Absolutely allowed. Entry is at the discretion of CBP, but a 12 day trip in December is unlikely to be an issue for a VWP traveler.
Thank you have you visited the USA while waiting for your application to be approved?

Hi,
They didn’t ask to see the letter or for any evidence! He simply passed through normally after having his passport scanned. Only question he was asked by a customs officer was the purpose of his visit, to which he said visiting his wife and in-laws.
Hope that helps.
Helps big time thank you so much put my mind at ease 😊

My husband did this a few weeks ago. He had his ESTA renewed, brought a letter from our attorney stating he was not intending to stay and adjust status, and evidence of his return ticket. He wasn’t questioned. Customs and visit went smoothly. Best of luck!
What questions did they ask? And did they even ask for the letter?

Yes, multiple times even. Around 6 times during the CR1 process (and also around 6 times before).
I also managed to renew my Esta while my CR 1 was being processed (my Esta was about to expire), no issues whatsoever. If you have a good track record, you will be fine.
Thank you 😊 this info has been super helpful

That would be good. You could also bring a copy of the NOA 1 (and 2 if you already have it). And remember, answer honestly that you will visit your spouse when they ask etc. 👍🏻
👍 thank you just a quick question have you visited the states while the CR1 was being processed?

Yes, it’s fine. Bring evidence for ties to your home country in case they want to see it to be able to decide that you will not overstay.
It does not matter in which stage you are.
I can bring a letter from work and I have a return ticket il be there for only 12 days for Christmas

So it’s fine for me the alien relative aka spouse to travel to the US while the CR1 is is being processed does it matter at what stage or no?

Just the questions that I've listed above. I've heard that they often ask if you've ever overstayed in the USA before.
i've never overstayed
thank you for your help

Hi! So far I've done it twice during my application process. 4 times in total since we got married. I've had no issues. Make sure you have a return flight booked. If you're really concerned, you can get a letter from your employer stating you have to return to work by a certain date. Know exactly what address you'll be staying at, how many days, and know the previous dates you've visited the United States- also knowing how many days those trips were.
I've never been denied entry, but definitely asked those questions. BE HONEST at the border. Tell them you'll be visiting your spouse.
Hope this helps!thank you for your response im looking to surprise my wife for her birthday and spend christmas with her and her family so il be there for 10 days did they ask alot of questions when you visited after being married?

Yes, it will be enough coming from the UK. Skip the affidavits though, and really go minimal on call logs. Print your photos 9 per page on plain full sheets of paper. Three sheets of 9 is plenty. Concentrate on evidence of time spent together in person.
what should we send in our packet?

Hey Guys we need some advice
so me and my wife got married on the 9th of February 2019 in Long beach and now i am back in the UK and we will start the visa process I-130 (CR1) soon.
Now we want some help
* we have a ton of photos from when we met 2016 to now 2019 (Wedding photos, trips to Rome, Edinburgh, Seville, Los Angeles (Disneyland) and Las Vegas, London and San Francisco) and also pictures with family members and friends
* call records from facetime and whats app
* we can get affidavits from family members from both sides
* flight itineraries with both our names on it for our trips
but what we don't have is
* a joint bank account
* joint tenancy since she lives in the USA and i live in the UK
will this be enough? or would we need more we are bit worried because we saw people talking about joint accounts and joint tenancy for evidence

4 minutes ago, geowrian said:I believe it's supposed to be like within 10 days after moving. The specifics are on the forms/instructions.
As long as it gets done in a reasonable timeframe, I wouldn't worry about. Filing just before you "actually" move isn't going to be an issue, but isn't technically correct.
Thank you

Immigrant files an AR-11 (either via paper or the online Change Of Address form).
Any I-864 sponsor that moves files an I-865.
So if you and your sponsor move together, you would both file change of address forms.
cool so i would do the AR-11 and my wife would do the I-865 do we do this once we are in Chicago or just before
-
2 minutes ago, geowrian said:
No.
Also, any I-864 sponsors need to complete an I-865 to change their address whenever they move.
so when i get there and we decide to move after 5 months we both need to change our address with the uscis or just me

- It should be fine (in context of immigration) and as you well know about it, if they bring it up on your interview, you should be able to address their questions.
- Normally the crime was toward child/underage + sexual related (AWA case) is very close to impossible to get a waive for the petition.
thank you i was getting abit worried
