We have had the interview for citizenship and are awaiting the letter with his swearing in ceremony date.  We will be doing it in Louisville, that is where the interview was.  We got an email on Monday stating that the date was set for the ceremony and that we should get a letter in the mail.  It has not come yet.  My question is, does anyone know what kind of timeline they give from the letter to the ceremony?  Hoping someone might know the answer.  

  2. My husband is here and has a 10 year green card and eligible for Naturalization this year. We want to bring his family over from Algeria, it's his mom and dad. We want to bring them over on a tourist visa. How long do those usually take after applying for them to come thru. How long do they usually last for?

  3. My husband has his AOS still pending and he needs to renew his EAD in a couple of months. When we filed with the AOS as C9 AOS pending.

    My question is do we need to pay again to renew the EAD and what type of documents do we need to provide for it?

    Correction on this, our question should be can an A9 be renewed as a C9 on the EAD? If so do we have to pay the fee? Also, can we E-file for it as C9?

    I found this paragraph under visa journey that shows you can:

    Renewing your EAD (assuming you filed for AOS). You may renew your EAD when your EAD nears expiration. You must renew your EAD to be able to work until you become a Permanent Resident (or Conditional Permanent Resident) at which time your "Green Card" will be proof of eligibility to work. A suggestion before filing is to check the processing time currently for EAD's and file at a time equal to the number of days before your EAD expires. ex: if the processing time is three months then apply for a renewal three months before your EAD expires. You will file as category ©(9), "adjustment applicant". (Where to file: mail, walk-in if allowable, efile)

  4. I have a question about the I 94. Has anyone ever had an interview and been approved the green card and not taken the I-94.

    We had our interview, it wasn't the most pleasant experience. He was very nice to my husband but rude with me. They took the I-94 and said they will make a decision and let us know within the next 2 weeks. I felt it didn't go so well. We are worried, not to mention they questioned our age difference and the fact my husband is Muslim.

  5. My sister has custody of her. Her father is a U.S. citizen, or possibly dual citizenship. She never applied for anything, my sister is divorced from my nieces father now. When they first got married they lived in Canada. They moved back to the U.S. after a few months. She never had a visa or anything, my sister didn't know at the time. She thought it was okay since she was a U.S. citizen. Alot has changed with immigration in the past 15 years. When she was here in the U.S. she sent away for a social security number for her and got it, there were never any questions about it. She has no type of visa of any kind.

I have a 16 year old niece, she was born in Canada, but came over here when she was a baby with her father who was born in Canada, lived there, moved over here and married my sister who is a U.S. citizen. My niece has lived here her whole life. She has a social security card which she got when she was a baby.

    She went to get her drivers license through the state of Missouri yesterday and they told her she was an illegal alien. My sister explained the situation and she showed them her ss card, they were questionable about how she got that.

    She doesn't know what to do at this point, obviously she will need a drivers license. Anybody have any replies or help on this one. She called me with questions because my husband and I are both dealing with immigration issues. I advised her to make an infopass appt and see what they say.

  7. My sister is a U.S. citizen and engaged to a resident of China. He has a tourist visa valid for 2 years to the U.S. He's been here once but now they are engaged. Can he come here and get married without it effecting his visa? They are moving to China because his business is there and doing very well. They want to live in China a few years and then apply for DCF to come back to the U.S. Will there be any problems later on with them marrying here?

  8. I recieved a letter from the NVC in the middle of October that they recieved an approved I-129F. I talked to someone at the NVC and they told me my petition was approved October 2.

    I never recived a NOA 2 in the mail and the website for the USCIS shows my case is in initial review.

    I called the USCIS and the woman on the phone was telling me that my NOA2 must be lost and that need to pay $300 to get another copy of it :angry:

    I don't think they ever sent me one. How can I find out if it was sent and what do I do in this situation?

    I never got mine either, I got it for the I-130 but not the I-129F. I called USCIS and they show it's still pending. I even spoke with a supervisor, which took 4 or 5 calls to get that person. She said that it should of been dropped since the I-130 was approved. She said I needed to call NVC center. I called them and and they said that USCIS approved it the same time the I-130 was approved. I got the letter from NVC that stated my case was in Hong Kong, even have a case number. I was told that the approval letter from them, is fine to use in place of the NOA2.

    Just so you know there is a cost of around $300 for another copy of the NOA2. My issue was that it showed still pending, so I didn't want to pay the money to get nothing.

  9. My husband has an interview in Hong Kong on November 10th. He has not recieved packet 4 as of yet. They said they mailed it out on Oct 14th and that it can take up to 10 days for him to get it. Its over the 10 day mark and still no packet 4. I emailed the consulate yesterday, which they have up to 2 days to answer the email. I am afraid if they do mail out another packet and it takes another 10 days he will not get it in time anyway. Does he need the appointment letter? Is that a requirement?

    The reason I know about the interview date is because I emailed them on a previous question and asked them about the interview and they told me when the date was. Any answers will be helpful. Thanks.

  10. I am in the same situation, my I-130 approved nothing on my I-129. I called USCIS and the lady I spoke with agreed and said they are approved at the same time, if that didn't happen, it WON'T happen. So we are going to go ahead with the CR1 route. I thought maybe we should wait too for the I129 but I don't want to spend a month or more waiting to find out it isn't going to happen.

  11. I applied for the K3 and my I130 was approved on Sept 1st and sent to the NVC center. My I-129 has not been approved as of yet, it was touched on Sep 1, 2, 3 but now nothing. Has anyone seen any approvals of the I-129 this late?

    I know we should apply for the CR1 because it is the best route, but we wanted to do the K3 and if it didn't work be able to go back and apply for the CR1.

    We married in Hong Kong and our K3 interview would be there, what about the CR1 where would he interview be? From my previous posts the reason we married in Hong Kong because my husband is not a Chinese citizen and we had no choice.

    Any information please, I was curious if anyone else was waiting or waited this long for the I-129 approval. Thanks.

  12. I am a U.S. citizen applying for a K3 for my husband who is in China. We are married now. My question is my passport is in my maiden name. I applied for the K3 in my married name and I put my other names used on the form. Do I need to change my passport name to my married name? My SSN is changed, all my banking info I have changed, even did my taxes in my married name. The only thing that hasn't changed is my passport. I have traveled after the name change.

    I know when they issue a new passport it will be blank and you don't get the old one back. I have all my stamps in the old one of travelling.

    Will it be a red flag if I just keep the old one? Or is it something that should be changed? Any advise helpful. Thanks.

  13. I applied for a K3 for my husband, he is a foreigner living in China, we had to get married in Hong Kong because he is not a Chinese resident. He will have his interview in Hong Kong.

    When he interviews for the K 3 in Hong Kong, if he doesn't pass, can we go back and apply for the

    CR1 through Guz? Do we have to re-send the I130 all over again? Or go off the one we just sent? Thanks for any replies.

  14. I guess I should of clarified my situation a little better. I live in the U.S., my husband lives in China, I applied for the K-3 here in the states. I have traveled with it in my maiden name, and luckily Missouri issued my drivers license in my married name, but they also issued me an ID card in my maiden name, to match my passport. I just was wondering if that would be an issue when he interviews why I haven't changed my passport over, but then again I want them to see my old passport with my Chinese visas and stamps in there.

  15. I got married in 2008, filed K3 2009. My passport is in my maiden name, should I change it to my married name? I have traveled to see my husband in China with my passport in my maiden name. That is the only thing that isn't changed everything else I changed to my married name. Would it be better to change the name on the passport to my married name before the interview? I can make a copy of the passport with all the visits to China to show for the interview and have the new one with my married name. Let me know. Thanks.

  16. The Consulate will look at, why did you have to marry in HK and there better be a darn good reason for that, an over whelming circumstance. All i know they will run the beneficiary through pure hell and all you can do is watch, you can't even go up to hold hands for support, just watch. I just left there, i know what i'm talking about. I wish you two all the luck possible. I would like to see somebody beat that system there and not a resident of HK.

    We have a good reason, we are both foreigners. For your situation, is your wife Chinese? Is she a resident? We didn't have a choice, my husband does not have residency. 2 foreigners cannot marry in China one has to be a resident. That is their laws. That will be our reason.
