    No, I got the approval instantly and received my visa in 2 days.

    Job offer is not required but the interviewer asked me if I had any job offers. I did not have formal job offers either but I had three possible offers. I took all the communications I had with them during interview. I printed all the details of skype/phone interviews I had with them. They are likely to offer me after I get my visa and they did too. I explained all the possible offers to the interviewer and let him know that the companies are willing to hire me after I get a visa. 

     

    Please apply many jobs as possible and print all the email communications you have with the prospective employer. Let the interviewer know your job application, and potential jobs.

    From what I can see, you did inform properly DHS, when you included your husband in your DS-260. In the Direct Filing page I noticed you should have sent it to the Dallas or Phoenix Lockbox, depending what state you live in, I assume you did that. 

     

    In my opinion, if you filed properly, included every necessary piece of evidence of marriage, DS-260, and his status as derivative applicant, with a detailed Cover Letter explaining your relationship, that it existed before you were a Permanent Resident and under which benefit he would be filing for his I-485.

     

    If you need to, you could get an infopass to try to explain in person to someone at USCIS.

    Many thanks for your help. We included our marriage certificate, his status but not DS-260 and explanation in the cover letter. Do we mean the DS-260 that I submitted for my immigrant visa application? 

  4. I filed i-140 based on EB-NIW in April 2017 from the UK when I was single. I got married before my petition got approved. My husband lives in the US since last few years (never out of status). I did consular processing in the UK and came to the US last month as a permanent resident. Since my green card was approved after we got married, my husband is eligible to do adjustment of status as a derivative based on my approved i-140. We sent the application package with all the documents to USCIS and it was returned stating that either the applicants is ineligible or could not be located in the system. 

    Has anybody been through such situation? I didn't update my marital status to USCIS after we got married but I have mentioned my marital status and details of my husband in form DS260 when I was doing consular processing. 

    Any help on this would be greatly appreciable.

  5. A friend of mine went to the US using advance parole on June 5, 2017. The class of admission is written as "DA" and Admit Until Date is "June 6, 2017". It is just a day after my arrival. I assume CBP has mistakenly written this day (a duration of one day). She has a TPS and EAD valid until June 2018 and advance parole valid until June 2018. She is now adjusting status and what should she write in section 23.b of form I-485, Expiration of Authorised stay shown on I-94? Can she write my TPS expiration date? Has the port officer mistakenly write that date? Should she contact CBP to correct the I-94 date before filing I-485?

Is on the list of documents needed for the interview  (just like the police clearance and medical examination),  and needs to be within a month of the interview. I would call the employer and do everything I could to get one.  Read all the previous posts on this page of the forum and read other members experience,  they all needed the job offer, and most of the interview questions focus on verifying the relationship with the employer , your job duties and qualifications for the job.

    Yes, job offers are required for EB2 and EB3 but not for EB2-NIW and EB1-A category. EB2-NIW is the national interest waiver category which waives the requirements of job offer and therefore the labour certification. Self petition is allowed for both EB2-NIW and EB1-A category.

    Thank you! They asked me what I would do in the states. While answering that question, I talked about few possible offers I have from the US employers and their willingness to hire me after I receive my visa. I pointed out the possible company and the office location I am interested in too and the work I would do there.  I had an email correspondence with all the interested employers but the officer didn't ask for it.

    APPROVED!!

     

    I had my interview this morning at US Embassy, London (the new embassy). I was asked to wait in front of windows 20-21 in the immigrant visa counselor section. I was called 5 minutes later at window 20. An officer had my I-140 package and the supporting documents I sent to NVC on his desk. He asked for my passport, photographs and checklist in the beginning. Later, he asked my birth certificate and police certificates. He verified all these documents with the NVC packages, gave me an X-ray CD and took my finger prints. After then he asked me to wait until my token is called again. He forwarded all the packages and documents to another officer at Window 21 and I was called 10 minutes later. The officer was a nice guy and he asked me to take an oath. 

     

    The interview lasted for about 5 minutes and it was the most easy and simple interview ever had. These are the questions he asked:

     

    1. Have you been to the US before? Since I had a J1 visa and a B1/B2 visa, he said that all US visa will be cancelled.

    2. What was the purpose of your earlier J1 visa?

    3. What will you do in the US?

    4. You have a recommendation letters from UCLA and UC Berkeley, that seems impressive.

    5. What is highest academic degree?

    6. You have a strong record of publications, almost all of them are focused on earthquake. You should go to California. We really need a specialized person like you.

    7. That's it. We will keep you passport to stamp a visa and original police certificates. You will get your visa in 2-3 weeks.

    As for the job offers or potential interest by clients, whatever you have, bring it.

     

    I even brought some email correspondence of a hiring process I was in. It was not needed and ultimately I didn't get the job after my approval, but the officer liked me talking about the potential position, what I would do there in my field of endeavor. I also mentioned some more loose job offers and potential clients. I just presented myself confident mentioning some of those and that I will certainly make my way in the US and where to look for work.

     

    @Richard: You are going to see that new London embassy. :D

     

    Thank you for this :) I was thinking to call US embassy to confirm the interview location as there is an old address in the interview appointment letter. :D just to be 100% confirmed!

  10. Has anyone travelled to the US when your case is at NVC or when you are waiting for interview at the US Embassy? My interview is scheduled for the end of Jan and I am planning to travel to the US during Christmas on my B1/B2 visa.

    I believe I can if I prove to the immigration officer that I do not intend to stay there and I intend to return back.

    If anybody has been through this, please share your experience.

    Thank you for the update. No other way than having patience. :) I hope they schedule by the first week of the month for the next month.

    I called NVC today and got to know that they have started scheduling for January and it all depends on how busy the embassy is. The embassy in London must be super busy. Nothing update on my case.

    That's actually complicated. EB-NIW does not require too but it's better to have before interview..I have few possible offers who are willing to hire after I get my visa.

    Thank you Richard. I also got similar email from NVC. Lets wait for the final email on interview date. Do you have job offer? I know it is not mandatory for EB-1 but I am trying to gain some confidence since I don't have any job offer yet :)

    I don't have job offer but have some possible offers. I believe EB-NIW does not require job offer but it is always better to have? Are you also in EB-NIW?
