Just did a search about splitting money orders up and lots of others have said it's okay, so I'm honestly not sure what is triggering your rejection. Were the money orders from an institution located in the U.S.?

It's worth a shot to try that but I'd wait and see if anyone else notices anything that could be the cause...

    good luck!

Yes they are from Publix,  I know, it's frustrating, I know  people who send them separately and have not had any problems, in fact there are institutions that do not sell money orders over $500.00

Unless someone weighs in with a better answer, I'd try again with one money order for the full I-485 fee of $1140 and keep the other fees separate like you already have. I'd also just do some searching in here to find other people's accounts of having AOS sent back for incorrect fees and see how they successfully solved it.

Another thing - your son is under 13 years of age, correct?

    Yes, he is 11

The first time they returned it was for something different with the same money orders and they did not say anything about the money orders.
Yes, money orders are made to the Department of Homeland Security.

If that is the case, should I make the money orders again? 1 for $ 1140.00 for I-485 and another for $ 85.00 for Biomeric for my wife or do everything together for $ 1225.00 and $ 750 for my son?

No, it does not say for me to  submit the fees in the exact amount. It dose say please resubmit the application with the appropiate fees

    1140+85 for you wife only。

What about my son ? $750.00 only ?

Just a guess - could it be because you split the I-485 fees into 3 separate money orders? It does say "You must submit all fees in the exact amount" on the instruction form. I realize that's open to interpretation but technically you submitted the fees not in their exact amount. Did you split it into 3 money orders the first time it got sent back too? Again, that's just a guess based on your description. I have seen people get the I-485 rejected for combining fees before, so that also might apply for splitting a fee?

Also - did you make the money orders out to "U.S. Department of Homeland Security" ?

The first time they returned it was for something different with the same money orders and they did not say anything about the money orders.

  5. Good morning, this is my case if someone can help me.
My wife entered the United States with her son with a K1-K2 visa, we got married in 90 days and sent the AOS, now the entire package was returned along with the money orders with an I-797C that says.

THIS REFERS TO THE I-485 APPLICATION TO PERMANENTLY REGISTER OR ADJUST TO THE CONDITION, YOU SUBMITTED I-485 FEES AND YOU WILL BE RETURNED TO ANY SUPPORT DOCUMENT FOR THE FOLLOWING REASONS:
THE AMOUNT OF PAYMENT IS INCORRECT OR HAS NOT BEEN PROVIDED. PLEASE REVIEW THE INSTRUCTIONS FOR THE FORMS TO OBTAIN INFORMATION ABOUT THE PAYMENT.
PLEASE, SHOW THE APPLICATION / REQUEST PACKAGE WITH THE APPROPRIATE RATES TO THE ADDRESS THAT APPEARS ON THE BOTTOM OF THIS PAGE.

    For my wife I send 4 money orders, (2) of $ 500.00 (1) of $ 140.00 and (1) of $ 85.00 for a total of $ 1140.00 of I-485 and $ 85.00 for the bio metric service
For my son I send (1) money order of $ 750.00.

For each one of them I send the forms
    I-485
    I-131
    I-864
    I-693
    I-765

Can someone tell me what's wrong? or the best way to send all the documents. It is already the second time that the packages are returned to us.
    PLEASE HELP
    Many Thanks

You don't need thei-693 either, as a K-1 and K-2 they already had their medical exams in their home country. Just send in a copy of the DS-3025 that they received at the medical, it should be marked "complete".

Even if it's been more than a year since the last exam. We have the new one that is dated 3 months ago and it was the one that we sent along with the whole package that they returned to us, USCIS opened that envelope and returned to us.
    Thank you

  7. Definitely, the process of assembling the packages has been much easier after the help of all of you.
    Now another question.
What should i do with the I-693 and the medical results? The same documents need to be  sent back to USCIS or we have to go to the doctor again.
If we send the same documents,  what happens if on that I-693 my wife has her birth name and in all other forms she has the married name ?
    Any Advise.

    Many Thanks

The fact that your I-485 application was rejected because USCIS said that your priority date was not current suggests that either: a) USCIS made an error; or b) you did not confirm that the priority date was current based on the Visa Bulletin. Depending on the relationship between you and your family member, your family member may have to wait before applying for AOS. The priority date must be current on the date USCIS receives your petition. USCIS has been making many errors lately. If the priority date is current you could try re-submitting with a copy of the Visa Bulletin if you are confident this was an error. Make sure the form is filled out correctly.

USCIS said that the I-130 must also be concurrently filed with the I-485. If one form is rejected they said that they can't accept the other. I don't know your visa history, but you should look into this.

The I-131 application for Advance Parole based on an AOS application will not be accepted by itself.

One of the forms you completed is outdated. Always check the USCIS website to ensure that you are using the correct forms.

MAKE SURE YOUR FAMILY MEMBER HAS AN UNDERLYING IMMIGRATION STATUS TO KEEP HIM/HER IN THE U.S. LAWFULLY. Be mindful of expiration dates. Check I-94 records.USCIS just issued a new policy this summer that foreign nationals who fall out of status can be fast tracked into removal proceedings in situations where this would not occur in the past, even for minor infractions. I just listened to a national USCIS conference call on unlawful presence yesterday and it was chilling.

Lastly, this is not legal advice and I am not aware of your full situation. I HIGHLY recommend that you consult with a reputable, local immigration attorney. Check out AILA (American Immigration Lawyers Association) as opposed to a Google search.

The immigration landscape has become hostile and increasingly complex. DO NOT DO THIS ON YOUR OWN. Always work with a reputable immigration attorney. Be mindful of any attorney who offers "money back guarantees" or touts their success rates online. If it sounds too good to be true, be suspicious.

Then let me inform you of my case to see if you can send me more accurate information.

My wife entered the country with a K1 visa and her son with a K2 visa, we got married within 90 days but between filling out the forms, seeking legal help time and money we were not able to apply for the AOS within those 90 days. We found legal help and this was what she told us we had to do.

fill out form I-485 for her and the child (Money Order $ 1140 and $ 85 her $ 750 the child)
fill out form I-864 for her and the child
fill out the I-130 form (for me and her) and the child (Money Order for each of $ 535)
fill out form I130A for her
fill out form G-325 for her and for me
fill out form I-131 for her and the child
fill out form G-1145 for her and the child
the I-693 form for her and the child

All that together with all the proper documentation (I-94, Taxes, etc)

We sent the package and approximately 21 days later all the 2 packages were returned with the Notice of Action (I-797) mentioned in the forum, this is where the stress began that I thought I had left behind when the packages were sent.
I present my case in this forum and the confusion begins as I was informed that there was no need to send I-130, I-130A, G-325 and that I have to fill out I-765 for the child so that he can opt for a social security number.
I will like to send the new packages my self for money reasons, this is why im looking for more accurate information.

I forgot to mention that yesterday I contacted a USCIS representative in the Live Chat and confirmed that the I-130 is not necessary

So far I am following the instructions of the link that forum members sent me

    Thank you very much

Um.....who exactly told you this misinformation??? Other experienced members have provided a link for you to review regarding YOUR process. Please take the time to go over the information in said link and follow it accordingly.

They guided me wrong, it was a wasting of time and money, but thanks to this forum I think it will be ease to resend the package, I will definitely take time and precaution to fill out the forms.
Once again thank you very much to all of you

I'll keep you all updated !!!!!!

  10. Now that I don't need the G-325 form and the I-130

    It came donw to this

I-485 (1 for my wife and 1 for her son)
Money order of $ 1140 for my wife $ 750 for her son and $ 85 for my wife
I-864 (1 for my wife and 1 for her son)
    I-765 (for my wife)
I-131 (1 for my wife and 1 for her son)
I-693 (for my wife and 1 for her son)
G-1145 (1 for my wife and 1 for her son)

Should I send all the Notice of Action I-797 (7 in total) that was sent to me, along with the new packages.

Should I fill all the forms again  with the most up-to-date date because the I-864 forms are outdated and I need to fill new ones but i don't know about the others ones.

In the I-693 of my wife she appears with her birth name, and in the rest of the forms appears with the new name (Married Name) That could be a problem?

Please if someone can help me with this information.

  11. After having contacted a USCIS representative, he confirmed that it is not necessary to send the I-130 form as you indicated.
    The question now is.

What to do with all I-797 (Notice of Action) that I riceved

The only forms to fill would be

I-485  (1 for my wife and 1 for her son)
Money order of $1140 for my wife $750 for her son and $85 for my wife
I-864 (1 for my wife and 1 for her son)
    I-765 (for my wife)
I-131 (1 for my wife and 1 for her son)
I-693 (for my wife and 1 for her son)
G-1145 (1 for my wife and 1 for her son)
G-325 (1 for me and 1 for my wife)

Make sure all the forms are actulizaded.

There anything else that I need to know before i take any further action ?

She came on a K-1 and the child on a K-2, so the lines above referring to an I-130 for a K-3/K-4 does not pertain to your case.

Follow the guides linked above. They cover AOS from K-1.

I'm not sure what you are quoting from. A K-2 AOS applicant does not need an I-130 (unless the marriage was after 90 days, again).

After having contacted a USCIS representative, he confirmed that it is not necessary to send the I-130 form as you indicated.

G-325 (1 for me and 1 for my wife)

Make sure all the forms are actulizaded.

  13. Looking for information on the USCIS website I found this for the requirements of an AOS
Copy of approved Form I-130 or I-797, or Notice of Action if Form I-130 is pending (if you have a K-3 or K-4 visa)

My wife came to the United States with a K1 visa as a fiancee and her son came with her and we got married within 90 days. What you are informing me about the I-130 that I do not need is true in my case
Sorry for the inconvenience but I'm confused because there is so much information on the internet
