  1. riblet, sorry for confusing you. Our I130s are retained at USCIS and I'm not going to file I824. My I129F was received by NVC(according to the letter from NVC dated on 12/26/06).

TongnadWei - did NVC receive your I130 or your I129F, I was just confused because you said your NOA2 for the I130 said it would be retained.
    Please add me

    Name -----NOA2 Date ---------- Retain or Forward ------- K3 NOA2 --- I824 filed---- Date NVC Received

    TongandWei -----12/18/06 ---------- Retain ------- yes--- N/A----12/26/06

    Thank you!

  2. Congratulations!!!!!

xcs: which one are u going to take? what's next to do? geeee im still confused about this processing things...

Right now I have no choice than taking route K because my stepson's I130 is still pending. If his I130 gets approved, I will see how CIS (or NVC? not sure which one) handles my I130s, retain or forward. Forwarding?-great! Retain? Hmmm $400, not a small amount , got to think about it. I'm still waiting for the paper notice for I130.

  4. Have you heard "USCIS Proposes to Operate Centralized Background Check Systems to Reduce Backlogs Effective 01/03/2007"?

I thought the name check will be done at NVC, not at service centers. Correct me if I'm wrong.
Probably hung up in the name check, the service center has up to 6 months to process, and if you call them they will just give you the same info as what you see on line.

Name checks happen at any point in the game, there is no predicting when a visa interview will happen, and if the interview will be a success.

Yes name checks happen at all stages of the USCIS, NVC, Consulate, Adjustment of Status, it is a pain, and slows things down, you can thank a few mad-men who flew planes into buildings for the extra precaution, do not get up-set with the government, USCIS is part of Homeland Security.

  7. Our Mao,

I agree with you. If CR1 can beat K3, that will be perfect. Actually the point is which is faster, Jame's shortcut or EAD,assuming 129 and 130 are approved at same time (that has happened in several cases). If the case is at NVC too long, longer than the period of getting EAD, then K3 would be better choice. (i'm not sure if you get my point). Oh well, there is so much uncertainty. We just have to wait and see.

    Tong and Wei,

Those are very good questions but I dont know if I have the answer to them! ahhhh

Well, in my case, my I-130 was approved before the I-129F. I dont know when the I-129F will be approved. But the I-130 is definitely better than the I-129F (for me anyway), because once you enter, you can work right away. You do not have to file for 'authorization for employment'. I really want/need to work right away when I enter the US (long story short, I was working in US, and my company in the US arranged for me to work in the Canada branch office while I wait for my approval. When I enter on the I-130, I can work right away. However, if I get the I-129F, I will enter, file for authorization for employment, wait ANOTHER three months for approval. I dont know if my company will be nice enough to do that for me so I think at this point in time, I'll go with the I-130.
