    Section 12. Possession of Equipment, Instrument, Apparatus and Other Paraphernalia for Dangerous Drugs. - The penalty of imprisonment ranging from six (6) months and one (1) day to four (4) years and a fine ranging from Ten thousand pesos (P10,000.00) to Fifty thousand pesos (P50,000.00) shall be imposed upon any person, who, unless authorized by law, shall possess or have under his/her control any equipment, instrument, apparatus and other paraphernalia fit or intended for smoking, consuming, administering, injecting, ingesting, or introducing any dangerous drug into the body: Provided, That in the case of medical practitioners and various professionals who are required to carry such equipment, instrument, apparatus and other paraphernalia in the practice of their profession, the Board shall prescribe the necessary implementing guidelines thereof.

    The possession of such equipment, instrument, apparatus and other paraphernalia fit or intended for any of the purposes enumerated in the preceding paragraph shall be prima facie evidence that the possessor has smoked, consumed, administered to himself/herself, injected, ingested or used a dangerous drug and shall be presumed to have violated Section 15 of this Act.

     

     

    She was jailed for 1yr and 4 months

  2. My mom's I30 is approved. We are just waiting for her interview date in Manila embassy.

     

    She has criminal background. She was convicted 7 years ago. she was in jail for 2 years and was released. but she was convicted. 

     

    I know this is a ground for inadmission. I wonder if there are any here who had the same situation and was able to bring their loved ones in USA.

     

  3. I am a bit confused, and I hope somebody here can help me. here's my story.

    My mom came to USA as work Visa 25years ago, me and my dad was with her. We came to USA legally. My mom did not finish her contract, our visa expired but we stayed and live with our relatives. 

    I applied DACA when I reached 18, married a USC, become a permanent resident, and now I'm a USC.

    I wanted to file for greencard for my parents. What forms do I file?

    Yes, I enter this country when I was 11yrs old. MY Mother had a working visa then. She brought me and my dad with her. After 2 years, my mom had to quit her job and she could not renew it with other companies. Then when I was 25, DACA became available and I applied for it.

  5. I filed March 1. We did concurrent filing. Im a DACA married to USC. Im done with biometrics. Aside from “fingerprints were completed” for work permit and “case ready to be scheduled for interviews”, since april, we havent heard of anything yet. It seems like mostly here got their work permit already. My current work permit is expiring on September, it worries us so much. 

  6. Hi, I entered USA legally, H4. My mother brought us here, and unfortunately her visa expired. I overstayed, and finally got a working permit through DACA. Now, I'm married to a USC. We are going to file for AOS this week. My working permit will expire on October 2018. Should I apply for renewal for work permit together with AOS this week, or I should just apply for AOS. I'm not sure if I can apply as early as now for renewal of work permit. But once it expires on October, I can't renew it anymore through Daca.
