitted a mental health evaluation from a doctor specialist (about 1 page statement) about how my husband feels due to threat and fear of separation and that his prognosis will be worse without my support (some family doctors could do this kind of basic eval.) The doctor recommended him some medication and we included receipts & info sheet. Also, we sent 3 new letters from friends talking about the devastating impact of separation; latest photos, trips together, DOS travel advisory about crime against foreigners, language barrier (if my husband would travel to visit me) and job loss due to the need to travel to visit me often and having limited vacation days; financial burden due to high cots of airfare (we incl. a screenshot or airfare). Again, we have no kids, no debt, no other financial hardship.

This is an important step forward but the time to celebrate starts after we are successfully admitted back to the U.S.

Hi guys! I just got back from my home country! Everything went well and I should receive my green card in a few weeks!
No need to be nervous or anxious about the consulate interview! Be prepared to answer questions confirming the information on your DS260 and you will be okay. Don’t be discouraged if you haven’t got your approval yet or if you got an RFE I know it’s hard and that things are taking a lot longer on this administration but your day will come too and it will be all so worth it! Let’s keep informing and lifting each other on this thread! 🙏🏻
