Sent mine in yesterday. My lawyer requested expedite processing. We'll see how it goes, part of me wants it to go fast, part of me is ok with taking longer since I am so nervous to leave. Is on God's hands.

He entered illegally. No documents. He came to the USA in October of 2010..And as far as working, yes he just worked for himself doing landscaping jobs where he could. I know it's bad that he was working but there is no way around explaining how he survived on his own when he got here.
Almost everyone who overstays their visa or enters without inspection works without authorization, that's why people come here (majority of times ). He can't be denied because of that. When he crossed without inspection did he use the passport of a US Citizen? If I were you I would try to find exactly why was the reason for denial ( assuming is something more than proof of relationship).

Tomorrow my waiver packet is being sent in. I am doing an I 601a with my father being the qualifying relative, and my lawyer is requesting expedite processing. I am so nervous.... Best wishes to all of you who are going through this process.

4.25/h that's insane. I worked as a nanny 10 years ago and made 15/h . I don't think you'll get anything from the lawsuit, get married, get your GC and move on with a better job. I get so irritated when people take advantage of other people.

Illegal work does not make him inadmissible. Does he have a criminal record? Tattoos? Drugs? Did he pass his medical? Use papers of USC ? Any DUIs? Anything else that could make him inadmissible? Did the CO say that he needs another waiver?

The lawyer will file my waiver next week. We will also ask for an expedite. Hope it goes well.

Just payed ours this past Friday, it says it takes up to a week for the payment to process. It says "in process" on ours too. Watch the bank account, I assume it will clear by Tuesday morning.

Payed the visa fees today, as soon as our psychological evaluation comes back, we will file the waiver. I'm so nervous!

Our case has finally made it to NVC. Payed the visa fees today, and we are filing my waiver next week. I'm so excited and nervous at the same time.I can't believe that after all these years, after many sleepless nights and many tears we can finally see the light. I pray for an approval on my waiver and a smooth process from here on.

Good for them, it's a choice that they get to do. There are also many immigrants who want to come here. Why ask for a visa if you don't want to be here, and think is not a good place to live? There are Americans who were unhappy with Obama, and there are Americans who are unhappy with Trump, I don't see how that is relevant to our conversation. My point is that you are asking them for a visa, regardless of what kind, they issue the visa, and they get to say no if they want. It might not be what we want, but as long as we are the ones asking and they are the ones issuing having a confrontational attitude is not gonna do you any favors. I honestly think you have compromised your case, let's hope I'm wrong. Wish you the best!

Also, "privilege" is a per-law term, not a privilege in per-real life. Meaning, that you cannot legally force them to do anything, and they have the right to make all the decisions. So I think you misunderstand what privilege means.
I don't have an attitude, they made mistakes and I was just responding to their insults. So get your facts straight.
Also, confrontation is the best strategy, especially if you have nothing to lose. After long periods of waiting most of us would rather have a closure regardless of the outcome.
Yes it is a privilege. Is their country, not ours! Can you force them to issue a visa? No you can't! So they ARE doing us all a favor. I have a very good understanding of the words I use btw. No need to come after me, but honestly your attitude right now is not good, If you don't want to come for a better life, then why bother?

I sent an email a few days ago noting that I want the case withdrawn within a specific period of time, if there was no visa issued by then.
Background story:
First, they didn't bother to look at the first email and realize that I'm a male. And called me a "madam". So I responded back with an insult, noting the issue.
Second, they responded back with a very very lame excuse and a lie basically, saying they "thought" it was the petitioner emailing them from someone's email. Which is another kind of insult.
Finally, I insulted them back, again, in another email citing their lies. I also included an ultimatum denoting either an issue of a visa or withdrawal of the visa.
Guess what? I got no responses for neither (no visa, or withdrawal confirmation), and they probably ignored or deleted the email.
The ridiculousness and unprofessionalism in that embassy is completely unfathomable and overboard. Makes me wanna punch them in the face.
I am sorry, but USA is doing us all a favor to come to their country in order to have a better life, and this is not the right attitude. Moving to USA is a privilege, not a right. I understand your frustration but confrontation is not the way to go when you pretty much are asking them for a favor. I hope it doesn't backfire, but in my opinion I think you really compromised your case.

He needs police clearance from all the countries he lived for more than six months over the age of 16. Depends how the crime is classified.

I would do a FOIA request to see what exactly is in his file. Did he get a deportation order? Did he have unlawful presence? Probably he is facing misrepresentation too. The unlawful presence wouldn't affect him anymore since it's been over 10 years ago, right?

How long does it take to transfer a case from USCIS to NVC? Our I824 was approved on July 24, called NVC yesterday and they still haven't received our file. Priority date current (April 2009). It's an EB3 immigrant visa case.

We are in a similar situation, have an I140 approved, husband with F1 with d/s on I94. He can not adjust here, because of unauthorized employment, however can do consular processing because he doesn't have unlawful presence. We saw 4 top attorneys and all said the same thing. As long as an immigration judge or immigration officer hasn't terminate status you do not acquire unlawful presence, so you are not subject to the bar. We also filed a FOIA request in order to get his file, and make sure there are no other ineligibilities, and to make sure his status wasn't terminated.

My situation is causing him stress and anxiety ( especially with the current increase in deportations) ,and is causing his heart to go into atrial tachycardia, to the point he can not get out of bed. We are having a psychological evaluation done next week (stress and anxiety part), and the cardiologist is putting this into his letter as well .

My reason for expedite was my unemployment was ending. I needed him here to help pay the bills. My lawyer told me it would never get approved...we filed they waiver late August 2014 and the expedite was approved October 2014 ( if my memory serves me) it's in my timeline I believe.
Thanks for the input. I am trying to get all my documents together to get the waiver ready. I guess is worth trying, My father has heart failure, atrial fibrillation, diabetes and many other health issues ( 20 conditions overall) and I am with him in a doctor's office every week almost. I am a RN and with the upcoming surgery the lawyer said that he will argue that it is important for me to be here in time for the surgery and the recovery part, so he will ask for expedite processing. If it goes through it goes through, if it doesn't it doesn't. I sometimes feel like I am close to loosing my mind. this is such an overwhelming situation, I just can't wait for this process to end.

I understand how frustrating and disappointed you must feel, but it sounds to me that your visa was not denied, it was just postponed. Do you have phone records, chat logs, birth certificate for your son, plane tickets, emails etc. that can further prove your relationship? If they ask for the divorce certificate, just bring it again.... Once you submit the required documentation most likely they will issue the visa. You are almost there!
