    I agree with you unless I am missing a very basic point then an overstay is an overstay regardless of the timing of a marriage. It is the application for AOS that triggers the commencement of the (hopefully) forgiveness of the overstay not the marriage itself. People are as far as I am aware still at risk of removal after marriage if they have not commenced an AOS application. If I am incorrect perhaps someone can let us know?

  2. I do understand that some people are new to the USA but there is an irritating little thing here called the constitution and a presumption of innocence until proven guilty not the other way around. :whistle:

    In the name of the Constitution, may I know? are they guilty or not?...

    Following due process an trial by a jury of their peers you may know the verdict reached ;) Assuming of course that it ever goes to trial. I find it incredible that so many people who bemoan the fact that the immigration process is unfair, takes to long etc etc etc are so quick to leap forward and make judgements without any substantive evidence, knowledge of the case or any clue of what has really gone on other than a newspaper article ( AND WE ALL KNOW HOW RELIABLE THOSE ARE DON'T WE?)

    I wonder how the hang them high mob would feel if someone in immigration said oh well those Irish/Poles/Indians/Insert any other nationality you feel like are all sham marriage people we will just deny them without even looking at the paper work, would feel?

    This board would be hopping with cries of outrageous indignation and protest. Yet some think it is perfectly fine to apply the same principle to the accused in this case? :unsure:

    Personally I have no wish to live in a country where (in)justice is administered by a lynch mob, and for those that do be careful what you wish for because one day you may just find yourself on the receiving end rather than as a member of the baying crowd. ;)

    Ouch! i pushed on a sensitive button lol...interesting that you state either from ideas that do not exist (immigration are not supposed to discrimate races) or exist (yes injustice is everywhere), tell me in which country or places you did not see injustice-s...we all are in those boats and experienced injustices...What I say...the least we can do if we have not the deicisional power is to try to think and think right...In the long run, that will make a difference.

    Oh, and I agree the point that the medias arouse mass hysteria...but, i would answer, yes, maybe sometimes they also reveal what is kept secretive for quite long time..for that they also might be useful...there also are medias that are engaged in social justice you know...to seek the truth, make just investigations....And in this case...i tend to believe my intuitions...even if we do not know yet what's the truth...the only thruth i know is the least i can say, is that something is very fishy...and that kid is not happy...it's all I can say for now...

    I don't think I posses a sensitive button:p Ho ever, I do enjoy a good debate just for the sheer heck of it and this is always a good topic to get people going on both sides of the fence :D

    Perhaps I was a little unclear in my original post as you seem to have misunderstood it. My reference to injustice was directed to the concept of a lynch mob applying justice rather than due process.

    As for the media? Well they sell advertising to make money and try to make themselves appear 'professional' by providing ####### bits of gossip dressed up as journalism :P Still their product is good for wrapping fish and chips in :D

  3. I just did that travel agent link posted above and it gave me prices about $100 more expensive than what I found on priceline. I think prices in general suck lately though.

    If you are referring to the ITA link I urge using caution. ITA is NOT an Agent but rather provides real time availability and ACCURATE pricing which changes literally by the minute It is much more up to date than price line, expedia or anyone else. They show base fares before the application of an agents mark up. Many times on 3rd party travel sites you will be presented with a fare only to find when you go to book it is unavailable and the price has changed. My own practice is to use the month long search facility and identify the best fare then grasp the phone and contact the airline directly to avoid mark ups and quote them the fare class and ticket type.

    Airfares are governed by yield management which is not only extremely complex but also very boring :P

    It is also important to remember than some classes of fare issued to consolidators are rigid and allow for no flexibility at all such as change of date, time, return etc without incurring large fees which can be up to 100%+ of the original fare.

    As with any purchase it is a question of buyer beware however the airlines suck more than most suppliers in baffling the heck out of their customers!!!!!

    Amed and I are looking at tickets to go visit his family in Algeria in the late spring. I've done some research on expedia and on a couple of airline websites, and the cheapest I'm finding is $1200/each. Is this as good as it gets? Is there somewhere else I should be looking? I've never been to ME/NA. I'm pretty good at finding cheap-ish flights to Europe, but when going farther afield, it seems to be a whole different ballgame.

    I'd welcome any tips! Ideally, we'd like to spend a couple of days in Paris before heading to Algiers.

    Before people suggest various travel agencies I would point you a step further up the food chain. This is a non commercial site which allows you access to the systems the travel agents use and shows the base fares plus a full breakdown of taxes charges etc and the booking classes and type of fare. You can not book with these people it is an industry search engine. What you can do however is take the information to a local travel agent and have them book it for you. I hope that made sense :unsure:

    There is a FAQ link on the site and instructions on how to you it. You do need to register an account which is free and painless. If anyone gets stuck on it please feel free to PM me and I hope you find this useful. :D

  6. ..... Apparently this American sponsor is a real control freak (I don't even know why he sponsored her in the first place but I believe he has a negative history with sponsoring others....) and he wouldn't let her complete the AOS process....

    I would suggest that there is rather more to this story than the brief facts given. There are three sides to every failed marital story, the mans, the womans and the truth! ;)

    It is often difficult enough for people to give good advice when all the facts are out in the open. To give advice based on a one sided hearsay appraisal of a situation would not perhaps be the most prudent action.

    It really isn't a big hassle to get an ITIN. You can complete the form online BY CLICKING HERE then simply print it off and send to the address shown together with your tax return.

    The decision as to how you file is yours of course but if there is a financial advantage to claiming a dependent then why not take it?

    IRS is not concerned with immigration status.

  8. I'm concerned about the proposed legislation. I'm concerned whatever meaningful portions of it that do come to pass will only benefit business, migrants and the like. I'm concerned for families.

    Your last comment - about the obvious - that's the part America needs to be made aware of. How the 'protection' that these clearances are supposed to achieve is hardly effective when it becomes protracted.

    My crystal ball predicts that any proposed legislation will be watered down to appease both sides and the end result will be any such legislation that actually makes it to the statute books will be within an economic rather than humanitarian frame work. This is not anything peculiar to the USA it is seen in immigration law throughout the world. I am not in disagreement with your viewpoint and beliefs just rather more cynical. :P

    With regards to edumicating the country I again empathise with your position but fear that the large number of people who believe that removing your shoes at an airport makes us safe really won't pick up on the subtle points you wish to convey ;)

    Oh well c'est la vie the wait goes on. Besides if it all went smoothly where would all these people post if there was no reason for VJ to exist? :o

    Interesting to note the views on immigrants even by those who are able to differentiate between legal and illegal immigration. Immigration is a political hot potato.

    Supporting immigration is not a vote winner which ever way you look at. Oh sure noises are made in pre election speeches in districts that have large immigrant population, but do those platitudes ever transform into real political action once in power? I think not, but please feel free to post a link to such an act by a politician of either party.

    The great unwashed do not listen to reasoned debate or apply critical thinking skills. They listen to the soundbite that tells them immigration hurts them and America. Hence there is never any serious immigration reform but rather a muddle of poorly drafted legislation to give the appearance that something has been done. If you seriously believe that there will be any sensible or meaningful immigration legislation passed in the term of this presidency then I respectfully suggest you blow the smoke aside and look in the mirrors that are revealed. Because like it or not, in essence smoke and mirrors are all that offered by either party when it comes to this particular political 10 foot barge poll.

    People vote for what they perceive to be the best for themselves, their families and their pocket. Most people fail to see immigration legal or illegal as positive for any of those.

    Do we find it frustrating, annoying, incredulous, obscene? Heck yes of course we do, but that is because those of us on here have an intimate knowledge of the situation. Sometimes to intimate in that it clouds our judgement on the real perception that the rest of the populace have with regards to immigration benefits.

    By all means educate people, publicise the insanity of a situation that can leave a person in limbo for two years on the basis of needing background security checks. Heck does anyone really think a terrorists who is in the country and intent on causing mayhem is going to wait two years to have clearance before committing such mayhem?

    The answer to that is obvious - unless of course you are a politician or an employee of DHS :P

    The sad fact is no one really cares other than those of those affected by it. The vast majority of people are on the current anti immigrant bandwagon. They rarely know nor care that there is a difference between legal and illegal immigration and frankly it isn't a vote winner on a scale large enough to matter to politicians. So whilst I agree informative publicity (and I reserve judgement as to whether or not this broadcast is such until I have seen it) is never unhelpful, I do not hold out any great hope of it being anything in the great scheme of the universe than a filler. ;)

    Of course if the programme causes enough of a stir (which I doubt somehow) then the obvious knee jerk response is that positive discrimination is applied so the FBIare not seem to be discriminating against Muslims which puts everyone else including the OP further down the list!!!

    I am not sure what the intent of the OP was other than to say here is an example of the media missing the point entirely as ever and being sensationalist for viewing figures. :unsure:

    A non event is the likely reaction by most viewers is my suspicion.
