    I believe this is just a standard message that the office got the application, and I've seen here on VJ that other people have gotten this message when their apps were sent over to CSC.

  2. D.C. is where their headquarters is. I dont think it was for local office interview stuff. Maybe they needed some kind of decision from the HQ regarding your petition. Anything unuswual in your case??

    Nope, as straightforward as a petition can be.

    As long as I don't have to drive up there, for an interview, then they can let it rest on a pile of other docs for as long as they want. I have my EAD and my Advanced Parole so I can work and go in and out as needed until Nov. 08. :)

    I am just wondering what this paper shuffling is about.

    We got the notice in the mail. All it says it that they've moved it to DC to 'speed up the process'...at least it wasn't an RFE. I'm sure yours probably says the same thing. I'm assuming you got yours by now? Good luck with it all!

    Yep, just came today.

    Reads:

    "This is to advise you than in order to speed up processing we have transferred the above case to the following USCIS office for processing.

    Attn: E-Filing, 2675 Prosperity Avenue, Fairfax, VA 22031-4906

    That office will notify you of the decision made on the application or petition"

    And then some more stuff on general processing dates etc.

    So I guess the CSC was perhaps just overloaded so they dumped some of what would've gone there to Fairfax, Virginia :) At least that's the way it sounds to me.

    Nope, as straightforward as a petition can be.

    I'm in the local area of the Charlotte NC office, so why would this be sent to DC? Does this mean I might have to drive there, 5.5hrs each way for an interview instead of the 3hrs to Charlotte?

    Also comparing the numbers(that don't mean all that much) on the processing times websites, then Charlotte NC is working on cases submitted in the last 6 months while the DC office is working on 12 month old cases, should I be worried about that?

    What does this mean? Why was it sent to the Washington DC office when I am living in NC and therefore under the Charlotte, NC office?

  6. angerman, hang in there. i'm sure it'll come soon...even though we have our ap and ead approved, I still find it ridiculous that there seems to be no order as to how uscis goes about processing cases...but from this thread, things really seem to be moving along for us sept. filers...fingers crossed...

    And the new orleans office is my local office, so i guess i somewhat should expect it to take a while :-/

    Anyway keeping fingers crossed, cant wait for some thanksgiving turkey tomorrow :-)

    The heat and humidity here in New Orleans, was unbearable last summer, i love the time of year now though, wife if freezing, wearing coats, im still in shorts, lol

    Congrats on your ap and ead, i havent gotten any emails either after i send in the documents, so i guess its not working that well for them in there?

    Update on my status, the EAD arrived by mail today and I'm just on the way out the door to get a new drivers licence :)

    Received today, Sept. 29th, two envelopes, NOA for I-765 and NOA for I-131. Both postmarked on Sept. 25th, meaning 5 days from receipt of my file until they posted these NOA's.

    Now waiting for I-485 NOA and Biometrics appointment letter.

    Check does not show up as having been cashed at my bank yet.

    What do you know, check shows up on banks homepage as having been cashed today, Sept. 29th.

    One question to all you others out there, are you able to use the Receipt numbers on your NOA's to sign up for status messages on USCIS.gov?

    Alright Status Update:

    I-485 Noa arrived Monday, October 1st, was postmarked Sept. 25th like the I-131, I-765 that previously arrived.

    ASC Biometrics Appointment notice received today, was mailed October 1st.

    Biometrics scheduled at CLT on October 27th.

    No I'm unable to use any of the three confirmation numbers I have on uscis.gov to sign up for notifications. But at the pace this is going now, I am pretty fine with it. After the biometrics get done on the 27th, it'd be nice to be able to sign up though.

    Received Request for Initial Evidence for the I-485:

    In order to process your application further, the joint sponsor on Form I-864, Affidavit of Supðport, must submit all supporting tax documentation (W-2s, 1099s, etc) submitted to the Internal Revenue Service (IRS) for the most recent taxt year.

    Now my father in law is the joint sponsor and my wife is the primary sponsor, or does she also become a joint one when he was added?

    We sent in document for her W2s 1099s etc and 1099s and letter from his employer stating his current salary.

    Is the USCIS asking me to resubmit for only my father in law and add his W2s to it or are they also referring to my wife?

    i was just wondering your biometric schedule is on a saturday, OCt 27. is that right?

    I thought scheduling me for 12:00 on the 27th which is a Saturday is odd too, and so thought my current employer as well(they've had a number of us immigrants)

    But that's what the notice says, so just do like they ask....

    I located a thread somewhere where somebody else had been scheduled for a Saturday...

    Biometrics on the 27th was fast, I was in and out in less than 20 minutes.

    I had a touch on my I-765 EAD application on the 29th(Monday) and was finally able to look up my I-485 AOS on the same day(day of touch on AOS as well).

    I had a touch on the 1st of November on my I-485, notifying me that processing had resumed, after getting a RFE for resubmitting my Joint Sponsors papers for AOS and EAD.

    After that there was another touch on the AOS on November 6th.

    So:

    AOS I-485 last touched November 6th

    EAD I-765 last touched October 29th

    AP I-131 last touched October 17th

    My EAD stamp and NC Drivers Licence expire now on Friday the 16th. My temporary employer(what I'll have to do until I get a more permanent work permit) has however got me working throughout the weekend so I am hoping that they have forgotten about my EAD stamp so I won't have to chill at home until the EAD arrives. :)

    AP I-131 was approved today, November 16th.

    EAD, I-765, approved Nov 20th and card production ordered.

    AP, I-131, approval and parole document arrived Saturday 24th of November. It was actually far better than I expected, I expected a one entry document but got a multiple entry, valid for one year AP. AP, I-131 was touched on the 21st and again yesterday on the 25th.

    EAD, I-765 was touched on Friday 23rd and the status on it was updated this morning to notify me that the EAD card had been mailed today the 26th of November.

    I am signed up for email notificatoins from USCIS, same email and info as for the K-1. I got a lot of emails throughout the K-1 process, but nothing has arrived for the 3 new forms, so I wonder if USCIS just doesn't send anything out.(Email notificatoins are ticked on in my profile).

  10. When my wife entered the US on a K-1 in Minneapolis they did not ask her for anything but her Visa as far as documentation. They did not ask to see the sealed brown envelope. I assume this envelope contains the I-693? Am I correct in thinking this envelope and the I-693A should be submitted with the I-485. Is this normal that they do not take this? The I-485 seems to indicate we should not be submitting an I-693 with the application, only an I-693A.

    Umm, the I-693A is not a part of the K-1 process. The form used in the K-1 is the DS3032 if I remember the number correctly. Both forms include the same information, but the I-693A is in Portrait format and filled out by USCIS approved doctors in the US, while the DS-3032 is in landscape format and filled out by embassy approved doctors in your/your fiance(e)'s home country.

    You will need a USCIS approved civil surgeon to fill out the I-693A, a list of them is on the USCIS site, at:

    You are however right that the brown envelope and all information therein should have been taken at Point of Entry (POA) by the Inspector.

    And yes it is only the I-693A that is to be submitted for AOS, if less than a year has passed between the medical appointment for K-1 in immigrants own country and filing for AOS.

  12. Hey there,

    thanks to Visa Journey and all those nice folks here I was let into the United States on my K-1 Visa on August, 26th. We got married really quickly and since I had all the paperwork prepared and ready, we filed for AOS on September 14th (that's the day the I-485 was delivered). So far so good.

    On October 24th, I received a request for Initial Evidence (tax stuff of my joint-sponsor, my mother-in-law). I sent the missing stuff right away and it arrived at the USCIS on October 31st.

    But here's the problem: On the letter of Request for Initial Evidence it says the following:

    "You are ineligible for interim employment authorization pursuant to Title 8, Code of Federal Regulations, Section 103.2 (B) (10) (ii) until ninety (90) days after the missing initial evidence is received".

    I looked it up. Title 8 etc. says:

    10) Effect of a request for initial or additional evidence for fingerprinting or interview rescheduling —(i) Effect on processing. The priority date of a properly filed petition shall not be affected by a request for missing initial evidence or request for other evidence. If an application or petition is missing required initial evidence, or an applicant, petitioner, sponsor, beneficiary, or other individual who requires fingerprinting requests that the fingerprinting appointment or interview be rescheduled, any time period imposed on USCIS processing will start over from the date of receipt of the required initial evidence or request for fingerprint or interview rescheduling. If USCIS requests that the applicant or petitioner submit additional evidence or respond to other than a request for initial evidence, any time limitation imposed on USCIS for processing will be suspended as of the date of request. It will resume at the same point where it stopped when USCIS receives the requested evidence or response, or a request for a decision based on the evidence.

    (ii) Effect on interim benefits. Interim benefits will not be granted based on an application or petition held in suspense for the submission of requested initial evidence, except that the applicant or beneficiary will normally be allowed to remain while an application or petition to extend or obtain status while in the United States is pending. The USCIS may choose to pursue other actions to seek removal of a person notwithstanding the pending application. Employment authorization previously accorded based on the same status and employment as that requested in the current application or petition may continue uninterrupted as provided in 8 CFR 274a.12(B)(20) during the suspense period.

    So what does that mean for me? I am put on hold for 3 months? Is it possible to get a biometrics appointment before those three months are over? I really don't understand why it is necessary to block me for receiving my temporary work authorization for three whole months? I really need this work authorization. I am doing an unpaid internship right now but the company would hire me if I had my paperwork.

    Can I do something? Might a nice and respectful letter to the USCIS help or is that counterproductive?

    I am actually really angry because I also received a letter from the DMV here in L.A. saying that the Department of Homeland security was unable to verify my identity and therefore cannot process my application for a driver's license (I have already passed the written and the behind the wheel driving test and paid all fees and did all the paperwork). Now they cannot verify my identity? I paid 1010 dollars for the application of AOS and cannot even get a driver's license. And no work authorization either.

    And the biggest irony of all: a friend of mine won his Green Card in the lottery and he has been here for two months now and has everything: driver's license, resident ship card - and a job. What makes the lottery winner so much more trustworthy than a guy who marries a US citizen. The whole process is really quite frustrating... life could be so easy...

    Sorry about the rant, I needed to vent a little. However, does anybody have an idea how to speed up the application for the temporary work permit? Life is not that cheap here in California. I need to work...

    I am guessing many Requests for Initial Evidence are being sent out to give USCIS additional processing time, beyond the 90 days required by law, but not because all those applications have missing data.

    By sending me an RfIE, requesting and being returned data that USCIS already got with the initial filing of the petition, they bought themselves additional 40 days.

  14. Hi guys I need an advice, I called immigration 3 times and kept getting different answers on this issue.

    I entered United States on 11/13/2001 legally. My mom was granted an Asylum status and then she filed a petition form me. In 01/2004 I applied for a green card (as a child of a person who was granted an Asylum status). In 06/2005 I got married, and my Husband who is also on an Asylum status got his green card few months later of our marriage. Last Friday I got a letter from Immigration saying that since I got married I am no longer considered as a "child" so my application was denied. Now my husband filled out I130 and we are having it ready to mail it to California Service Center Tomorrow. I have few questions on this.

    1. First the CA service center shows that they process applications that were filled on 01/2005. Is this means that they are just now approving I130 for those people or issuing a visa number?

    2. Also what other choices I have? Can I jut go head and file I485?

    I think you are in a pickle. The I-485 AOS only applies to relationships where one person is a US Citizen and the other one not, but not situations where one of the person is a Permanent Resident and the otherone not.

    Marriage invalidates all status claims through your parents, and as your husband is not a citizen then you have a large problem ahead of you. It can't be expected that one knows all the rules beforehand, but this is one where a irreversible error has been made, that you can't reverse in any good manour, as marriage to a permanent resident does not entitle the spouse to seek permanent residence but only to get into a waiting line for a visa number, which will take years.

    Hopefully someone with a better more qualified experience will comment on this thread.

  16. Same thing happened to me. If it is really a 90 day delay I am so hooped. It's only been about 43 days, so I am halfway there. But it says on my AOS I should hear back within 60 days of receipt so thats 17 days away. Here's hoping the 90 days is just an estimate.

    I am to write a final thesis next spring from my Bachelors studies, for that I will need a work permit, as it technically is work.

    So if no EAD on february 1st, not only will we be strained financially from me not being able to work, but also my bachelors will be postponed from June 15th 2008 to January 15th 2009. Now that would also truly suck as I already postponed it half a year to move over to this site of the pond(should've been writing it now)

  17. Argh, I'm so frustrated right now. I just got an RFE for more documents from my joint sponsor, and they have started holding up EADs based on this RFE. There's a lawsuit being filed in Texas over this because it's unfair to hold up a totally seperate application over a RFE for something else, but this claims I won't get my EAD for 90 days post RFE receipt. Is this really the case or is this wording just covering their ###?

    I hope this makes sense to you, I'm really upset about this because it's hard to go 7 months without working when I'm the primary breadwinner, how the hell do they expect people to survive? This whole system is so insane.

    I got the same ####### letter yesterday, and I also have the same story, that my salary is something we're counting on getting.

    I sent them all they are asking for now, when I mailed the application in September, but now ofcourse have to do it again. This at least postpones my case for 3 weeks, as it took their letter 1 week to get to me, it'll take my father in law at least a week - 10 days to send me this stuff again (he's a busy man) and then a few days for my mail to get to them.

    I hope my employer will look the other way when my work stamp expires on Nov. 16th, but if not then I guess I'll be sitting at home for a few weeks, the worst is that I can not go shopping around for a more permanent workplace since I don't have the EAD, but only a stamp close to expiration.

    I think I've seen that this 90 day ####### is not real, but it is a nuisance threat, and I could totally see USCIS sending these out to save their own asses, when they're running late in processing and feel that they need to get themselves additional time.

    They are required to give out the EAD within 90 days, by law, but hey if they send out an RFE then they can get themselves 90 additional days for slacking! (Yippee)

    Ofcourse it is a totally bogus way to do processing.

  18. Tell me how can your fingerprint card expire?saying that! My wife just recieved a letter from uscis and require her to do the finger prints again because it was expired from jan. 2006 the first time finger prints? she has been waiting for her green card after her interview approved in April 2006. Because of her background checking from FBI.

    That is a very good question, and in a bizarre way funny.

    But nevertheless they still do expire in a year at USCIS so that they'll have to be redone if the green card has not been issued 365 days after the last biometrics was done.

    Received today, Sept. 29th, two envelopes, NOA for I-765 and NOA for I-131. Both postmarked on Sept. 25th, meaning 5 days from receipt of my file until they posted these NOA's.

    Now waiting for I-485 NOA and Biometrics appointment letter.

    Check does not show up as having been cashed at my bank yet.

    What do you know, check shows up on banks homepage as having been cashed today, Sept. 29th.

    One question to all you others out there, are you able to use the Receipt numbers on your NOA's to sign up for status messages on USCIS.gov?

    I-485 Noa arrived Monday, October 1st, was postmarked Sept. 25th like the I-131, I-765 that previously arrived.

    ASC Biometrics Appointment notice received today, was mailed October 1st.

    Biometrics scheduled at CLT on October 27th.

    No I'm unable to use any of the three confirmation numbers I have on uscis.gov to sign up for notifications. But at the pace this is going now, I am pretty fine with it. After the biometrics get done on the 27th, it'd be nice to be able to sign up though.

    In order to process your application further, the joint sponsor on Form I-864, Affidavit of Supðport, must submit all supporting tax documentation (W-2s, 1099s, etc) submitted to the Internal Revenue Service (IRS) for the most recent taxt year.

    Now my father in law is the joint sponsor and my wife is the primary sponsor, or does she also become a joint one when he was added?

    We sent in document for her W2s 1099s etc and 1099s and letter from his employer stating his current salary.

    Is the USCIS asking me to resubmit for only my father in law and add his W2s to it or are they also referring to my wife?

    i was just wondering your biometric schedule is on a saturday, OCt 27. is that right?

    I thought scheduling me for 12:00 on the 27th which is a Saturday is odd too, and so thought my current employer as well(they've had a number of us immigrants)

    But that's what the notice says, so just do like they ask....

    I located a thread somewhere where somebody else had been scheduled for a Saturday...

  21. Yes, there's a new law in NC that discriminates in favour of canadians against everyone else as only Canadian foreigners driving experience counts.

    Because road laws in Canada are nearly exactly the same as in the US, and we drive on the same side of the road, so there's not a whole lot of difference driving in one country over the other.

    As for getting a license in NC, your EAD and SSN along with mail from a gov't office (NOA letter) addressed to you at your current address should suffice. Your license will likely be valid til the expiry date on your EAD.

    I don't mean to be rude, but I do not see anything special about driving here, nor can Canadians be that special.

    The only real difference I've notice is that on the other side of the pond, where I've been driving, then right turn on red is not allowed.

    Now I wouldn't call that "a whole lot of difference".

  22. We lived in NC and EAD and Social Security Card (you have to bring it in person) is sufficient. Though those DMV people there are really strict, unfriendly and way tougher than in CA.

    Call Allstate, they recognize out of country experience. It's ridiculous anyway - Geico suddenly in Feb 07 said they would no longer recognize my experience abroad and wanted to double our insurance. We shopped around and Allstate doesn't participate with that bogus fee hike.

    Yes it was Geico that tripled our fee because Chris is an "unexperienced driver" in the state of NC. Insanity! I am calling allstate right now!

    My wife had insured our car through USAA, which she was eligible for, before I came over. Adding me onto the policy wasn't a problem and did not raise our policy costs for the remainder of the period, further to that our premium is dropping by about a $1.5 a month for the next period which is starting on Nov. 12th, as compared to the previous 6 months when I wasn't here for 4 out of those months.

    Ofcourse $1.5 a month is a minor crumb, but they all add up in the end.

  23. We are going though absolute nonsense here trying to figure this out, hopefully someone out there is going through or has gone through this recently.

    Chris has his EAD, Advanced Parole, Social Security, we even just added him to my insurence for a fee jump of over $400 because he is an "inexperienced driver in NC" HOWEVER I called the DL office to make sure we had everything in order to go and get his license and they say he can't get one because he doesn't have a resident card. Or they need to have a visa that states the day he arrived and the day he must leave!

    Now if I am correct his I-94 gives the k-1 dates...but since we are going through AOS those mean nothing now not to mention they are expired now.

    So what do we do. Do we wait till he gets his card? How is that right. he can work, pay taxes but he can't get a DL in North Carolina???

    Please is anyone else out there going through this from NC...am I mega confused?

    I will be hitting this in a few weeks as my 2 month drivers licence(issued until my I-94 expires) will become invalid on November 16th.

    However I believe a passport, your social security card and EAD should be sufficient to get a drivers licence issued, with a expiry date set to the expiry date on your EAD. You might even bring your I-485 NOA, athough it is not valid for anything.

    The EAD shows that the USCIS has given you permission to work within the period the EAD is valid. That in turn means you are legal here while that is valid.

    The EAD is definitely a valid unexpired document of the USCIS, a limited permission to work here.

    I guess my 5c advise would be to show up at your nearest DMV office with passport, EAD, SSN card, a utility bill or lease contract, bank statement etc. in Chris's name. Often it works much better just to show up and talk your way through things while on the spot instead of trying to call these kind of offices up. If you're there, then there's additional pressure on them to look into your case or consult with a colleague as opposed to just saying no on the phone.
