I did want to call and see what could be done over the phone but I was under the impression that speaking with the officer at the Infopass was the same as speaking with someone on the phone. It seems as though my call would have still been too late as the greencard was issued on August 30th and I didn't realize the stamp in his passport was wrong until Sept. 7th. I'll be submitting the I90 tomorrow and once we get the receipt, we'll be scheduling another Infopass to have his passport stamped that an actual greencard has already been issued.

  2. Hello friends, here's an update:

     

    On 11/04/2017, status changed to card is being produced. It stayed like this for a month. 

     

    So on 12/04/2017 I called teir 2 customer service and they made an inquiry to explain why it's taking so long. Teir 2 told me that the card production was interrupted for some reason so he made the inquiry.

     

    On 12/05/2017 the officer responded to the inquiry and the next day it said inquiry is completed. 

     

    On 12/12/2017, it said "on 12/12/2017, we ordered your new card to be produced. 

     

    On 12/14/2017, it says new card was mailed to me. 

     

    I am hoping it's the ir1 so I won't need to file I90 and wait for another forever.

  4. Update: 

     

    It's been more than a month since the last notification of card production was received. I called teir 2 USCIS customer service and he said that the card production was interrupted for some reason so he made an inquiry to see why it was interrupted. 

     

    Question: could that be due to the previous inquiry the officer made (cr1 instead of IR1) and now they're catching it? What could the other reasons be? 

     

    On the online profile on uscis it says "we will notify you if your document cannot be produced and provide any instructions".

    I don't know much about IR2 or if calling them would help. I called and I'm crossing my fingers to see what green card I will receive. Try to call though, it doesn't hurt. They can make an inquiry to correct it if it's not produced yet. They made an inquiry for me but I'm not sure what happened behind the scenes and whether or not the officer saw it. All I'm doing now is waiting.

     

    even if I get the incorrect card, I can file form I90 with the incorrect card to get the correct one.

    I paid 2 weeks after I arrived but it's not the problem. After you arrive you're supposed to receive your green card WITHIN 120 days. That's the notion you'll get from USCIS. Some people get it sooner (still within 120 days) and a few get it later.

    No not yet. I'm still waiting for the card to arrive. On 11/04/2017 I got a notice that the card is being produced and it should come within a month from then. 2 weeks went by and I'm waiting. I'll update you once I receive it. 

     

    Did you get the incorrect stamp? Can you update me about your card too please?

No it is not, it is based on how long you have been married at the time the visa or permanent resident green card is issued, or in the case of a K1 visa who filed Adjustment of Status it is based on how long you have been married at the time the permanent resident green card is issued. I personally know people who came to the US on a K1 visa, waited a little over 1 year after marriage to file Adjustment of Status, by the time their permanent resident card was issued 1 year later it had been 2 years since married thus they received a 10 year green card without having to file for Removal of Conditions.

    Differences Between IR1 and CR1 Visas

    • IR1 (IR stands for "Immediate Relative") Visas entitle their holder to receive Permanent Residency within the United States for a period of 10 years (may be renewed)
    • CR1 (CR stands for "Conditional Residency") Visas entitle their holder to receive "Conditional" Permanent Residency within the United States for a period of 2 years

    The deciding factor on which visa an applicant is issued (IR1 versus CR1 visa) is the amount of time that they have been married at the time the visa is issued. If an applicant has been married to their US Citizen spouse for a period of two years or greater they will be issued an IR1 Visa. If they have been married less than two years they will be issued a CR1 Visa. A CR1 Visa will result in the applicant obtaining "conditional" permanent residency within the US and after a period of two years the applicant can apply to "Remove Conditions" 90 days before the conditional permanent resident card expires and they will be issued a regular 10 year green card.

    Thanks for your comment. I think what you're saying may not be 100% correct. I took a photo of what the embassy gave me that is attached below. I think it means from the time being married to the time I'm admitted to the POE.

    Neither do I throw dice. My question is clear and can be answered by someone who knows the answer. Or someone who had his passport stamped with cr1 after 2 years marriage and whether she or he received the 2 ir 10 years green card. I'm not looking for statistical analysis.

    The passport POE stamp was CR1 because your visa is CR1, it doesn't matter if you entered the US after your 2 year anniversary there were no mistakes it is not based on when you entered the US. In regards to your permanent resident green card, if the card is ISSUED prior to your 2 year wedding anniversary then you will receive a 2 year green card, if the card is ISSUED on or after your 2 year wedding anniversary you will receive a 10 year green card. In your case as far as I know, since you have been married 2 years or longer AND your permanent resident green card has not been ISSUED yet, you will receive a 10 year green card once it is ISSUED. If they issue a 2 year green card then make an appointment at your local USCIS office to address the mistake and request they re-issue a 10 year green card due to mistake.

    Thanks for your comment. I understand that I can correct it in case I receive the wrong one. But I was wondering what are the chances that they'll give me the wrong one at the first place.

    didn't care much coz for us being home was important. But when i got GC (physical) a 10 year IR 1 GC was sent

    It's' a CR1 visa but I came after our second anniversary. So even if it's a CR1 visa, since I came after 2 years, I am supposed to have the IR1 status, regardless of the visa category.

    Thanks a lot! That's a bit easing. I spent too much time dealing with the paperwork and I was expecting to have a good break after receiving the IR1 GC.

  15. Hello all, 

    I have been married for more than two years and at the POE my passport was stamped with CR1 instead of IR1. At the USCIS website, it says CARD IS BEING PRODUCED. What type of green card will I recieve? the 2 years or the 10 years gc?

    I called the customer service representative and she said I'll probably get the CR1 since that's what the officer stamped my passport with. Does any of you know if that's true? For me the idea of my gc being messed up because of a mistake an officer made doesn't sound right. Aren't they supposed to look at the huge envelope I gave them in order to determine what GC type I am eligible for? How long does it take to correct the gc I have by filing I-90 till I finally have the correct one?

    I called the uscis and they said my greem card hasn't been produced yet so there's a chance we can avoid the problem. He told me he will notify the uscis and that they will follow up with me. 

    Tonight when I checked the status online, at the bottom of the screen it said: 

     
    As of October 23, 2017, your general inquiry, referral number WKD**********TSC, is currently not assigned for processing.

     Can you please tell me what that means?
