Now, I can see that my documents were received the first week of September but the NOS is not listed in the site.

     

    I was wonder if they don't accept the NOS if it arrives before the package with the case documents?! Did anyone here face similar issue?

    it takes about 2 weeks, at least mine did. On the second week mark, I emailed them. Also, I'm counting from the day that it arrived there, cause you there are a few days that the USPS takes to deliver it.

    I was sponsored by CAPES during my postdoc and had to come back to Brazil for a year to get a "No objection letter" from them. Then, I applied for my J-1 2-year-requirement waiver this week, when I mailed all required documentation to the U.S. Department of State.

     

    The real problem came up when I sent via email the documentation (CAPES letter, DS-2019 forms, passport etc.) required by the Brazilian Embassy in Washington to issue my "No objection Statement". Although the U.S. Department of State requires this document to be sent directly from my home country's Embassy in Washington, the Brazilian Embassy replied my email explaining they will not proceed with my requirement because I am no longer living in the USA.

     

    I have sent emails and called to a bunch of places, like CAPES, Washington Embassy, US Embassy in Brazil and so forth but all of them said they could not help me.

     

    Has anybody gone through such a similar nightmare? Any tips you guys could provide me?

    Hi, Im from Brazil, and I have never heard about that. It might be worth it to get a lawyer ( I did not use a lawyer for mine). I don't think DoS would accept if it is not sent by the BR Embassy.

     

    Good luck! And be patient, it takes forever.

    I am trying to do a little bit of damage control here. DOS received all my paperwork and NOS on 1st of August.  They haven't issued my recommendation yet, but I expect to see it these days. However, I am a little bit anxious about UCIS. I wonder if anyone with a CSC case waited for 12 months.

    I don't want to be a party pooper, but few of us have been waiting for 2 months or more for the DoS recommendation. They say the normal wait time for recommendation is 6 - 8 weeks. I do hope your case gets approved faster though.

    Mine NOC was sent on August 21st and there is no update on DOS website yet.

    When I contacted DOS they said that I should ask the embassy to fax the NOS directly to their office.

    Let me know how long it took for you guys to get the NOS updated

    Mine took 1 month, and I emailed them after the second week and took them another 2 weeks to update the system.

    We are all pretty much on the same boat. Mine has been 9 weeks. I developed a theory ahaha...

     

    Most of people who had their waiver approved fast was because they submitted the fee all the paper work (except for the NOS), and then went to get the NOS. In your case, and mine, I did all the NOS and then proceed to pay the fee and send the rest the documentation. Even though they say that the time only counts after the NOS arrives, I dont think that the position in their line is by NOS arrival order, but instead by fee arrival order.

     

    Anyway, I digress. Nothing to do but wait.

    So, not really helpful. I just check the website 4x a day, it is fine... Im not anxious... ahaha

  11. I sent an email asking for an update 2 Fridays ago (08/17) and I haven't received any response and my status is still pending. I'm sure I'm not the only one on that situation. My theory is that people responsible to evaluate the cases took vacation over the summer...

     

    Has anyone with the 6-8 weeks mark heard anything? I'm on the 8th week and no updates...

    I wonder if the average 6-8 weeks refers to DoS or DoS+USCIS? I don't know... seems unpredictable

     

    Yeah, Coco8 is right. It starts to count when they received all the documents (usually the NOS is the last).

     

    And the 6-8 weeks is for the DOS only, however, if you need this to apply for an adjustment of status, the DOS favorable recommendation suffice.

     

    This 6-8 weeks rule is also just for reference since they can take how long they want. Which sucks, because it took them 1 month to receive my documents alone (counting from the time it arrived there according to USPS), and has been another 5 weeks.

     

    It is just a rant here, but I would like to know the % of denial for the No-Objection processes. Like, if my government is ok with it, what is the big deal? Anyway...
