  1. Mine was sent in in September 2017, got the receipt with a notice date of Sep  25th, 2017. Waiting now for the biometrics.Did you do your biometrics?  I really don't think the processing times are accurate, and that the officer's discretion plays a role in how fast some applications are processed. When we filed the I824 it showed a six months processing, and it was approved in 30 days. I'm on a fb  group for I601a applicants and most of the people who have applied in May have been approved.

That post was confusing... how could that person have gotten the labor certification and passed the USCIS application process without the required minimum experience?

Yup, that's what I was thinking too. When my husband's company filed the I140, under perm the requirements for the  job were high school diploma and current driver license, so USCIS issued a RFE asking for these documents and the employer's taxes. Once the documents were submitted the I 140 was approved.

Im under skilled but my lawyer said as long as I have a bachelors degree, the exp is not required as she had processed nurses for eb3 before even without experience but were still able to get the visa. I guess this depends on the interviewer at the embassy?

That's good. I am not a lawyer, so go with what he/she says.  Each case is different, and I;m sure your lawyer knows what she is doing. Tell the truth and be honest, that goes a long way. Best of luck! Let us know how it goes. When is your interview?

    HI there,

Thank you for listing the possible questions during the interview. Will it affect the approval of my eb3 visa if I have less than a year of experience as a nurse?

I don't know, it depends on the job requirements.  Was experience a requirement for the job, or no experience required?

    Helo ,

Can someone please tell me what are the possibilities of rejection of visa eb3 during the interview ? ( ofcourse if i dont have criminal records and all those things...)

And also what kind of questions should i expect ?

    Thanks

From what I'm reading you have to know rally well the info you put on the DS260.

    Who is sponsoring you?

How have you found this job?

What duties you will perform at this job?

    What experience do you have?

Where is the job located ?

    Are you married?

Have you  been to the USA before?

This is just what I have seen on other forums and what our lawyer told us. Best wishes, and let us know how it goes.

helo. i am an rn with eb3 visa appointment in few weeks. i have good sponsor and job offer is ready. all is in order except one thing. i dont have an rn license from my home country. i only have us rn license. from new york where im gona hopefully work .do you think embassy would deny me if they found out ? thanks

No,  very unlikely. I would bring maybe just proof that you graduated from nursing school. Having a US license and passing the NCLEX  is what matters. I'm an RN too btw :)

Just a update I called on the 15th day expedite was approved and no case status changes or notifications sent. So she told me now they will work on my waiver and to expect an answer for that in 60 to 90 days. Also I requested I be sent a approval notification on expedite, she said that would take 2 weeks. Please share your experiences!

That's awesome!  the check just cleared my account today, so I am still waiting for the receipt notice.

    Hi there,

I think you can check on the embassy's website. I know that's how it is for Bucharest. Best of luck, let us kn ow how it goes!

  9. My husband's   FOIA  has been processed  and we got the CD today, and I was so frustrated to see that only the file from the Nebraska office was sent back after our request, even though we requested the "entire content of his file" and his request was placed in track 2.  The info we got back was only regarding his I140, which was information we knew. We wanted to see his whole file to make sure his F1 status was never terminated, and that he didn't acquire unlawful presence., and that there are no  "surprises" before we leave the country.  All this information is apparently at WSC. Our lawyer will get back to us hopefully tomorrow to see what we can do next. We waited 5 months to get his file, and this is so disappointing. While looking on the CD we also noticed that he has 2 alien numbers, how's that possible? At the NSC he is with one alien number, and at WSC he has a different alien number. Hopefully we can figure it out soon.
