  1. Good day every one here ,

     

      I want to say a big thank you to every one that has being supporting Me with advise and encouraging messages ,  we just got a memorandum from the USCIS and it was listed we should provide proof of our marriage and relationship.  I am providing all the evidence I used during my interview before the case was sent back for review and my wife is also gathering what she can, just  to show proof to the USCIS that we are legitimate and legally married . my question is that , if we put all we can together and send to them , and the case must be sure be reaffirm and send back to my country embassy , would I have to go for another serious interview for the second time .  am so tired of all this . please some one that as went through this process should put me through please

    My wife just finish talking with the nvc now , she ask them when would they send the case to the USCIS , they said soon. And they also said only the USCIS can fix it for us. So I think its not something difficult okay. God will handle it.

    It could take 3 months but some wait much longer.   Its best to be prepared either way.   Mine was one of the fastest turn arounds I've seen on VJ. 

    Interview may go much smoother as you would have overcome the reason for denial but right now I would focus on how to overcome it.   USCIS may make it more difficult since it wasn't originally disclosed but you won't know until you have the letter.   I would consult with an attorney and start gathering the documents you may need plan more trips together to relive some of the stress of the time apart.

I had gathered all the death certificate documents either from the police and the hospital together with the government . and I will be forwarding to my wife as soon as they send her the letter to show what they need, but for now we don't know what they might need and it might just be a very simple thing.

    It is against the TOS of Visa Journey to tell someone not to reply to your message.  People here are very experienced, and want to help you, and part of that is knowing what you can realistically expect based on recent experiences with your consulate.  Lagos is not an easy consulate, and the omission of your first wife's death certificate could be quite a problem.

    Yes I know that's the problem and God will handle that okay.  I did not stop any body here for replying me please do not  get me wrong sir, its just that some message really get me more scared and heart break OK.

    I also met with some one already from my region which his case took just 3 months and 2 weeks at the USCIS to be review okay , so this is why I was shocked and felt bad to hear the long wait .

    The poster wasn't harsh just reality.   My petition took about 4 months to be reaffirmed my case is from Pakistan.  They are speaking form experience for cases in your region so when they say expect the long wait its because they have seen others wait that time frame.   It rarely reaffirms without needing information from you but it could.  In that case it would be because USCIS doesn't agree with the embassy so they reaffirm without a NOIR.   Unfortunately due to the previous marriage not mentioned I don't see that happening.   After USCIS completes review they will send your a response.   You'll need to respond with the evidence of the ex wife and her passing (possibly even a reason to why it was not originally disclosed) or anything else they request in the letter.     They will then review the evidence and come up with a decision.   Lots of people have been through this same process.  Its not quick or easy.

    You ask what is next. Your application is being sent back with Notice to deny or notice to revoke (NOIR/NOID). USCIS will either agree and revoke or deny your petition. Or you will get a NOIR letter where all the reasons for denial are listed and you will have to address each denial point with evidence.

     

    Right now all you can do is wait. and its a 15 months to 2 year wait. Not 6 months at all. Are you in Nigeria or Ghana?

    Thank you for your message okay. We have being talking to the USCIS about this case and they confirm to us that the waiting period is just 3 months for the review and it will be reaffirm back to the consular, please do not reply message the way you sound . you are making me feel more bad about it . thank you . my question is this , after the reaffirm and the case is send back here , would they be any delay again?  Am in Nigeria

    at this point your wife can contact NVC and talk to them ask them to look at the notes on the account to see the exact status if they will tell her.

     

    I would venture to say your wife will need to show proof of bonafide marriage, there was something the CO didn't like and the reason it was sent back to NVC, and ultimately USCIS, I would recommend having her speak to an immigration attorney at this point if things have not been understood what is need from start which is what it sounds like.

    Thanks . We are talking to an attorney already but we are still wait to see if the case will be send to the USCIS or sent back to the embassy.  During the filing of the case, my wife only mentioned that I have a child and not my previous wife is dead . that's the problem . I think the USCIS will demand for the death certificate now. Thank you very much .

    Once with USCIS it could take 6 months to a year before you hear something.   I got my NOIR in less than 6 months but every case is different.   Once USCIS responds with the NOIR than you can make your next move.  At this point if you have any idea why they are returning the petition its good to get all the evidence needed now to rebut since you'll only be given 30 days to submit.

    Please kindly tell me the next move you think the USCIS will ask us to do when they receive the case ?

    the death of your wife, and the marriage to new wife, were close or not close at all, was the marriage of new wife before death of old wife?

     

    now the next question needs answered, you should have had the papers for the death of your first wife, when your now current wife sent in the petition for you.

     

    I assume this was a CR1 case, and how did it get past NVC if the tax papers were not completed?

     

    if your interview was Jan 30, 2018, it would only have required to have the 2016 tax papers completed, these are the same papers that would have had to submitted to NVC in order to get a case completion and sent to embassy in your country.

    My previous wife died 4 years ago before my marriage to my new wife . and the tax paper was intact when passing thru the nvc but on getting to the consular desk , the consular said its not enough and I will need my wife relative tax paper for support my wife tax . and that was done and its okay.  About the death cert, I did not know all this things will be required from me. You know, its Africa and we dont take all this things seriously until my interview and I went straight to the hospital and the government office to get it done and I explain this same explanation to the consular on the day of my interview and this is why she gave me the go ahead and get the death documents just for me to be able to submit together with the support tax return papers.

    Thank you my brother.  The tax return papers are not complete and it was discovered at the time of my interview and also the death certificate of my previous wife.  my wife got the tax ready and sent to me immediately and I did got the death cert ready too. This is after my interview and I had being in contact with them the embassy till date .  they receive all the document and they place me on AP since January and they just return the case to the USCIS early this November.

    Yes bro, they gave me a 221g for me to get the missing docs and I submit the 221g together with docs requested . but they did not give me any kind of form before they return it this time .

Good morning all, please I had my cr1 interview 30th of January 2018 and I was place on AP since then after demanding for some documents , I just got a call from the embassy early November saying my case as being sent to the USCIS attached with memorandum . just last week my wife called the nvc and find out the case got to them and up till now they still holding it , we called and they keep saying its on AP.  My question now is that, I thought the nvc will receive the case and send it across to the USCIS.  But to my surprise the case is still with nvc and its going to 2 weeks now. Please some one should advise the situation for me to be clear

Hello every one,  I  am still on administrative processing until now.  It's 3 months now and we haven't hear nothing from the embassy.  Please can any one that as gone through this process and got approved with he or her visa successfully.  Please reply me by telling me how long am I to wait for this process to finish.  I NEED TO SEE SUCCESS STORIES.

She glance at our marriage photos and tell me it's okay.  But I need to bring some additional papers before my visa can be issued to  me.   It's about the affidavit of support and death certificate of my ex wife.  That's all.

    I recommend you to read all the reviews in visajourney for that consulate.

     

    Is good that you can show proof of communication since the start of the relationship. Take with you not just the pictures of the wedding, but apictures of both of you together in both visits, with the receipts and passport stamps. The marriage certificate is important, but is not evidence of bonafide marriage.

    Joint bank accounts are good evidence in case you have it. 

    I have a joint bank account with my wife.
