  1. bills in both names?

    lease in both names?

    house deed in both names?

    car titles in both names?

IMO - this evidence is also about 'the co-mingling of finances'. To not have a joint bank account, IMO, is a great fail.

A great fail even though we are joint tax filing, life insurance and health insurance? Those are all pretty major financial co-minglings, I would think, right?

We live with my parents so we have no lease or house deed.

  2. Hello, everyone! This forum has always been very helpful for me so I hope you guys can help me out.

My wife and I are going to be mailing our packet to remove the conditions on her residence very soon and I was wondering about proof. We have a joint tax return photocopy, joint life insurance and joint health insurance...but we don't yet have a joint bank account. Should those three items I DO have be enough evidence? I certainly think it should be but I wanted your opinions. Thanks!

  3. Again--thanks. This forum never lets me down when I have questions regarding this process. After these conditions are removed I won't have to worry about anything for ten years, LOL!

my wife and I are aware of the 90 day window to file the forms. Her card expires in June but our financial situation will likely have us sending the packet sometime in April. Should that allow enough time?

Absolutely - can file any time during that 90-day window (it opens 90 days before the card expires and closes the day the card expires), April is somewhere right in the middle.

  4. Thank you very much for the info! This forum has been my lifeline throughout this entire process!

So, if you don't mind I have one more question......my wife and I are aware of the 90 day window to file the forms. Her card expires in June but our financial situation will likely have us sending the packet sometime in April. Should that allow enough time?

    Thanks a million!

It is called Removing or Lifting of Conditions (removing the 2-year marriage condition).

The 'how to' & 'what's needed' is all laid out in the Step-by-Step Guide on Removing of Conditions (Form I-751) .

**Topic is related to 'Removing Conditions on Residency General Discussion' ; moving thread there.

  5. Hello! My wife and I went through the AOS process in 2008 and received the first Permanent Residence Card. However, it expires June, 2010. Now, I've heard we need to do something called "removing conditions from green card"....well, I'm confused on what we need to do. What are we required to do in this process?

Any help would be greatly appreciated, thank you.

  6. This is a bit of a tricky situation that I would appreciate help from anyone who's been in it.

My wife has a green card and she needs to go home to the Philippines next week to attend a family service. Here's the problem--her passport has her first name and her maiden name since it's the one she had to get her into the country in the first place.

So, we ordered her round trip plane tickets tonight and put her first and maiden name on them to match her passport.

Here's the problem....she needs to get her passport renewed in the Philippines since she's now married to me and she told me that her Philippine passport will put her first name and new last name of mine. So, our dilemma is that when she starts to leave her country she will have a passport with her first name and my last name but boarding passes with her original maiden name on them. Will this cause any problems with customs?

    Thanks in advance!

  7. Thank you for your advice but there is more to it--my wife intends to visit the embassy in the Philippines to update her passport (that is starting to run out) to have my last name added to it. So, will this create conflicts for her upon return with her passport saying her new marital name but her boarding passes saying her maiden name? I'm asking this because we're getting round trip tickets. Thanks!

Vann: This is extremely common. Have your wife buy the tickets in the name that's on her passport (Philippines passport). She will just need to show her greencard when she enters USA. My wife has done it several times and so have hundreds of millions of others. (My wife has never been asked for the marriage certificate (her name on her passport is her maiden name - different from her greencard name) but no one has ever asked for the marriage certificate and the last three times we didn't even carry a copy (we went to India, Panama and Colombia and didn't carry the marriage certificate). Don't worry. Good Luck

I'm ordering the tickets today which is why I'm so urgent right now. Thanks!

  9. Hello, everyone. My wife's I-94 expires on April 17th and we're currently assembling the last of the AOS package to be mailed off.

    A few questions:

-What is the address of this Chicago Lockbox that I'm required to mail the AOS package to?

-What do I make my $1010 check out to? (Pay to the order of)

-For the Affidavit of Support, I was planning on sending in copies of my most recent W-2, check stubs from both jobs, and employment letters from my work places. Is this sufficient enough or should I also include a copy of my recent bank transactions list?

I would appreciate your help as all the checklists I've found failed to give me the info I need.

    Thank you!

    The address in Chicago is:

    USCISP.O. Box 805887Chicago, IL 60680-4120

But there are exceptions, so it would be wise to visit the USCIS website and make sure you are not one of them!

The check is made out to U.S. Department of Homeland Security, but again, there are exceptions so you should read the USCIS guide to the I-485 form to make sure your case is not one.

Give them copies of your tax returns with the W-2's, Bank Letter and Employement letter along with recent pay stubs are all good to show for Affidavit of Support. The guide here in VJ is pretty darn good, check it out if you haven't already!

Good luck on the AOS process! Pretty soon this thread will be moved to the AOS forum as well... :P

Thank you very much for your help!

  11. that is correct that they keep the brown envelope.

The vaccination sheet that they refer to for the aos is that usually your wife should get another DS2050 (I think that is the form) which she can take to a civil surgeon to get it transferred to the required document. Anyhow, not everyone received the DS2050, including me.

What I did for my AOS is that I copied my entire vaccination records booklet (not sure if you got something like that in the Phillipines) and mailed it with the package and I was never asked for anything else, no RFE...

My wife received a vaccination form from St. Lukes in the Philippines and she decided to get the vaccines here in America. So, they put that request on her form and handed it to her but the US customs on the POE took the form along with the brown envelope and never returned the form. Are they supposed to do this?

Can we simply visit one of these surgeons and ask them what she needs?

This is all very strenuous and my wife and I are having headaches.

  12. Also, she opted to have her vaccinations done here in America and the woman over the phone mentioned a special surgeon we must go to, however she said we could see them on the website. Does anyone have a link to this list of surgeons? Is there any idea of what the cost is?

Needless to say, my bride and I are quite distressed now.

Are we overworrying? Is this AOS process really as simple as everyone says?

    Please help.

  13. Hello all. My filipina sweetheart and I were married on January 28th. However, we are overlooking the AOS process and realized there are some documents required from her that we don't have.

The problem is that when she entered her POE they took the brown envelope, opened it, and returned to her her passport, I-94, and X-ray film...nothing more.

My question is--did these people forward the forms in the brown envelope to the proper Immigration people?

Also, the USCIS representative I spoke with over the phone told us that once we mail off the AOS package we will receive a notice from them later on if we need any additional documents to send in.

My question is...did these people screw up and not return to her every necessary document or will these be sent back to us or what? So confused!

Also, the woman told us that as long as we mail in this package within the 90 day period that as long as they receive it my bride will be safe and not deported. However, this woman didn't sound as if she was 100% sure of all of our questions so mine is...is this true? Will she be safe? Her visa expires on April 17th and it will take until next month for me to raise the money for the high filing fee of $1,010. So, should I deliver this through UPS to be faster?

Also...does anyone know where to mail this thing??? LOL! All that I see on many websites is "Chicago Lockbox" but gives no address or anything.

Also...we are required to send in our Marriage Certificate and License? Should we send the originals or will photocopies suffice?

Your help would be greatly appreciated, thank you.

  14. ....Wow. I feel quite overwhelmed right now. I remember quite a few people always telling me things like "AOS is the easier part of the VISA process" but if anything--I'm overwhelmed and confused than ever. Am I just overanalyzing something? I'm very confused now.

From the sounds of it I have to pay out over $1,000 in fees???

Also, the info lists were confusing me about my fiance's work permit.

Do we file for this separately from this AOS package? My spouse wants to work right away. Please someone help clear some of this up.

My spouse and I are very stressed now.
