Yes, they can do "married but filing separately".

I think that if your father in law does not claim dependents, his household size is 1. So to sponsor you, then his household size would go up to 2.

Is your wife presenting her income and claiming herself in that? (I'm assuming she works.)

But you need to figure out the deal with his wife.

Hi! Just want to ask about my situation. I'm filing for my husband and I'm a permanent resident. I'm unemployed so I will ask my stepdad for affidavit of support. When he file tax, me and my 1 yr old son is his dependents. Will that affect on the petition of my husband? Or it doesn't matter? And how do we count household size?

Just want to share what we did recently.

My gf was petitioned as F1 and arrived in the US last Dec 2016. She received her green card on Feb 2017 and returned here in the Philippines this March. We then got married and while she was here, we prepared the Forms I-130 and I-130A.

She returned to US on Apr 1 and filed the petition on Apr 6. She received the Notice of Action (Form I-797C) on April 21, 2017. I now have my priority date.

Hi! We are on the same page here. I also filed for my husband i-130. My PD is August 3,2017. Hope we could share each others info on this journey. :) Btw, are you in California Service Center too?

When was your mom issued the K-1 visa? If it was less than 1 year ago, then your sister can utilize follow-to-join to obtain a K-2 visa. ETA: probably a month or two depending on embassy.

Otherwise, for your sister your USC stepdad can file an I-130. ETA: ~1 year form filing to visa in hand

As for your brother...how old was he when your mom and stepdad got married? If he was under 18, then he can use the same process as your sister. Otherwise, you mom has to file for him. ETA: ~2 years. He shouldn't age out (turn 21) if she files fairly soon.

My mom had the k1 visa june 2014 and my brother was 16 yrs old when they got married. Oh okay. So their petition before will no longer be valid? I thought we can just like reopen it or somehing. Its just my guess. 😅 Thank you so much for your help! :)

  4. Hi! I'm not sure if im at the right page. I wish you could help me.

My step dad petitioned my mom thru k1 fiance visa. Then my step dad included us in the petition too. But I am just the only one who is here at US and my mom. My brother and sister didn't yet go here because they want to finish their school first back in our country. But now they are graduating. So they want to go here too. How will we process their papers? Will we start a new petition?

You need to change your category to F2A in your profile. The highlighted area is your category and what case nvc is processing now. You have about a year wait left before you become current. This what the visa bulletin look like. It comes out around the 10th of every month. About 6 months before you are current nvc contact you about paying fees and submitting more documents. When you are current that is when you get your interview.

Hi! I just wanna ask is the priority date is the day that they received your form? And the dates on the charts are PD?

Don't worry that looks like the zip for your city so don't worry. This happens a lot so don't worry because it might be delayed by a day IF that.

Oh okay. Thank you so much! :)

Google search shows they are both USCIS. The same thing happened when I sent my N400, and they got it all the same.

It's technically possible for USCIS to interview the petitioner for the I-130, but this is a fringe occurrence that I wouldn't worry about in your circumstance. The only interview to expect would be for your spouse at USEM. You are welcome to join him at the interview (it does tend to help show a bona fide marriage), but it's certainly not required to be there. When I was there a few weeks ago, there were many people there with the petitioner and many without the petitioner.

Okay. Thank you so much for your help! I really appreciate it! Made things clear. :)

For the visa purpose is better if you did file taxes. People on VJ have had their visa delayed at the consulate stage because they've had had to submit back taxes. You can file the old tax return.

But also remember that if you get interest from savings or you have property, you need to report that.

You should check on VJ if there are threads about taxes because I'm not sure how you have to file, if married and filing separate, or what, since he is not in the US with you.

Oh really? Okay i will look on that! Thank you so much for your help coco8! :)

Oh! OK. Yes, that works. I'm guessing your dad is a permanent resident or a US citizen.

Just make sure to be back well in advance of his interview because consuls don't like when the PLR spouse is living in the other country. Also, keep ties to the US in the sort of thing I mentioned above.

Also, your kid can travel with you to the US. He doesn't have to stay in the other country. I think you need to do some quick paperwork in the consulate. I'm not 100% certain what that is.

Yes he is a US Citizen. :) sorry for the confusion. Oh really? I'll take a note on that one! Thank you so much for your help! Really appreciate it a lot! I have one more question. I know the is out of the topic but im still kinda new about filing taxes and stuff. I didn't totally work on the year 2016. Didn't received any unemployment benefits etc. Should i also file tax?

Is your husband legally in the US and you will file an I-485 for him once the I-130 is approved and the PD is current? If so (and he still has legal status at the time), then you will have an interview with USCIS. Otherwise, he will need to interview abroad for the immigrant visa.

    Page 1, Note #1 of the I-130 instructions (https://www.uscis.gov/sites/default/files/files/form/i-130instr.pdf):

If you are filing for your spouse, he or she must complete and sign Form I-130A, Supplemental Information for
Spouse Beneficiary. If your spouse is overseas, Form I-130A must still be completed, but your spouse does not have
to sign Form I-130A. Form I-130A must be submitted with Form I-130.

Please - read the instructions in full.

He is not here in the US. Oh okay. If that is the case I will be no longer be interviewed? Just my husband back in the Philippines?

It doesn't matter who provides them...just as long as they are in the I-130 packet when it's sent to USCIS. She should also provide additional evidence when she does the interview.

Hi! I just want to ask. Cause I also filed my petition for my husband. I am a permanent resident. Are we having also an interview to uscis as well here in US?

  13. 14 minutes ago, Coco8 said:

The petitions are for reunification so be careful. At least make sure to be back well in advanced to his interview to establish strong ties to the US (at least 6 months). Also, if you don't have a financial sponsor, you would need to think what you will do about that, unless you have a job waiting by the time you are back before his interview.

PS: File taxes as if you were in the US the whole time and keep things behind, like bank accounts, lease, storage locker, something.

Thank you so much for your info! I just want to file re-entry permit also because i still have a 10 month old son. He is with my husband right now. Yes i already have my affidavit of support ready. I didn't work in a while though. My last employment date was december 2015. But i still have those bank accounts etc.
