  1. Hello everyone,

     

    My wife came to the states with a k1 visa and we got married in October. We are planning to do a ceremony and for our friends and family and we have chosen September 12 2020 to do it. I'm wondering what are the chances her family will be able to get a visitor's visa? Her mother is unemployed and is a farmer and lives off that. As far as her older brother goes he does have a house and his own business along with a wife and kids. If they were to come they would only be coming for 2 weeks and then return back to Vietnam.

    I'm in the process of doing k1 visa. We are currently waiting for her to finish treatment for tb and am slowly starting to plan our wedding. I'm wondering what are the possibilities of having her family from Vietnam being able to attend the wedding? A little concerned because her family does not have that much money and I would be paying for their trip to the wedding along with boarding and stuff. Would it be better off to just go back to Vietnam after she gets her green card to do a wedding for her family?

    Nobody can answer that. That is a medical question, not an immigration question. Also, nobody can predict how a person will respond to a medical treatment. It is possible your fiance could need more treatment later (hoping that is not the case).

     

    The best thing to do is wait until the treatment is done before requesting time off.

  4. Hello everyone,

     

    So my fiancee is doing treatment for tb she is from Vietnam. The doctors has lowered her dosage on medication. Does this mean that her treatment will only be 6 months? She has told me that treatment will take between 6 months to 2 years. She started treatment at the end of November and is telling me that since her medication has been lowered her treatment will only be 6 months.  Has anyone been through this process that may be able to shed some light? Just wondering because I will need to request some time off from work and wondering if it would be safe to put in a request for some time off so that I'm able to bring her to the states.

    Well after a long dreadful process. Turns out my fiance has been tested positive for TB. She has started her treatment. Would anyone know how long the treatment process takes? I keep hearing so many different answers. My Fiance has told me that the doctor told her she will need to take medication everyday for 6 months ( I'm guessing antibiotics) and will need to be exam ed every month and that will determine how long the treatment will take. Does this sound right? I have some people say that treatment may take up to a full year. How does this work?

    Just wondering my fiance already passed her interview but pending medical exam results because the doctors have found something unusual in chest x ray. She has been tested for TB and we are waiting  for the results have been told 10 weeks to get the results. Anxiously waiting for the results and hoping and praying for good results. The doctors has informed her that if they find something then they will give her a call. Its been about 3 weeks since she completed the test. Is it safe to guess that the results will come back good?  Or should we just wait for the results to come back because obviously if the results come back and they do not call her then its a good result. Also wondering because I'm wanting to buy her flight back here. I'm going to be flying out there to visit her and follow her to take care of the result at the consulate and hopefully be able to bring her back but I have been checking ticket prices and they are getting more and more pricey as the days goes by. So wondering if I should just go ahead and book the flight and if needed cancel later on.

    My fiancee has just completed her medical exam and was informed by the physician that they have found something in her chest x ray that needs further evaluation. ( they have said that they found something in her lungs). Kind of worried and wondering what it can be. Can this cause her to be denied for a visa? I have read and heard that at times there is a way to get a medical wavier is there any truth to this? If so how can I go about this if needed? All though she does seem perfectly healthy and fine to me and her self also. She is not a smoker or anything an does not show any symptoms of any kind of illness so I'm a bit lost and confused. Can it be an error from the physician? Once again any information will be greatly appreciated.

    The NVC sends  both a hard copy of your case as well as an electronic version to the embassy. The electronic version obviously gets there almost instantaneously, however, the hardcopy is what takes a bit longer (5-7 days). Not sure how the embassy in Vietnam works but typically they'll allow you to start the process of getting everything ready and setting up an appointment once  they've received the electronic version but you still need to make sure to schedule your interview far enough out that they'll have the physical version of your package by then. This is critical as they will cancel your interview if they don't have the physical version at that time. 

     

    That's how it works with the Ukrainian Embassy so can't guarantee that the process is the same everywhere else. Just an example. 

     

    The NVC takes anywhere from 2-4 weeks from the time they receive your package from the USCIS before they forward it on to the embassy. 

     

    They are pretty sketchy at best and consistency is almost non-existent with them. You can call them every day of the week and get a completely different answer each time so just be prepared for some frustration. Hopefully they just send yours right through with no hassles. I've never been able to confirm the twice a month batch shipping theory  as I supposedly missed a batch date only to have mine get sent off a few days later. Timing and frequency is really an unknown. I've tried asking them specifics in the past and all they'll say is that they do indeed send in batches but would not reveal any other details.  

    okay thanks for the heads up I noticed the same thing each time i call them they tell me a different story and no constancy.

    okay thanks. Turns out my fiancee is correct. and i just wrote the case number down wrong. I just called NVC and verified the case number. Now im anxiously waiting for them to send my case over to the consulate. I have heard that everything is done electronically.  Would you know of any truth behind this?

  10. Hello everyone,

     

    I have called NVC back on October 10th and have gotten a case number and receipt number from them. When asked when my paperwork will be forwarded to Ho Chi Minh I was told they do not know when that will happen. About how long has it taken everyone for this to happen? Also they did give me a case number but when i try to look up the status of my application on the website that i can check the status it says that it is a invalid case number. So does this mean that the actual case number I will get from Ho Chi Minh? I'm a bit confused because my fiancee keeps on insisting that our k1 visa application is a immigration visa.  Which i know is a non immigrant visa. She has taken our case number that we have gotten from NVC and checked on the website and checked it as a immigration visa and the status says that its currently at NVC, so I am a bit confused. The thing that i do know is this though, the case number i have gotten from nvc starts with a 8cm and a bunch of numbers. She has changed the 8 to an H. So it became HCM and then a bunch of numbers. To me this does not make any sense and seems to be invalid, but want to make sure. Once again any information would be helpful. Thanks

    I have called NVC today and they have given me a case number and a receipt number but they have told me that they have not forwarded the paperwork over to Ho Chi Minh consulate yet and they do not know when they will be able to. I have forwarded the case number and the receipt number over to my attorney and she has told me that the number they have given me is not the actual case number. Would it be the case number that I can report when I call the NVC. Also will I receive a notification about NVC sending our application over to the consulate in the mail or no?

    I just got a email from USCIS APP that said that they have received my RFE. Does anyone know about how long it can take before they can make a decision on my case? The reason why I got RFE was a simple stupid mistake that my lawyer has made. 3 questions were not answered. They were 1. Do you have any children under the age of 18. 2. Does your beneficiary have any children. 3. Has your beneficiary ever been to the United States before. The answer to all those questions were no. I'm finding out recently that I should of just done the process alone instead of hiring a immigration lawyer. I hired a immigration lawyer so that mistakes like this would of not happened. But realizing that no one else will care about their case other than the people who are filing it.

     

    Another thing does anyone know which dates are available currently in Vietnam for a k1 visa interview?  Only asking because I'm going to be visiting my fiancee this month towards the end and was hoping and wondering if its possible that we can just do the interview while I'm there. I'm planning on staying for 3 weeks currently. But if we are able to do the interview i will extend the trip so that I will be able to attend the interview with her. Any info would be greatly appreciated.

Sorry about your lawyer, unfortunately that just confirms my belief in their lack of usefulness (and possibly harmfulness) when dealing with routine 129Fs. 

    Was I supposed to sign the spots that were circled and highlighted? I didn't bother signing because the original form this and two other questions were not answered and see no space for me to sign. So I did not sign. Should I sign right next to them?

  14. Hey guys so I finally found out why I have gotten. A RFE it's because there were 3 questions that my lawyer did not answer which is a stupid mistake if you ask me. Now that I have fixed it I am wanting to send it in. Do I need to attach the page that asks for the passport pictures or no? Also can I send it back expressed so that I can have a tracking number so that I will be able to know when they receive it.

My fiancee has been an authorized user on my one credit card for over 1 year now, about 6 months before filing the K1 I had her added to my Credit card. It was an easy way to avoid having to send her money and pay fees. The card has no foreign transaction fees, and you get a pretty good exchange rate with a credit card. If you do need to send money I recommend Transferwise.. They have low fees, and they work great transferring the money right into her bank account.

    • Making sure ALL the questions are checked and answered at 129F. Forgot a checkbox? RFE.
    • Required documentation, letters of intent, divorce certificates if needed, etc, nothing extraneous.
    • Additional proof of meeting in person in last 2 years.

    From what I observed lawyers doesn't seem to any better then self filed ones. In some cases worse, as due to their busy schedules they sometimes tend to "forget" things.
