  1. I'm moving to the U.S. in a month (RI to be exact). I have a job lined up, a place to stay and alot of friends in the area. I'm moving on my own. Not for love but making a personal choice. I can sympathize with how your feeling. Although I've done my research and know the area VERY well, I'm still scared to leave my family. And although our situations are different, I can safely say that I'm scared but exhilarated with the change.

    But to be honest, I'm leaving a bad situation. My current job is in question, with many former co-workers moving to work for the competition. Things are very ugly for me professionally that I feared that if I didn't cease an opportunity, I would definitely regretted it. Honestly, if I didn't have this move to look forward to, I would've definitely had a nervous breakdown by now. The argument of people in Canada vs people in the US is really irrelevant because it depends on where you're moving or live and who you know. For me, I live in Winnipeg (the confirmed murder capital of Canada). Don't get me wrong, Winnipeg can be fun sometimes and has a great cultural diversity, however, there are obvious problems that the city faces as well as the overall ho-hum attitude of Manitobans in general. And as a professional graphic designer, for 8+ years I've been searching for opportunities in the area for sooooo long with none to be found. Unfortunately for someone in my profession, Winnipeg is not a major centre and there are not alot of opportunities. I fear that if I waited for my job to fold, which is inevitably going to happen, I won't have a heck of alot of luck finding anything remotely close.

    So when an offer came I sat on it, thought about it, did the numbers crunching and said what the hell, I have no kids, no debts, no marriage, now's the time to take a risk.

    In my opinion, your doing the right thing. No kids, no debts, no marriage. You have nothing to lose. You will be fine.

  2. You are in perfect position like us! You also abandoned the GC same like my wife.

    Now your petitioner has to file entirely new I-130 form. Never put YES to Q#16. You should put NO.

    Section D: Q#2: YES. Name of the beneficiary, place is which service center. Filing is previous I-130 filing date. Result: Approved.

    You need to somehow retrieve your previous A# which may need to be filled in G-325A.

    Where did you abandon it? At border or in the Montreal Consulate? Did you file I-407 as part of the surrender? Did you get a copy of it?

    WOW!!! ok, I will put NO. on question 16, first page of 1-130. I figure that proceeding must mean something else.

    Would my alien # be on the old passport visa? There is a number there. I abandent at the Maine border. I turn the card in because the guard told me I had to, because I was going in Canada to seek medical help. You cannot have two addresses to use the medicare card, it is called fraud. We are hurrying before the year is up. It will be one year on November 13,2010 since I left the USA.

    If you don't mind me asking, what happened that you and your wife is going through the same thing. I truly understand how hard it is, we are in the same boat. I hope we can help each other.

  3. We are also in the same boat. My wife went back to India after getting her first green card. Now I am filing her second green card.

    I think you also had previous GC.

    Questions:

    1) When was it issued and expiry? Is it CR1?

    2) Did you take re-entry permit?

    Explain in detail, then I can give you better answer.

    It was a CR1, my interview was in Montreal sometimes in April 2009. I entered the USA on July 19,2009, I left and abandont on Nov 16, 2009. No, I didn't take a re-entry because in Canada you cannot have two adress to use the medicare card. I was explain that at the border when I cross over back in Nov, 2009. My husband and I file our first 1-130 back in June 28, 2007. We married in the USA on June 16,2007. We had no problem being approved.

    I do have the old passport with the old visa in it. It is expired for sure. I cannot remember my alien resgistration number which was given in the mail sometimes in August of 2009. Is that enought?

    I have a question concerning Form 1-130. First page question 16.( Has your relative ever been under immigration proceedings?) The answer is yes,but I don't understnd where. I was process in Montreal, is that what I put and the date of the interview? It was approved, do I check-mark the approved section? Also second page section D other information question 2. The answer is yes, place? and the date of filing and results? What is excactly the date of filing mean?

  7. Hey, I know how you feel

    It is true, the woman gives up so much. But, don't leave, I did, and now starting the whole process all over again.

    For me , I became very ill, depress. I went home, what a big, big mistake that was.I love my husband so much. He loves me, this I know because he never complains that we are going through this again. Be strong, things will changed.

  8. About the passport , it has my maiden name, but here's the thing, it will expire in November 3, 2011.

    I am nervous about this as we all know, a Consulate interview the passport has to be good for at least 6 month after the interview. That is IF I ever got there. I have to think positive. Should I get a new passport with my married name?

    This is complicated for me and my husband. Form 1-130, question 9 and 10, should my husband write my past U.S. social insurance number and past alien resgistration number? Or should he write none?

    Also the form G-325A, (family name, is that my maiden name or married name? The very first question.)

    Since this is a re-start, should we just fill it out as a re-start and just provide additional information?

    I also notice that we cannot fill this out if two years has pass. It has only been 7 months. Thank-God. I know this is going to be very difficult, but we have to at least try. I also thank God for this group, because we know I could not do it without.

    For the G-1145 - your Husband is the petitioner. I don't know if they mean applicant = petitioner on this form as well.

    If you both want to receive electronic notification, fill one out for each of you.

    To begin - you submit an I-130 and a copy of the G-325A , one G-325A each, for you and your Husband, plus all the other items they request to accompany them. This information can be found in the I-130 instructions.

  11. I can understand your confusion at my time-line. I had to leave, now we have to re-start the whole process all over again.

    The only way I think to edit my time line is to delete it or use another e-mail. I don't know.

    Also, I think I have to include the biometric G- something. I fill out all aplications the last time, my husband provided info and sign. He is just not good at forms is all. Yes, it is costly and yes it is hard for both of us.

    Can you clarify what position you're at in the immigration process? I'm confused by your time line... lol (confused about what you'd be filling out a G-1145 for now, I mean... I thought CR-1 visas were pretty much done with it when they POE'd, since you get a temp PR card right away, don't you?) You can only put one name and one email address down, so it's whomever you'd want to have receive the notifications.

    The form G-1145, E notification. Do we put both names the Applicant and the Petitioner names. Or is it just the name and e-mail of the Petitioner? Who is the applicant, and who is the petitioner? I can't seem to get this.

    We've a 'guides' section here - a how to on 'how to do'. Click 'Guides' at the top, find the right petition/visa for you, then email the link to your husband (since he's filling out a new I-130 )

    Not sure about any medical stuff for your ears, sorry.

    Suggest your husband write an evolution of relationship letter, as well (in addition to the coversheet) and explain why you abandoned your green card (He writes this, not you).

  15. Hello all;

    I am beginning the 1-130 all over again. What are my fees? And how do I assemble the package? I remember some things but not all. I did notice if I have additional information I have to write it in the letter of content.

    Also do I need any letters from friend in the USA to prove relationship, as we have been married since June 16th, 2007. I will have proof of illness from my doctor. I have lost hearing in both ears, but I have finally a specialist. Should I also wait for any prove from my Doctor to show why I had to abandent the USA?

    Will I need to make sure of all vaccination be up to date? I know I will have to see an immigration Doctor "IF' immigration lets me get that far. I know it's a lot of questions, I apolige for that.

    I also notice the Immigration Doctor in Montreal is quite far from the consulate. Too bad the one in Atlantic Canada stop doing Immigration. There are not many left, period. Thanks in advance for every ones patience with me.

    I hope that no one makes the mistake I made, and you can learn something from me. Do not leave the USA once your there, without a permit. Make sure you read everything.

  16. Yes, I think you right. The form does state medical reason, but I don't think it will apply for me. You can't trade a green card for a medicare. I will have my husband call them. I do believe we have to start over again with the 1-130. We married in 2007. Here we go again. This time IF, God gives me the chance of going to the USA, I will get the flu shot, once a year. This is going to be costly for me.

    Since you returned your green card at the border when you returned to Canada I don't think this form will apply to you.

    (1) You had the status of an alien lawfully admitted for permanent residence at the time of departure from the United States;

    (2) You departed from the United States with the intention of returning and you have not abandoned this intention; and

    (3) You are returning to the United States from a temporary visit abroad and, if the stay abroad was protracted, this was caused by reasons

    beyond your control and for which you are not responsible.

    I would call USCIS and ask them if you are in the system as having abandoned your residency. If this is the case (since you returned your green card at the border) I'm not sure this form would apply.

    I assume from your previous post that you filled out and signed the I-407 at the border, to relinquish your permanent residency in the U.S.?

    As Kathryn mentioned - if you want to go back now you need to start from the beginning and apply for a CR1 or IR1.

    Ok, I made a mistake, but it was out of fear. I was going to lose my hearing. I entered the USA on a CR1, I was there for 4 months. I got home sick and sick. I got an ear infection in both ears. My husband had no health insurance. I went back home to Canada. At the border, I was explain that I could not just enter to use medicare, althought I never told them I had ear an infection. They took my green card and explain I had to write abandent the USA, I ask I don't know what reasons. So, I wrote ( Unable to adapt to the USA). I want to go back to my husband. Will I be able to? I was explain if I wanted to return, by the Maine border quards that I would have to stand in front of a judge. What judge? I will stand if I can get some information. My green card was good for two years, ending year 2011. I would said anything, under pressure when a bus is waiting for me to cross the border into Canada. Truthfully, I realy had no intention of returning, until I set foot in Canada and got treated for my ears. Yes, it would have been a lot easier, to trust my husband when he said "Don't worry, I will get you a DR.) Oh God. Can someone help me.? :crying:

    Where do I begin? I got my green card. I got a severe ear infection, I have a history of ear problems. I moved back home to Canada from the USA. I entered the USA on a CR1. At the US border in Maine, I told the custom I was leaving the USA for good. They took my green card. They ask me if I was sure, and I said well not really. They explain that I would not be able to use my medicare card in Canada while a conditional resident of the USA. So, I turn in my grren card, and wrote that I was abandening the USA. My reason that I wrote was that I was unable to adapt to the USA. They aslo explain that I would have to stand in front of a judge to return to the USA to be with my husband. I did not tell them about the ear infection, I was afraid, that they would not let me get in Canada to get treated. My husband had no health insurance.

    I was home sick, and all sorts of things were happening, I honestly didn't give anything a chance. I love my husband very much. We married on June 16,2007. It took a long time for me to get to the USA and money.

    What a mess. If I can't ever return to live, can I visit and stay 6 months at a time? Will they let me enter? :crying:

    I don't know what the forms I fill out at the border. I do know I was fingerprinted. And I did get a copy. I don't plan on ever returning to the USA. This is my home. I found a job, that pays well. I have to get all furnitures all over again, but you know I feel safe and content to be here. Even if I have to do without a few things for a while that is ok. One thing it is hard working a new job, I was at my last job for 20 years, and I miss that life, but there is no time to look at the past. It is done. I wish all here good luck with their jouney. For me I belong here in Canada, my home. Thanks to all who help me and did not look at me like I give up too soon. It 's what I wanted, to come home.

    Hi Marie,

    Welcome back to Canada. Sorry things didn't work out for you and that you have had such a hard time.

    The border officer didn't really need to take your Green Card, but if you told him you intend to relinquish your U.S. permanent residency/move back to Canada permanently - then he did the right thing. Did he have you fill out a form as well? an I-407?

    I'm sorry that things didn't work out for you Marie, and glad to hear that you are back on your feet and doing much better.

    Your husband doesn't need to do anything with regards to your immigration status. When you handed your green card back at the border, you effectively told them that you were no longer a permanent resident at that time and they would have recorded that on your immigration paperwork. It is all taken care of and there is nothing further either of you need to do.

    The last time I wrote I wanted to return home to my country. I was very ill. I am now home and feeling much better. I have an appointment with my Doctor.

    At the border, the USA custom ask me to return my green card, as they told me it would interfer with my medicare. I gave it to them, was fingerprinted and explain by them I may not return to live unless I stand in front of a judge. I don't plan on returning to live , ever. We are all different, it was not for me. I found Troy, Missouri a very dark place.

    I found work here, and slowly will start to get my life in order. I have a lot of good friends and family who are helping me get furniture and so on. Yes, I miss my husband, but not as much as I thought I would.

    I have a question , is my husband suppose to write or contact immigration, to tell them I am no longer in the USA, as I was a CR-1. I was only there for 4 months. It felt a lot longer. What happened to me, does not mean it will happen to anyone else. I love being in my country. There was a lot of things my husband did not share with me. It's not that he is not a good man, he is. I wish all of you for a safe journey.

    Last time I posted was me wanting to go home. I have decided, I am. I am from Canada, and something here is not agreeing with me. I had two colds, a severe flu, then an ear infection. The Dr, told me I got some kind of bacteria, from either enviroment ,allergies or it could be atmospheric. I had two job offer, but too sick to work. Married for 3 years, only been here 4 months. I left a 20 year job that I loved, my home all my personal belongings gone. I love my husband, and have ask him to move to Canada, but he can't stand the cold. Reality is he loves his country. I feel hopeless and scared. My family is helping and so is my husband for me to return.

    And there are other problems, which my husband and his ex-wife is fighting for child custody of their daughter and that is going to be a war. I should be home in 2 weeks. It will be the hardest 2 weeks. My husband has finally accepted that I need to go. I think back, and you know, marrying someone in another country is risky. But, things happened, doesn't mean it will happen to anyone else. I just wanted to share this and would ask anyone who prays for prayers that it will be fine. I am getting anxious and all at the same time feel an emptyness. I think back of all the money and hard work we both did for me to get here in Missouri. Somethings are not meant to be.
