No, they will not count that as a public charge. I think the problem will be if you have work permit and you r receiving welfare. I know someone Vawa recipient who was asked in the interview if she was on welfare. When I sent form 912 fee waiver I just wrote that I would like my fee waiver because I want to be able to work and all my forms were waive. If you are not on welfare go straight to part 3 and write about why you are not able to pay the fee. Note: I didn’t send any prove. I just wrote a paragraph explaining why. Don’t forget to write down all the forms that you are requesting fee waiver.

That may be true for Vawa, not really sure, but for I-485, they do not forgive illegal entry.
  6. Thanks

For vawa you are exempt from been a public charge. I read somewhere that for vawa, been a public charge or grounds of admission if entered ilegally in the U.S don’t count.

I think you just need to respond to their specific RFE in case they send you one.
Supposed they asked you for Good Moral, you can't respond to them with evidence of good moral along with evidence of abuse and bonafide.
  11. Thanks
Florecita_Bella reacted to iwillsurvive in VAWA, Part 10
USCIS will ask you what they think is missing in order for them to approve the case. Just send them what they ask for.

For example, I didn’t have a police report or a psychological evaluation when I submitted VAWA and I had gotten an evaluation and prepared myself to submit evidence along those lines. But they never asked for it and only sent me an RFE for good moral character asking me to submit police clearance from a specific country I had lived in. So don’t worry, just submit what they ask for. I know it is a long process and there are so many things while waiting that you will think of you could have submitted. At the end of the day, USCIS will tell you if anything is missing. You just have to be patient and trust the process.
  12. Thanks

When my application was accepted, USCIS  sent me a blue notice, along with my prima facie to use in case I decide (in future) to send additional evidence. It is my understanding that additional evidence sent without that blue notice will not be acknowledged. You can also wait until they specifically request for additional evidence before sending anything.
  13. Thanks

USCIS will consider just the abuse that happened during the time that your husband was living with you.
Block his mail address, block his phone number or get a new phone number. Avoid contact with his family and friends. If you fear for your life then get a restraining order against him.

The wait is very long and the agony is unexplainable I know ! But try to be patient my case took 2 yrs and some months to be approved after a very extensive rfe thank God my vawa was just approved but I still have a long wait for my GC :/

Form 797C only proves that you filed an application. That’s about it. You are overthinking a lot and that’s not good. You got the receipt and  that means they got your case and it will be adjusted when the time comes. Sometimes some people do not receive the prima facie because they are missing some evidence and when they respond to the Request for evidence  they usually get their prima facie. Every case is different and every officer work different.

Yes, legally speaking the submission of a new  G-28 replaces the previous attorney representation but we all know USCIS is VERY messy then we suggest the previous attorney submit a  notice of withdrawal.

    b) Substitution or Withdrawal of Representation.
It is not uncommon for applicants or petitioners to wish to change representatives or elect to forgo representation during the course of a proceeding. Notification to USCIS of the substitution or withdrawal of a representative may occur in a written notice of withdrawal by the representative of record or upon the filing of a properly completed G-28 or G-28I by the new representative2. Written notifications are to be filed in the record of proceedings. An applicant or petitioner may elect to proceed without his or her representative, but must submit a written statement to the USCIS official that he or she has voluntarily chosen to proceed without representation.

    Good Morning!!
I've seen several people saying that they are receiving old notifications from USCIS and I just received one about my work permit which I received January 2017. I think there is something wrong with their system that is sending notification about old cases. I have an InfoPass schedule for June 14th I will ask about this. I don't think we should give it much importance.
  19. Thanks

You said " I understand that in Vawa USCIS cases it allows one to register a different address than the one that lives for security reasons with the abuser.",  look you can give someone's address to receive your mails, that is it. You MUST update your address every single time you move to a different place, that being said in case of VAWA approval you will have the interview considering the City/State that you are living.

There is no problem regarding the address of your psychologist.

Have always with you a document showing you have a pending case with USCIS.

There is no interview for VAWA petitions just for AOS,.
  20. Thanks
Florecita_Bella reacted to iwillsurvive in VAWA, Part 10
No, you have a pending petition and won’t be deported unless you are committing a felony level crime while filing. You actually are required to give USCIS your real address. You can use someone else’s address as your safe mailing address, so that your mail gets received somewhere safe and not by your abuser potentially.
  21. Thanks
Florecita_Bella reacted to iwillsurvive in VAWA, Part 10
    1. If you move, you need to mail form AR-11 to the Vermont Service Center to change your address. Even if you are just moving for a few months, you are required to update your physical address to where you live. When you move back, file another change of address.

    3. You can travel inside of the US with a valid ID. This can be a valid passport, ID or driver’s license.

    4. You are not interviewed for I-360. You will have an interview for the adjustment of status (I-485).
  22. Thanks

It doesn't mean they'll deny you. My ex did the same thing. My lawyer had to notify USCIS of the stuff he was doing. It doesn't mean anything. USCIS will not discuss VAWA with anyone. Don't worry. He can be as pathetic as he likes. It doesn't mean at all that you will be denied.
  23. Thanks
Florecita_Bella reacted to bold in VAWA, Part 10
USCIS does not take into consideration what ur ex partner tells them, in fact USCIS does not contact ur ex partner or allows them to contact USCIS once u filed VAWA. So be rest assured that ur approval or denial is solely based on ur input into the application.
  24. Thanks
Florecita_Bella reacted to Sandra G. in VAWA, Part 10
Uscis will not take into consideration anything that your ex spouse will say to them then don’t sweat ok.

If you are feeling this way, you should get some counseling.  Sandraj suggested that I stay in counseling and I am, so it has helped alot in this process, I cant sweat the small stuff and things that are out of my control.  I use Mindfulness daily to destress myself and reduce my anxiety.  I learned it through counseling.
