  1. In trying to see about cancelling, if it is even necessary to cancel the previous K1 application I am running into a lot of frustration.

    1) The previous K1 applications original expiration was in March of 2020,  2 years and 5 months ago. I have read that it is only extended for a year. But others advice that I still need to cancel it. Does anyone know the facts?

    2) All I have is the Receipt Number and the 9 digit A number from the NOA2, I never had the case number beginning with MNL, does someone know how I would obtain that?

I have sent emails from other advice only to get them bounced back. How do I follow up on this without losing my mind.

But, I would concentrate on meeting in either the Philippines or other countries.

Most foreign nationals are refused a tourist visa when they are of a young marrying age. They're also denied if they do not have strong ties to their home country AND they have a USC partner.

I need to clarify, I live in the Philippines (via tourist visa extensions), I returned in March 2022. I live with my girl friend in the Philippines.

The true purpose of the B2 visa is so she can accompany me when I go to the US for vacation and/or visit family there.

I am a naturally born citizen of the U.S.

I do not want to live in the US at this time.

A K1 for my girl friend at this time is a waste because I do not want to live in the US for the time period required.

I just want to be able to visit 3 to 4 weeks at a time every 1 1/2 to 3 years.

But I very much want her by my side when I visit.

The intention is Not trying to do an end run around the process, a K1 would actually be easier if marriage was the purpose.

A K1 is not appropriate because the intention is Not to stay.

B2 is appropriate because the intention is truly to visit.

  3. We do not want to do a K1 visa at this time, but I would like to take my girl friend to the US for vacation from time to time. I noticed there is about a 400 day wait for B2 visas.

Trying to get a handle on the chances of obtaining the visa and how to present the case best for successfully obtain the B2.

She has a daughter and about a hectare and a half in her name and a older house on it that was her parents. She has worked in Taiwan between 2019 and 2022. She also has a townhouse in her name through Pag-Ibig that has been assumed by another but remains in her name at this time. But really no money in the bank. I would be paying all expenses, so there is not a financing issue, but worry about how CIS would look at this.

She is not working at this time, but possibly could be by the time the 400 days for the B2 interview would come up.

I know a sponsor is not required, but I am thinking what is going on with financing may be of concern as well as reason for vacations in the US.

Would it be best to explain our relationship as the primary reason?

My background could be a further complication. I have a previous NOA2 for my ex fiancée that the original expiration date was March of 2020. The pandemic kept me and my ex separated as I got stuck in the US during that period and there was no way to repair the relationship upon my return. I am concerned as to the true status of the NOA2 from the previous relationship, as I have read conflicting information, some saying it is cancelled at expiration date, and others saying it will be extended automatically. Could it possibly be automatically extended from March of 2020 until now? Or would it be cancelled by this time?

I know this is confusing, but really need help on how to best handle the B2 for now, as well as how to handle the NOA2 from previous relationship should sometime in the future wish to pursue a K1.

    lol, that's funny as hell.

Also the USEM MNL is NOT Closed

I will say up front that I do not recommend getting married and starting all over with a CR-1, but should you want options ........

You and your Fiancée can get married online through the state of Utah and neither of you need to be physically present in Utah at the time of marriage and it does not matter if your Fiancée is physically located in PH. - Currently the PH Authorities are not allowing spouses to enter alone i.e. the couple must enter together but early last month this was not the case and in the future it may not be the case again so there is a possible option and if going this route you can "Consumate" until your hearts content lol

Another possible option is to fly your fiancée out of the country and meet in a 3rd party country to you both (CR is an easy one for US / PH) and get married abroad get all the documentation in order and then re-enter together (Consumation would not seem to be an issue in this case).

Both of these scenarios would require much documentation and getting a 9a visa to enter which the DFA is not issuing exemptions for at the moment and neither is the PHEM issuing visas for at the moment but may soon be again. Additionally, flying out to get married may require quite a bit of money and additional paperwork for the PH IO.

The USEM MNL is currently processing K-1's outside of just the Expedite criteria of the additional category of those who are already case ready at the USEM. Give them a call and give them your priority date and some other info including your Fiancée's Passport # and they may follow up with an email to your Fiancée to sched. an interview

I thought they were not processing K1's. I am confused. We got the NOA 2 back in January of 2020, said valid between 11/2019 through 3/2020. I was under the impression that it would be extended. I actually tried to get back to the Philippines in March 2020 but my flight was canceled.

    How does that happen?

He has never registered his marriage in the Philippines assuming he was married in the USA to a US Citizen before.

I would assume he would already have a cleared on CENOMAR, Doesn't cenomar basically say the person is single?

I was married in the Philippines and lived there for more than 10 years. After waiting more than 3 years and realizing the lawyer was just ripping me off and playing games with the annulment I returned to the U.S. for a divorce and what I thought would be a short break. I also started the K1 process and received the NOA 2 somewhere around late January. The situation is a bit complicated.

How will you enter the Philippines? Do you qualify for one of the exemptions to enter? Or do you already have a visa?

You don't need to have you divorce recognized there as of late, read this thread :Local Notarization of Legal Capacity to Marry - Philippines - VisaJourney

I can't, that is the problem. My flight was landing in Manila on 3/19/20 and the connecting flight to Davao was cancelled.

Imagine anything in the Philippines being a whole year behind and trying to catch up... it's gonna be rough.  I'm going to fly there and stay until the process is complete once tourist visas are allowed again.

I'm going to fly there and stay. I'll have to get my divorce recognized so we can be married there. The COVID delay has already messed up our tight plans with dealing with the kids. The boys really need someone now. I've become numb to missing her, but the kids have me crying if I dare think of it. She doesn't have the family support a lot of Filipinos have and the boys really need someone. There is no making up the time at their age. I feel stupid and guilty for ever leaving. What was supposed to be 6 months is now quickly becoming 2 1/2 years with no end in site. I fear things are changing so much, so quick, it may never happen.

I am starting to think that all of us are the idiots.... we spend the money, do all this paperwork and take all this time to bring our loved ones here, when instead we just fly them to Mexico and meet them at the border and be legal.......

I thought of that. But actually the Philippines government would not let the woman leave because of human trafficking concerns. K-1 visa application can't go anywhere, NOA 2 in January 2020. Have been separated 2 years. Flight back to Davao March 19, 2020 but flight from Manila to Davao cancelled so I did not go.

How I regret. I thought of taking a flight through Singapore directly to Davao as they were still available. But I did not do it, thought it would be just a month or two at the most delay. How I regret. Was separated already 14 months in March 2020.

She can't get here, I can't go there. This is hell!

Does this mean your fiancee got a K-1 visa?  Are you thinking of going for CR-1 instead?

No, we just got as far as the NOA 2. Long.. short...  because of the kids we're probably going to delay for another 4 or 5 years.

Was discussing with her about having a wedding in PI w/o license because of divorce recognition if she wanted to. She said she thought I didn't need the divorce recognized by the RTC.

I'm not finding anything on point and was trying to verify what I was telling her was accurate.

Probably no problem getting the license, but when reported to PSA wonder if it would be considered bigamy.

Then you are still considered married in the Philippines. You will need Philippines Judicial Recognition.

    https://www.philippineconsulatela.org/wp-content/uploads/2017/12/Judicial-Recognition-of-Divorce-in-the-Philipines.pdf

What confuses me is that says "Filipino spouse", I am not Filipino. But the marriage is registared with the NSO.

  11. U.S. citizen married to a Filipina in the Philippines, received divorce in the U.S. from filipino wife.

Is all I need is a "Affidavit In Lieu of Certificate of Legal Capacity to Marry" from the embassy or would I have to get the divorce recognized in the Philippines since my last marriage was in the Philippines to a Filipino?

Off Topic: Is there a place online foreigners are monitoring/discussing COVID, travel, and the Philippines. Personally had tickets to come back March 19 but flight to Davao got cancelled. Now I don't know if/when I can go back. Had K1 application approval but need to make other plans.

Not for her sake but for yours.    You can email the consulate to rescind the petition

I am assuming you are saying for my sake is in case she would apply for it without me knowing.

    Is that a correct assumption?

    Or is there another reason?

I am not worried about her doing anything like that. She just is not like that.

She is overwhelmed by the situation and trying to get her head together. I have to admit I made matters worse.

I want to keep the ability for her to apply, I was just wondering if keeping it open if it could cause harm if she does not apply before it expires.

The NOA2 had a valid to 3/27/2020 date, so I assume that is when the ability to apply expires.

She should know if she can deal with the process and other issues before then.

I was wondering though if it was close to the expiration date if the date to apply can be extended?

I am upset with the situation, but I understand and I want to give her as much time as possible.

    Really not true...

I thought you needed a good reason to get a waiver. The girl changing her mind doesn't sound or look good. I know the notice said I was now entered into the multiple applicant data base.

I was thinking they were looking for visa fraud, domestic abuse and human trafficking, but then I heard you needed a really good reason. I just don't know.

  14. I don't know. I got my, I guess ex fiancee, application approved for her to apply and now she won't apply. Doesn't want to deal with it if she does have TB again. I could fix things if I could go back and be with her during the process, but I can't because I could lose one of my eyes if I don't continue treatment. I said I would give her P17,500 a month because she would be out of work, a little more if it was really needed. We lived together for 2 years, I feel like an idiot.

It was my second application for a K1, now I can't even apply again.

Sorry for the drama, just, well.......

  15. Ok. Once NVC Forwards do we have to wait until something from the embassy is sent to her.

Or if I contact NVC and get the case number she can fill out the DS160 and set up an interview?

If I understand correctly we are about a month away to being able to submit the DS160, is that correct?
