Please forgive me if this has already been asked but I need some clarification and I am not finding an answer. I a
m getting ready to file for AOS for my wife who came in on a K1 visa, and want o get it done before the new fees on 7/30/2007. Do I need to file an I-864 or an I-134 again with the 485 paperwork. I was under the impression that USCIS already had the I-134 submitted during the K1 visa interview.

Per the Consulate website for Brasilia, religious ceremeonies are not legaly binding in Brasil so I am pretty sure I am in the clear on that one, but I will advise my fiance not to mention it unles aked about it. Thanks for the reply.

My fiance will have her interview in Rio in a couple of days and I have a couple of last minute questions and or concerns. We had a non legal wedding ceremony in Brasil 2 weeks ago, should she mention it and take proof (photos etc.) or just keep quiet about it. Also I have a list of the order to present the documents for the interview but I am curios as to how they should be presented. (stapled, clipped, etc). I hole punched the I129F paperwork and used folders fasteners and tabs, just wondering if it would be advisable to do the same for the interview paperwork.

NVC sent my case to the consulate on 3-12-2007. The consulate has a record of it on the computer. They can look up the case number, but they have not received the paparwork.. When I asked the rep she said it takes up to 4 weeks to receive. I am confused. Supposedly DHL delivers the package in 3-5 days. Am I missing something here or is my paperwork considered to have arrived at the consulate once they have the case number in their system. I also see that others who got their case sent to Rio at the same time have updated their timelines to indicate the embassy has recieved the case.AM I going about this the right way or is there something specific I need to ask the consulate.

You have to call or email the Consulate to know when your information has arrived AND has been entered into the system at the Consulate. DHL delivers in 3-5 days. But Consulate staff needs "time" to enter your info into their system. Until it's entered into their system, they do not have your package.
Hey, they are Government workers. They cannot go fast! It's the Law.
Thanks for clarifying that for me, it is appreciated. May I ask you something else, being that you have already endured the process of acquiring the visa.
It states on the consulate info link on this site that you can expedite your interview date by sending the forms from packet 3 ahead of time if you can download them and have them ready. My fiancee already has forms DS-230 part1, DS-2001 and her photos as weel as a copy of her passport, and all our other paperwork is ready as well, we are just waiting on packet 3. Have you heard of anyone sending it ahead ahead of time and is there anything else that packet 3 requires you to send to schedule the interview?

I know I need to send in a second letter affirming me and my fiancees desire to marry after the NOA2. Does it get sent in with the package 3 forms or do we hold onto it for the interview.

Thanks for the info. I had been listening just to the automated message. I got a hold of a live rep and the case has already been sent to the embassy. Wheew! What a relief, I was starting to really worry it would take a lot longer. Thanks to all who replied.

It has been exxactly 2 weeks since I received the NOA2 from the CSC and I still get a have record of this case or has not been received message from NVC, should I follow up with CSC to make sure it has been sent or should I just be patient? How long does this take. I see other filers getting confirmation from NVC in less time.

I've received a letter stating that my I-129f has been forwarded on to the US Embassy in Seoul. It's been 1 month since then and my fiance still has not received her packet 3.
What should I do to get more info on this? Should I call the embassy? Any info would be great.
I would call NVC first at 1-603-334-0700 and verify that they have received and forwarded the case to the embassy. If they have then I would contact the embassy

Your case will be forwarded to Brazil after the NVC reviews it.

K-1 filers are at NVC for a very short time, we are sort of stuck in limbo between non-immigrant and immigrant visa's. We have to give proof for relationship with the I-129F, but we don't have to fulfull all that is required for full immigration...yet. That is why we don't file those things at NVC.
The embassy in Brazil will require a I-134 or something similar (some variation from one Embassy to the next) for evidence of support, but the I-864 won't have to be submittted until after you two are in the states, married and filing for AOS (Adjustment of Status).
You will not need to 'do' anything while at NVC except wait. I have only heard of one case where additionnal information was needed at NVC and it was just that one location...can't even remember which one.

I am a little bit confused and need some clarification please. I have received my NOA2 and am waiting for NVC to recieve. Am i going to have to file a I-864 and DS-3032 with NVC or will my case be automatically forwarded to the consulate in Brasil once NVC receives it. I am applying for a K-1 for my fiance.

You cannot schedule the interview yourself for the K's visa. They'll contact you for that. However, you can always contact them to see if they rec'd your approved petition and ask if they have given you an interview date already... Good luck!

In the embassy reviews section for Rio De Janeiro Brasil it states that you can save time once you have your NVC case number by simply downloading the forms for packet 3 and mailing them to the consulate instead of wating for them to send them to get the interview date. Has anybody actualky done this and what where the results?

interview translator
in Adjustment of Status (Green Card) from K1 and K3 Family Based Visas

Hi all,
My wife had her interview scheduled for 10/20/2007 and we were very surprised when the interviewer requested a translator. I went to the interview thinking I would be able to serve as her translator. To my surprise I was told I could not. It does not state so anywhere in the paperwork. Anyway to make a long story short. The interview will be rescheduked so that we may bring a translator. All I was told is that it could not be a family member. Is anyone aware of any other restrictions for the translator ie, age or certification.
