    Some experience from my trip to the US that I think it is good for all of you.

     

    You should pay the immigration fee $220 before or after arriving to the US, so you can get the green card soon. Keep the receipt number after payment, you can also create an account to keep track of your green card status on USCIS. Or check it online when they send the green card.

     

    You should note that the waiting time for processing immigration procedure in POE of US Airport is very long, especially from 9 AM - 3 PM and 6 PM - 8 PM. That's why you should book the connecting flight from POE to another US city around 3-4 hour so you will not miss the next flight.

     

    In case you miss the flight, just go to the airline desk with your ticket, they will book another flight for free and may be give you a coupon for hotel stay if the next available flight is on the next morning.

     

    After arriving the US airport, you should prepare:

    - Your passport with US visa

    - Your sealed documents from Embassy. If the embassy told you that your document was processed digitally, and you do not need the physical ones, just tell the CBP so he/she can check the system to see your documents online.

    - The customs declaration.

     

    Remember that the principal application will have to meet CBP first, then derivative spouse/childrens go after.

     

    After a long waiting time, you should meet the CBP. Greting him/her with a smile and give them all documents above. They will ask:

    - Who is the petitioner? Where does she/he live?

    They will look into your document to check if you say correctly. It is not a big deal. Just a procedure so do not worry or nervous.

     

    - Where do you want your green card to be sent to?

     

    Just tell them your address where you will live or your relatives/friends house, so they can send the green card to you, within 120 days.

     

    They do not care if you live in the same address as your DS-260, they just want to check where your green card will be sent to.

     

    After processing your documents, they will ask you to take fingerprints and look at the camera to take a picture for green card.

     

    Then he/she will stamp I-551, temporary green card on your passport then welcome you to America.

     

    After that you can take the luggage and go outside or transfer to another flight.

     

    After go to the US, 2-3 days later you can go to SSA office to register for Social number card. Although some people get their SSN card after 2 week automatically but some people have to register in the office. It is up to you.

     

    You should bring your passport to USPS post office to register your name in your mailbox. Or the mailman will not deliver your mail. 

     

    You should register Informed delivery service of USPS so they will notify you when your green card, SSN card will be sent to your house, so you can take it before package thief stole it.

     

     

  2. Within 2 weeks from the date of arrival, you will get the SSN card. If not, you should go to the SSA local office to apply.

     

    Green card takes up to 3 months, you should check the card status online using IOE number from receipt. Bring your passport and visa to go to the post office to register your name, otherwise the post officer may return your mail to sender if your name is not in mailbox.

     

    Should register informed delivery service of USPS. It will tells you when your card is delievered so you can check it before anyone else take it from your mailbox.

  3. No one can enter the POE to help. However, do not worry at all. CBP do not ask trick questions for immigrant visa holder. Some POE allow a translator to help if they are available.

     

    You should prepare the passport with visa, the sealed documents from the Embassy, and the customs declaration which was provided on flight before arriving the US.

     

    When you meet the CBP,  just show them all 3 documents as above. They will check and only ask:

    - Who is your petitioner? 

    - Where do you live? Or where do you want your green card will being sent?

     

    That's all. They will fill the paperwork, ask you to check fingerprints, look into the camera for taking photos, then they stamped the passport and Welcome to America.

    - Folder of financial documents: your newest tax transcript, AOS with signature.

    After your parents go to the Consulate and check their fingerprints, in Pre-interview, the CO will check your parents' documents. And they will take original and copies of birth certificate, police certificate, ID, passport... to prepare for the interview.

     

    In the interview they will ask to see some photos and give them back.

     

    After the interview, CO will RETURN all the original documents and photos. They keep copies and passport only.

     

    Some applicants were so happy after passing the interview, and they forgot to take back the original documents, so they lost them.

    This was happened in September 2017 for F1 and F4, because there was a retrogression.

     

    The consulate called affected cases to ask them wait until October, although they had interview letter for September.

     

    Do not worry. They will issue visa to you in October, when the cut off date return for a new fiscal year.

     

    However, In the beginning of October, you can call or email to the consulate to remind them about this, so they can issue the visa as soon as possible.

    Every case has different processing and status. You cannot predict your case processing based on other's case.

    No. Ready and AP have different meanings.

     

    Ready only means your case is in the consulate and ready for the interview.

    It was updated on September 5, the date of your interview, because in that day, the CO open your case to read the info while he was asking questions.

    Administrative processing means the CO is processing your case. This status is appeared when:

    - The CO is reading your documents to prepare for issuing the visa.

    - The CO reviews your documents and they has not yet made a decision on approval or not.

    - The CO is waiting for the support documents such as proofs, financial documents.

     

    If the CO needs more documents, they will send you a letter or call you.

    It is shown Ready from the interview date because the CO is not ready to process your visa now.

    Mybe they are busy or they need approval from DHS.

    For example: your case is F2B but the petitioner is citizen, so they need DHS approve to keep your F2B status.

    In my case, my status was updated 4 days later.

    Working days mean Monday - Friday and no holidays or weekend.

    Your interview was in September 5, Wednesday.

    So you waited 3 working days included Thursday, Friday and today Monday. I think within this week you will get the status update.

    As I said, every case has different processing because there are many different situation.

    There is no formula for processing, so you cannot predict anything based on other experience.

  7. In my interview date, there was one gay couple attending the K1 interview.

    The Consular officer asked the petitioner (US citizen) to sit on the bench and wait, while she was interviewing the applicant.

     

    She asked a lot of questions and the applicant answered in English.

    Their conversation was very loudly, but I only remember some questions such as:

    - When did you meet the first time? How? 

    - How many times did the petitioner visit you? Did you travel together? Where?

    (The applicant showed a lot of pics in his folder)

     

    Then she asked the petitioner to come for asking a series of questions to cross check their answer.

    I could not heard all of what they talked because the US guy and the CO talked very fast, but they laughed a lot.

    So I guess the interview was successful. I think they did not ask any info regarding to their family.

    You can explain that to the Consular officer and I think they will understand.

    There is nothing to worry about.

    The movement of visa bulletin was very slow in August and September because the visa quota for 2017 fiscal year reached the limit.

     

    From October, the visa bulletin may move faster because it is the beginning of 2018 fiscal year, which mean more visas.

     

    However, in some countries, the embassy is very busy so it cannot schedule the interview even the PD is current.

    So we cannot predict how fast the visa bulletin move, or when you will get the interview letter.

    What you can do is waiting and praying, but don't forget to prepare for the interview such as proofs, financial documents...

    Did you check the case status? What does it say?

    Your wife can send an email to the embassy to ask about her case. Successful interview will get the visa within 2 weeks.

    If they need any documents they will send an email or call your wife.

    You can wear jean or informal clothes, do not need to wear suit or uniform.

    But please avoid shorts, flip flop, crop top etc. anything shows your parts of body.

     

    Approriate clothes for office enviroment can help boost your image in the eyes of the Consular officer.

    The substitute sponsor assumes all of the obligations of an I-864 sponsor.

    Above is the info from USCIS regarding to a death of petitioner. I suggest that you should find a lawyer who can help to submit a petition for you.

    Because the process is very long and many cases have been denied, very few people has success.

    You should ensure that your i864 is correct and bring the latest tax transcript, W2 in the interview so they do not ask anything about income.

     

    In the interview, the Consular officer asked me and most of other cases in that morning:

    - How did the petitioner go to the US? When?

    - How many times the petitioner return to visit you in your country? When? How long?

    - Are you single or married?

    - Is the petitioner a citizen? 

     

    While you are answering and the interpreter are translating it, the CO look in their computer to check if your answer is correct as in their system.

    After an successful interview, about 2-7 working days later, your case status will be changed from READY to ADMINISTRATIVE PROCESSING, and then ISSUED.

    Then after 2-4 working days you will get the visa package via post mail. It included your passport and a sealed envelope to submit to the CBP.

     

    You should check the info in your visa and the Summary form on the top of sealed envelope, such as your name, birthdate, case number and US address.

    Because your green card will be sent to the US address noted on this Summary form.

    If the address is wrong, you can ask the CBP to update your latest address when you enter the US.

     

    You will get an instruction paper for paying green card fee $220 before entering the US and get Receipt number in confirmation email.

    That is the final payment for this process.

    After enter the US, you can use the Receipt number to check when your green card is issued here https://egov.uscis.gov/casestatus/landing.do

    From 30 days - 120 days the green card will be issued.

     

    After it shows "Issued", you can call the USCIS to ask them about green card's tracking number so you can check when USPS send the green card to you.

    You should register Informed delivery service of USPS to know when they send green card and social number to you.

    The social security number card will be sent to you within 2 weeks after entering the US.

    If you don't get it, which mean they forget you, so you should go to the SSA local officer to register directly.

    As I said, I filed for a F2B retention and got the interview letter 2 months later.

    1 month before the interview, my case status changed from AT NVC to READY, which mean my documents were sent to the Consulate in my country.

    2 weeks before the interview, when I check the case status, it said that my category was changed to F2B (previously F1).

     

    In my interview, the consular officer noticed that my petitioner is a citizen, so she asked me if I want to keep my F2B status.

    I said yes. Then she gave me a F2B opt out form to sign.

    The content of this form is that I agree to keep my F2B status and I will not against them if I change my mind and want to upgrade to F1.

    They also gave me a letter to promise that I will not marry until I enter the US with F2B visa.

    Then she said my case was approved and I can wait for my visa.

     

    4 days later, my case status changed from Ready to Administrative Processing and then Issued.

    2 days later, I got my visa and a sealed envelope which contain my documents so I can submit to the CBP.

     

    P/S: Please note that in some countries, such as Philippines, you will have to send a letter to DHS in Phillipinese and get their approval about F2B retention (opt out) before the interview.

    The consular officer may ask you to go home and get that letter before they can approve your visa.

    Your brother got interview sooner because he completed his case before you.

    NVC got the schedule for October interview from the first day of September.

    If you called them this week and they said you don't have interview in October, which mean you will have to wait for November interview.

    Let's hope that you will get interview letter soon in the next month because the new fiscal year will begin from October, which mean more visas are available.

     

  17. Some people failed the medical exam due to lung issue, but they can attend the interview.

    However, their visa is delayed until they finish the treatment (about 6 months - 1 year).

    After that, the medical examiner will send their medical result to the embassy, and the embassy will issue the visa to them after ensure that they are healthy.

    Which mean their case is delayed, not cancelled, even 1 year.

     

    Therefore, you should contact the NVC or the embassy and ask them about your case status, to know where is your case now, so you can submit the petition for processing your father's case. If your case is cancelled (because you did not contact NVC, embassy within 1 Year), then you have to start all over again.

     

    P/S: If the embassy agrees to process your case, your father has to do the medical exam again and the interview (if he did not attend the interview), because the medical exam result is valid within 6 months only.

  18. In my interview, the consular officer told me that my petitioner is a citizen now, and she asked me if I want to keep my F2B status.

    I said yes and she gave me an F2B form to sign, then she said my case was approved. After 4 days, my visa was issued

    .

    Because the consular in your interview did not ask you to sign that form, so you have to send a letter to confirm that you agree to keep your F2B status, and will not against them for that (like you change your mind later and want to move to F1).

     

    If you send the F2B retention (Opt out) letter with your signature to the embassy, you can wait until they review your letter. 

    We do not know how long of the Administrative processing time, so what you can do now is waiting and checking your case status online.

    Every 2 weeks, you can call or send email to the embassy to check their progress, and what else do they want from you.

In case you miss the flight to US due to long wait time for preclearance,  just go to the airline desk in the terminal, and show them your ticket, they will arrange a next available flight for you and it is free. If the next flight is in the next morning, they may offer you a coupon for a one night hotel stay.

     

    This is a common policy for most of the airlines, but it is maybe vary between airlines. Just another info so you can have a back up plan.

    "Administrative Processing" means the Consular officer is reviewing the documents.

    When it shows ISSUED, it means her visa is issued and be ready for delivery.

     

    Typically, the embassy will keep the copy of documents, and return the original documents after the interview.

    In case they said that they need to keep the original documents, when your mom gets the visa, she should check to ensure that they return original documents to her.
