Technically you are not a VAWA case anymore because it was denied and you are not appealing but rather planning on doing a new AOS through a new spouse. Your post does fit in the VAWA thread however because its about filing a new AOS after a VAWA denial. Im just not sure there is anyone else posting currently in that situation... Have you tried using the search feature? Im sure this topic has come up before and Sandra has offered advice on it.

When I just got married i live with him after I left but the therapist said I never live with him I ddnt see his letter so my is different so something is fishy around.they said that .and they said I never talk about the neighbors on my letter .i ddnt mention when I met him if he was citizens or lawful residence.

I got denied from wava I married last week.i got denied feb 21 .

tax we filed 3 years together 

bank statement 

6 affidavit from his mom ,his dad ,my family 

one affidavit from me ,one from the therapist.pictures,the letter he wrote say he was the one to tell not renew my TPS cause he wanted to send my Adjustment papers.

police clearance .

Not enough evidence.cause I moved to different state cause I was suffering my family told me to lve him but never got divorce never go to police for report .my case was strong cause we were together for 10 years the problem is my lawyer ddnt do a good job .t

It was my first marriage and I just got married for the 2nd time .i send picture when we were in our country ,chart papers ,and the problem is I moved when he was verbally abuse me .i ddnt know if I had my right to reported him .

My I 360 is denied cause of insufficient evidence and I think my lawyer Ddnt do a great job .my letter and the therapist looks a little different .like I said here I was with my ex husband since I was 15 in high and married after we married for 7 years I ddnt know anything about immigration.i had visa and TPS and he told me not to renew my TPS he never did .that s why I apply for wava  so I got denied.i just got married with my boyfriend cause we waiting for the wava. Answer before we do that .i don’t of it s gonna be a problem for me cause my new husband gonna file the Adjustment for me .

Pregnancy is not proof of a bona fide relationship. Raising a child together can be one piece of evidence, but be sure to include much more evidence and  not rely on that.

 

You can marry in the US and file for adjustment of status. That said, they will likely look very closely at your case. Be sure to present a very strong one.

I'm in no way accusing you here. But look at how it will appear to the IO - married and never field for AOS. Filed for VAWA once legal status via that path was no longer available, then was unable to substantiate that VAWA claim. Got pregnant, then married somebody else (hasn't happened yet, but is needed for AOS), and filed for AOS again. It is going to have the appearance that you are doing anything you can to stay in the US. You will need to overcome that hurdle.

5. You can get your transcripts from IRS website, you ex isn't needed.

I'm just a bystander and it doesn't convince me that you're in a real relationship, but for immigration benefit, and You have a long way to convince multiple officers, who are trained to spot fraud, lies, and people intentions. Especially being from a country that has high visa refusal rates, that won't help your case either.

Maybe you don’t get it .my country your parent can apply for visitor visa ok FYI i was 17yrs .i came got married to my boyfriend.we were together since we were 15ok .and for the transcrit uscis as only the 2017 not 2012 to 2015 when i called ok and i sent all letters from IRS ,you can call and they will tell you what year they start .they said i need a lot of proof for my second marriage i said i m pregnant i will have kids i think kids can be a proof also .your number 6 that s you ok .cause you have ask for detail just jump and talk .how we were together since high school and you said sound like He s not a real relationship.3 years in Haiti and seven years marriage sound not real ????? And I see you mix everything I said .Thank you for your help
