I don’t understand the family relationships. Who is sponsoring you?

who is the principal beneficiary and who are the derivatives?

your mother is unmarried but has an expired marriage certificate?

    who are you married to?

how can you have a brother in law attached to the same case as you?

My grandmother is citizen and she sponsoring us.
Yes my mother is unmarried. We made marriage certificates a long time ago for interview, but as I said it expired and we made a new ones and submit them.
I'm single. Also my mother is single since 2003 year.
We live together me, my mother and my brother. He attached to the same case as I'm because he is also son of my mother. what's problem here?

  2. Hello there.
Last year 8 August Me, my unmarried mother and my brother-in law(5 years old) attend on interview(F2B). Everything went fine , but mine and my mother's marriage document was expired, also CO told us that he needs "acceptance of father" for my brother and gave us 221g Pink paper. We collect everything the same day and submit them all. Aproximately 2 weeks we waited after that they emailed us that they also need "F2B retention letter", but our lawyer lost it and we didn't find that letter. Then our status changed from F2B to F1 and our case transfered in citizen's raw. On 22 january we write them that our PD is current and we need case update, after 7 days on 29 january our case was updated and they also replied that we must wait SHORT TIME and they will give us instructions. After last answer 15days gone, but still no updates.

I don't understand is it good or bad after our interview my mother's case changed from READY to AP at the same day, but my brother's and my case is frozen on READY since interview date.
Aproximately 6months is gone after our interview and how do you think howlong time is medical valid 6months or year? I mean we must take a new one?

If someone had the case like ours or don't know can anyone give us any advice? What we gonna wait next?

Do you already know the date of your another interview?

I would suggest you not to trust any crucial paper work to a lawyer unless you keep a copy

I wrote them via email two weeks ago and last week they replied that in short term they'll tell us what we gonna do.
I think second interview don't need just new medical and that's all.

  4. Hello everyone.

Our case changed category from F2B to F1, after interview because our lawyer lost retention letter.

    Interview date was 8august.

Our cutoff date is 27 august. At this time the visa bulletin is on 22 august. What do you think on next visa bulletin our date will be current right?

And another question: We must attend on second interview or we’ll take our passports and that’s all?

During the interview consul was very nice with us.

Also our medical expires soon and we must do it again right?

Thanks for attention and please if someone knows anything like this situation  please reply.

Why is there a Marriage Certificate? Beneficiaries for F1 F2b are supposed to be UNMARRIED.

I think the lawyer can request a copy of the first opt out explaining about the lost copy. NVC doesn't charge for it.

    Waiting on F1...

You already answered your question. Beneficiaries F1 and F2b must be unmarried and that’s why they request the proof.

When you take Marriage certificate there is 1 year expiration time and we took it last june and interview was on august. Maybe consul though that I’m married or something ... I don’t know all these process is veryyy veeeery boring😞😞😞

  6. We had interview 8august. Co gave us pink paper for additional documents. Marriage certificate was expired, also police certificate. We collect and submit them all at the same day. Aproximately 2 weeks later they told us that we need also F2B retention latter, but our lawyer lost it and we didn’t send it and our status automatical changed from F2B to F1.

My question is we must wait on F1 row right? If so when our date will be current they give us the visa or after that there is additional procedures?

Is there a chance of denial?

After the interview the co asked to submit our passports with documents. They didn’t return our passports. I think it’s good sign, right?

  7. Hello everyone.

8 August was our interview and we attend me, my little brother and my mother. Everything went fine, but there were marriage and police certificate expired and consul gave us for that 221g pink paper. We collect that documents the same day and submit them all. Around 2 weeks later we received the letter from the embassy, they told us that they also need F2B retention latter. Fortunately our lawyer had that document, but she was on voccation and she didn't send that letter 5 day,  but 5 days later she did. When I logging in on caec.state.gov it says that last update was on 21 august. I'm worry our case will be still F2B or they will change the status on F1?

If someone had the same situation or if you know anything about this situation, please explain me: aproximately howlong time need for answer and will they leave the case on F2B?

    Thanks for attention.

Did you make a request for F2B retention (F1 Opt out)?

If you did not do this, and the Consular Officer found out that the petitioner was a citizen, he will upgrade your case from F2B to F1.

Which mean you will have to wait until F1 is current so you can get the visa, no need to attend the interview again, but if your medical exam is expired you have to do it again.

Some Consular officer may ask you to sign a request for F2B retention in the interview so you can keep the F2B status, then they can issue your visa.

You should read the letter again to see:

    - Who send it? USCIS or NVC or Embassy?

    - Did they say anything else regarding this?

You should contact the Embassy via phone call or email to ask them about this. If they ask you to sign a F2B retention, you should do it now or you will have to wait until F1 is current.

I remember that our lawyer did that F2B retention, but she didn’t gave us any document about that. If my lawyer find that document and we will send it, is there a chance to stay in this row again?

She is in vaccation at this moment

  9. 8 august was our interview(F2B) . Everything was fine consul was very friendly he only asked to my mother when she married and devorced exactly. He also asked me what I'm going to do in USA. Our marriage document was expired and he told us that we must to take the new one and that's all. On the Pink paper also written the same(Marriage document). Today (After two weeks) we received letter that we jumped from F2B to F1. What this means we must wait aproximately extra 6 month and there will be the second interview or what? on the interview consul didn't mention anything about this.

There was no problem in your interview, and they only ask for an update of your document, so as long as you can provide them the requested documents, it is nothing to worry about.

Please note that you have to collect ALL the requested documents and submit them ALL at the SAME time.

Do not submit documents in several times, they will forget or lost them in processing.

After the interview, you can check the status on website https://ceac.state.gov/ceac and see something belows:

Ready: your case is in the Consulate and ready for your interview. This status appears before your interview.

Sometimes this status still being shown after the interview 1 month, because the Consulate is not ready for reviewing your missing documents.

Refused: It mean your case is not ready for issuing the visa. It will be changed after you submit your documents. Do not panic if you see this, unless it stills show this after 1 month.

Administrative Processing: Your documents are being reviewed by the consular officer. The processing time may be within weeks or months.

You can ask the Consulate (not NVC) about your case status every 2 weeks - 1 month via email.

Do not spam them email or call everyday.

Issued: you visa was issued and being sent to your address.

Last update was 17 august. On my mother's case shows Administrative Process and mine READY. What do you think howlong time need to be done?

By the way here is a direct quote from uscis on CSPA contradicting what “someone” told you:

This allows some people to remain classified as children beyond their 21st birthday. (From https://www.uscis.gov/greencard/child-status-protection-act)

think about it logically, what would be the point of even having CSPA If you are automatically done when you turn 21?

    Thanks I understood everything.

Today my mom got his interview date on 8 august. My case is still under review(((

Ok, if you’re not understanding what we are saying about CSPA and as you already have a lawyer maybe they should explain it to you properly. I don’t know how else to tell you that you’re ok under CSPA different from what I and others have already explained here. Do you understand the concept of the CSPA?

I understand what you're saying, but someone told me if I'm already 21yo than I'm done CSPA can't help.
My case is still under review and my lawyer says, that If they don't qualify me on interview than we can complaint them on federal attorney, but it's extra 6months or year.
