    No updates car0593. I am thinking this is going to take a long time.

    I think this varies from local office to office. Your local office prefers that you send it to them directly, since they already made you wait so many days before even giving you an interview. My local office was very prompt in interviewing(received interview in 4 months), but i guess they dont accept the 601 directly hence told me to file with the lockbox. I know another lady from NYC who's case is similar and she filed to the lockbox as well and is still waiting. All in all i think from filing to 485 it takes about 2 years if you have to file a waiver.

    My lawyer is an idiot. He just took my money and did nothing. My RFE also came from the local office signed by the local uscis director, but it said: File 601. You can go to so and so site to find out where to file your 601. 

    Did you RFE give an exact address in the local USCIS office to file the waiver? I wish i knew of your lawyer one year ago.

    no news about my waiver yet. It's going to be a year next month. Your lawyer is super smart. In your RFE did it say the name of the interviewing officer to send the waiver to?

    I know another guy in Florida, who was given the opportunity to file a waiver and it was approved after 10 months. Then on the 10th month they send him an RFE to resubmit his medical and then within 3 weeks approved his 485 and send him his card. For me it has already been 10 months for my 601 waiver. Here is my timeline.

     

    I-130;1485;I-765- submitted 01/27/2017

    I-765 approved- 04/28/2017

    Interview date: 06/01/2017(Local office in Chicago, IL)

    I-130-approved on the spot after the interview on 06/01/2017

    I-485 -further review needed, asked to submit 601 waiver to the lockbox-06/10/2017

    I-601 waiver filed: 06/30/2017(pending review)

    Yes, after my checks were cashed i got a receipt notice for the 601 waiver from Lee's Summit, MO. The receipt number starts with the prefix "MSC". You really lucked out that they wanted to send the 601 directly to the officer. It will be processed faster. I envy you. I dont know why i was asked to file the 601 waiver in the lockbox, although my waiver is in-country. What is your processing office again?

    I dont know which way is better. If they explicitly stated in the RFE to send it directly to the officer, then i think sending it to the officer is best. BUT, 601 has a separate filing fee of $930. If the 601 is send directly to the officer they are not going to process the check. It has to go to the lockbox for the processing fee and all that.

    I think what your lawyer is doing is that he is sending it 2 places:

    1) 601 form with evidences for hardship to the lockbox along with the filing fee.

    2) Only evidences for hardship to the officer.

    He/She is a damn good lawyer if he does that and a keeper. 

     

    My RFE did not state to send 601 directly to the officer. Instead it stated file 601 at the appropriate location which is the lockbox. Can scan/type what is written in your RFE? You can hide/omit all the confidential information.

    Did you apply from the UK? what i mean by that is "is your 601 from outside the country"? is your receipt number LIN or MSC?

Even on the USCIS website that's what it states BUT in the RFE it states that it has to be sent to the same office we interviewed at. our lawyer has had similar cases in the past and the instructions have been the same

    hi Car0593-

    My RFE for the 485 did not state to send it to the same office BUT eventually it gets routed to the office where the interview happened. If your lawyer did send it to the office directly in addition to the central lockbox(in chicago IL) then he is a very smart lawyer and is worth keeping. My lawyer is not that smart. Who is your lawyer and what is your interview office location?

Thankfully my grandmother is a US Citizen as well so he qualifies for it that way. We will be sending off the waiver next week. Our lawyer also told us that it goes to the same field office we had our original interview at. That the person who interviewed us is the one that makes the call :) Hope fully it all goes well.

    Hi Car0593. I havent received any updates yet. I put an SRP request but the USCIS folks just send me a print out of the case processing time for 601 for Nebraska field office. They dont know anything that not all 601 are processed at Nebraska.

     

    Boiler- why would he need a new lawyer. incountry 601 waivers for I-485 applications are processed at the local USCIS office by the same officer who interviews at the local USCIS office for the adjustment of status.

    Make sure your passport has more than six months validity at time of medicals and submission at the embassy for the immigrant visa. My spouse was told to get a new passport due to her passport was just one day less than the six months required and hospital refused to attend to her stating it is the embassy directive. She would have gotten her immigrant visa next week but now have to wait for the new passport to arrive then do medicals and submit for visa issuance after that.

    your case is the same as mine. Wow it will be 2 years for you in September. I hate this wait. Looks like i am in it for a long time. Very disappointed.:( Was your 601 because of a misrepresentation or CIMT?

    Was he told/given the opportunity to file a waiver? Along with 601 waiver i believe you will have to file for 212.

    Your case is different from the Normal Inadmissibility of someone who overstayed and voluntarily left the U.S to file the I-601. so i am not sure the office that will be handling your case. You can call the 1800# or schedule an infopass visit and USCIS will tell you the exact field or local office handling your case.

    Thanks for your responses Franco. I am thinking that for my kind of case which are adjudicated at the local USCIS office the 601 waiver time depends on the time when they start re-processing the adjustment of status application. OfCourse i am speculating here. I just got to know that one person in New Jersey who was in the same boat as me got approval for his 601 in 9 months.
