    im going to apply for my in-laws soon/pakistan as well. was the process straight forward or do you recommend a lawyer.

    @bulls2030 hi any update, going to start the process soon for my inlaws wondering if I need a lawyer or its straight forward to do on my own?

    Changing name by naturalization can be difficult. The core problem is that in the U.S. only a judge can administer oaths of citizenship that include a change name. There are on the order of 1000 federal judges, and one million people naturalizing each year. Depending on the field office that can mean a longer wait. Some field offices will all but flat out refuse  a change of name.  
     

    Even if you get a change of name oath, the actual change of name document is not the naturalization document as you might expect. When it does not show up, there can be a finger pointing exercise between the court and USCIS.

  4. Hi my wife came to the US 3 years ago via IR1 visa, we have past the 3 year mark that she has been here and want to apply for Citizenship (n-400). But my wife for her paperwork and everything still has her maiden last name and not mine, and our marriage was in her country, do we need to obtain a US marriage from a courthouse here, and if she wants to change her last name to mine, do we do all of this before we apply for the N-400?

     That's what we used last month to send them but the embassy sent an email stating they need the Original Nikkah Namah, which is what we sent them via Speedex. 

     

    I emailed them last week confirming receipt of the documents, but they responded today stating they need original Nikkah Namah, and nothing in regards if they received it or not, and that to use AEG. 

     

    Because the Nikkah Namah is the certified copy the marriage office gave us and they kept the original one.

    She did not have a SS number and did not live in the US for the first 8 months she was enrolled but she was on the plan.

    She was added as “spouse pending SS number” and there is NOT a law requiring a SS number to enroll a spouse or child in your health insurance plan.

    Marriage is a qualifying life event.  “Arrival in the US” is not.  They can make you wait until next year’s open enrollment if you don’t take advantage of it now.

    You need to enroll her NOW or you’ll miss a year on your employer plan and have to pay extra for her to have her own separate plan.

     

     

    I just started working and haven’t picked my health plan yet but have the option now during my open enrollment to enroll both of us, Before the end of the month.


     If there is a qualifying life event I’m able to enroll her which would be her obtaining official legal status when arriving here by producing a SSN. 

     

    so your recommending me to add her right now? And send that proof to the embassy?

    My wife's case is in Islamabad Embassy requesting additional joint sponsor, I provided all that documentation and now with this law I had a question.

     

    I have health insurance through my employer and my wife will automatically be able to add once she arrives, Do I need a letter from my employer stating I have coverage available for a spouse, or do I need to change my health insurance and add her and pay even though she isn't here yet? (It's open enrollment for my company but am unsure of the requirements needed to add a spouse if she isn't here yet)

    my wife had an interview last week, the 221g box wasn't checked just the 846 for joint sponsor, and tax for joint sponsor. because originally my father was a household member so now he is a joint sponsor and than my brother is added as a household member. and than they said to upload everything on CEAC. 

     

    I uploaded everything and also sent the documents on the embassy website. yesterday it said case updated oct-2 but still says refused. 

     

    what happens now? 

  10. I highly recommend getting one, I didn't and took the advice off of here and told myself it'd be straightforward, but its not really, there's so much at stake 

    and having all the fine details figured out its tough and challenging, its also hard to get real advice because everyones case is different. with all the changes going on its good to have a lawyer in your arsenal for guidance, because anything can go wrong. it's been extremely long and stressful for me and looking back I wish I had gotten a lawyer and not used just VJ. IMHO. others have had a very straightforward experience and are lucky to but unfortunately I haven't.

    So do I fill out an 864(joint sponsor) for my father (Who was my household member that I live with making well over 125%)? 

     

    I also started working in august after graduating from school and make well over 125% plus have included health insurance for my wife so there is no way that she would be a 'public charge'. 

     

    There really is no clear way of getting answers the only contact information from the embassy is an webpage request with 140 character space, and I cant add a joint sponsor on CEAC even though the 221g indicates that I do.

     

    Do I need to obtain a lawyer to help? this is very confusing and just seems off!

    Yes his tax transcripts for 3 years, and his K1 (he is self employed as a business owner) 

     

    I got off the phone with NVC and they said they are specifically requesting a joint sponsor because we dont meet the income guidelines, which is weird if my father makes well over 125% of federal poverty. And they said to contact embassy directly to sort it out.

Because if he filled out I864a, and not I864, then he wouldn't be a joint sponsor, he would be a household member of sponsor (you), combining income. Did you also include his tax transcripts and proof of US citizenship/LPR status? If he's married, did you have his spouse fill out I864a combining income with his? Did you include W2s and/or proof of current income?

     

    Edit: My mistake, just realized it was the OP who stated the joint sponsor filled out I864a, not you; regardless, if the other things stated were not submitted that could have caused the problem

    sorry its an 864a household member but the 221g indicates joint sponsor with tax for most recent year of joint sponsor, 

     

    I had included my BC which was accepted and my fathers 2018 taxes that my wife brought with her. his wife/my mom doesnt work.

    sorry about all the confusion, he is a household member making over 75k+, he initially was a joint sponsor but NVC had me change it since we live in the same household. I had proved that he is household member and a resident in NVC stage with my BC, addresses, passport, mortgage bills 

     

    but on the 221g it says "evidence of economic solvency" with taxes for most recent year and 864 requested for 'joint sponsor'

     

    so im really lost on what to do?

     

    my father makes well over the federal poverty level, I started working this month and will make well over poverty level. 

     

    there is no option to add a joint sponsor on CEAC can only add additional documents to my father and I. 

     

    I was thinking maybe he saw my 2017 864a for my father with lower income but on NVC it shows the most up to date one that I had completed 2018 with his 2018 taxes that my wife brought to her interview. 

     

    also how do I check the status of 221g and get information about how to send documents? the only intructions on 221g indicated to go to CEAC to upload documents which I can't add a joint sponsor.

    hi what is aramex? I was going to call the NVC about uploading that. 
     

    id you don’t mind me asking. Who did you use as an additional joint and their income? And how long till approval after submitting that?

    my wife had her interview and their requesting an additional joint sponsor even though my father (joint sponsor) makes well over the minimum. 
     

    i started working this month after graduating school (hence no taxes filed and need for joint sponsor) and after the 221G uploaded my paycheck along with an offer of employment from my employer. 
     

    i also updated the 864A for my father to include the 3 properties he also owns. 
     

    the only other person i can add to as a joint sponsor is my brother who currently makes 25k and lives in the same household. 
     

    is all that enough? I’m really surprised that even though my father makes well over the minimum and i just started working, they want additional joint sponsor.  I also will contact my congress rep to help hopefully since it seems like AP can vary greatly.
