  1. Hi..our 1751 package was sign for on Aug 8 and the check for the fees is showing up as a pending transaction at my bank today. So it should be cleared tonight.

I do have a question. I fail to put a copy of our marriage certificate in the package. I had it listed as one the documents that was included in the package on the cover sheet but some how flat forgot :cry2: to put a copy in the package. In my opinion that should not make a difference since clearly the marriage exist for my I30 application to get approved.

Do you think I will still get the NOA without any delay?? My husband current GC expires Oct 26 so we have time but it would certain be wonderful if we can just get this part behind us B)

    Jenice

Why would we need to send a marriage certificate if they got one during the AOS process?

I noticed someone got an NOA1 from the VSC so hopefully we will get ours in the mail in the next day or so. We are off to worlds of fun in KC for the weekend in the morning, hopefully it will be in our mailbox when we get back.

  2. u dont count the marriage anniversay date, i am not sure but i can tell u one thing that anniversary date has nothing to do with ur papers.

u count the date u came to usa and wait two years or before 90 days of two years then file for it,

    good luck

    abid

Your wedding anniversary does have an impact on the initial entry. If you would have had your second anniversary before your interview you would have gotten an IR1 instead of CR1 and you wouldn't have had to remove conditions.

  3. Thanks so much taby and albert. Also, Buggy, i would suggest that she bring her vaccination records, so she can get it transcribed. she will need to have it for the AOS process, or she will have to get all the shots over again.... EXPENSIVE!!!!! since she will probably not have insurance right away when she enters. Plus, regardless, its an uncessary expense if she has already had the shots.

This is why I said to call the CS first to verify if anything needs to be translated. I only mention this because my wife went to the Dr in Juarez just because she had some problems and her Dr here was unable to understand the medicines and MRI report from Mexico so he had to have someone translate it first. I would just ask the CS before you make a trip?

No translation needed on the vaccinations. They only need to transcribe them to the correct form. The Civil Surgeon would know the correct form. Go got the USCIS.GOV website and search for the Civil Surgeons in your area. I would call and shop for the best deal. Some will try to tell you he needs the whole medical examination, so tell him he only needs the transcription of his vaccination records. If he is missing any vaccinations, they would let you know.

  4. Hi everyone, i have some questions about the AOS process that i am hoping that you guys will be able to help me out with so my husband alfredo can get his green card.

On the form I-485, the instructions in USCIS say that i need to attack a copy of fiance pettion approval notice, is that the letter that i got in the mail that reads "Dear petitioner: The state department's natinal visa center has recently received an approved -129F petition filed on behalf of your fiance. THis letter is to lt you know that within a week the petition will be forwarded to the appropriate visa-issuing post where your visa interview will take place." And then it lists my husbands name, the INS receipt number, the case number, and where the case will be processed at. Is that the letter that they want a copy of? If not, can anybody give me a clue as to what they want????

It also said that i have to include a form of I-94, that is the page in alfredo's passport right? I just need to copy it?

And also, they want me to submit the vaccination supplement, that means that it needs to be transcribed right? Do i have to translate it, or is that what the surgion general does? I really dont know what transcribed means, but a woman told me that that was what i had to do with alfredo's vaccination records that he brought from mexico. Has anybody done this? What do they do/what do i have to do?

Just send copies of the documents requested (NOA2 for your I-129 approval), not the originals. Make color copies of all the pages in his passport with information including the k1 Visa and the I-94 he got when he enterred the US. I would call the civil surgion that you will be going to and ask if they need it translated before you go. At the CS they will fill out the vaccination suppliment form that you will send with your AOS package.

  5. You enterred legally so you have every right to adjust status here after you marry. The best thing to do is get married and then file AOS and I-130 simultaniously. The sooner you do it the sooner you can stop worrying. Why didn't you get married before the children were born? The sooner the better.

  6. Hi,

I entered the US with a visitor visa (which was valid for 1 month) in 2002.

    But stayed here since.

Then married a US citizen in sept. 2007 (we had a child in 2006).

We decided to get the green card processed.

So we have to begin with the I-130, my question is :

do we need a valid visa to fill the i130 ?

    (my paaseport is still valid).

    Thanks for you help,

    Happy New Year.

    K-and-J

You should be filing the 485 along with the I-130. You entered legally so you are supposed to file AOS and I-130 simultaniously.

  7. Did not mean to do a double post like that....

Anyways, I am glad that I bought her ticket yesterday to Acapulco because there are no tickets available right now!!

To clear things up a bit Diana got to the embassy at 8am and said she was waiting outside for almost 5 hours in the cold before being allowed in. Then everything went smoothly and she made it out with her visa by 5pm. They asked her very basic questions (How did you meet? What does he do? etcetera)

When is Diana flyinh to the US?

  8. My wife spends about 50 to 75 bucks a month calling her mom. We have a plan with At&t that has international calling. It is about 9 cents per minute. The plan adds 5 bucks per month to our phone plan. If they ever get VOIP phones in Mexico I will probably buy one for her parents and pay for the internet service. It will be cheaper than her monthly phone bills.

Talbert-- Skype has a plan where you can call landlines unlimited for $5.95/month to Mexico City, Guadalajara, and Monterrey. Outside of those three cities it is 2 cents / minute. And Skype always has free Skype to Skype. I am assuming you have the internet so all you need to do is get a microphone. Then if your wife's parents have the internet too, all they would need is a microphone. Then you each go to http://www.skype.com and register a name (for free) and you can talk unlimited (for free), as often as you want.

Here is the $5.95/month 2 cents/minute plan to landlines, 20 cents/minute to cell phones: http://skype.com/allfeatures/subscriptions/mexico/

Thanks I will try that. Congratulations!

  9. Really the only one that could get in trouble would be the employer if they were caught. If they are using a valid SSN for themself and already have a job they may let you work if they don't ask for new documents? If you are trying to get a new job then you won't be able to work because you won't have the needed documents for employment.

  10. I will have to see how much it costs to call, but i know its not alot because it charges the same in the U.S as it does in mexico, and if it costed too much, no1 would have them, and i know all the mexicans i know have 'go' phones, they are easy to keep up with, there is no contract, and you pay for what you use! i will ask alfredo, or even look online for you so you can decide if you want to buy them for your inlaws.

The cell phone my wife had when she lived there was a pay as you go type phone which her mom has now but the minutes are expensive compared to plans like we have in the US.

  11. I found this really cool way to call Mexico, it's called Jajah at www.jajah.com and it costs only 6.4 5.8 cents per minute. You can call from your cell phone, land line, or computer.

Nice! The website is showing that it costs 5.8/minute to a landline, thanks for sharing the nice find.

The problem with Diana and I is that we are in a no win situation with phone calls because Diana's mom doesn't have a landline, she only has a cell phone. JaJah charges 31.6 cents per minute to a cell phone... Now if she could just get the internet in her house Diana and her mom could talk for free on Skype.

  12. alfredo has a 'go' phone, and it worked in mexico. It didnt charge extra to send or recieve text messages and calling didnt cost extra either. it costs the same here as it does there, plus, you can load money on the phone without physically having the phone with you, like when alfredo was in mexico, he needed more money on his phone, so i loaded $15 onto his phone, and they send you a free text message letting know your updated account balance. It worked in juarez, but also in alfredo's home town, which is like the center of mexico in the mountains.

How much per minute do they charge for the Gophones? I might buy my wife's parents one.

  13. yah, i know, i wasnt going to buy the ticket until i know he is approved, and i have to buy him his ticket around my work schedule so that i can go pick him up.

Can anybody answer my question about the boarder office??? if thats the name of it, and if thats where alfredo needs to turn in his packet of papers. Please? All i know is that alfredo has to turn those papers in at his point of entry so that he gets his I-94 stamped in his visa or w/e, im assuming that they are going to give him more information when they give him the packet. They cant just shove some papers at him, and not explain to him what he needs to do with them, right?

He does not need to go to the border until he is ready to enter the US.

  14. Congratulations everyone! I'm glad to hear the new consulate is open, it is a little safer area there. My wife just flew to Juarez Wednesday to visit her family for Christmas. I am driving down on Monday and spending the week of Christmas there. It's sad that it is becoming so dangerous there. I talked to my wife yesterday and her family told her it just isn't the same there, you have to be careful everywhere you go. I found this really cool way to call Mexico, it's called Jajah at www.jajah.com and it costs only 6.4 cents per minute. You can call from your cell phone, land line, or computer.

  15. Just saw Gaby&Talbert's post. I would trust the regulars. But I would still hate to be out of status for a prolonged period of time. But trust the regulars. :star:

    Brian

It is a gray area about K1, according to the rules and some of the other long time members you only have to marry before the 90 days, a waiver is needed only if you marry after the 90 days. Applying for AOS does not have to be done within that timeframe. You wont be out of status as long as you marry within the 90 days but you are stuck at home with no way of working, driving, school, anything until you start the AOS process.

  16. Hey everyone, i have a question. How long can Alfredo and I be married in the U.S before we apply for the AOS? Just a question because the AOS costs 1000+ dollars i believe with all the fees with the fingerprinting and everything, and we just dont have it right now. Let me know what you think or what you have read.

The is not set time to apply for the AOS if you are a K1. The only rule is you have to be married within the 90 days from entering the US. Just make sure you keep a copy of your marriage license with you once your I94 expires because that is proof you complied with USCIS rules. He won't be able to do anything like get a license or work or travel outside the US until you get your AOS, EAD, etc..
