    Thanks! I've filed last December, got an RFE at the end of April and EAD/AP in mid-June. The interview request was dated 07/25, I think. So, about 8 months total.

    I honestly wasn't counting to get anything until late fall for some reason, and then was super surprised to hear some of our original March filers were already through the interview and had green cards in hand!

    Our local office is in CA, which seems to be behind some others. So, hopefully, you get something really soon too!

    Well, each state differs. I was asked questions only from application form i485 and to provide everything we can to confirm our relationship. 

    We brought everything we could - bills, mutual tax returns, honeymoon trip confirmation, wedding dress receipt, new pictures, even invitation to the wedding. :)

    It was quick and simple, but we didn't get an answer or at least understanding of the positive result in the end. The officer just told that she will review all cases in the end of the day and send her decision by mail. 

    USCIS web-site was helpful as they post an updates of our case, so I new the result much earlier then received letter via mail. 

    In most states people get their reply in a week time.

    I'm a bit worried because we don't have any mutual bills/tax returns yet. My husband wasn't required to file tax returns last year as he's not working (we have a co-sponsor) but we do have plenty of photos together and with other people, as well as some mail addressed to us at the same address to prove we live together. Hopefully that would be enough!

    As far as the i485 questions - what kind of questions were they? Like just to confirm your biographical info like name, SSN, etc? 

    Did they ask your husband any questions at all?

    I'm not sure about Texas rules, but in California we have an assembly bill 60 that is suited for situations like ours. Basically, here you can apply for a driver's license without having to submit proof of residency. There's a list of docs they still need from you, but it was something like a passport and a US-issued document (which is what your SSN and marriage certificate are).

    So, look up if your state has anything like that. Also, keep in mind that the people at the DMV might not even know this themselves, which is terrible. They were refusing to issue me a license, so I literally had to print out the AB statement from their own website, bring it in and tell them they're wrong. 

    My EAD took almost 6 months, but that is also because I had an RFE. Hope you get yours soon!

    Your review mentions there were only formal questions from the form? Were you and your husband interviewed together at the same time?

    THANK YOU for checking with her though! It's been almost 6 months for me since filing for EAD, so hopefully that means I'll get it soon too.

    The USCIS told her? I asked them and they told me RFE for AOS puts your EAD and AP on hold, but they didn't tell me it sets you back all the way to when you started. Considering it took them 5 months to open my application, that would be my nightmare!

    Where did you find out that it can re-start your timeline?

    I filed my AOS/EAD/AP in December and got RFA in April. It's been 2.5 weeks since they've received my response, but I haven't heard anything back yet.

    Notice day - April 29th, sent by mail on May 2nd.

    No reply on EAD or AP.

    I am a little worried as we didnt submit 3 years of taxes we only submitted 1..but there was a part that asked for 3 years of #s and I assumed since we were only submitting 1 year we didnt have to write out 3 yrs of taxes but who knows.

    My status never changed to "ready to schedule interview". It went from "We received your application on Dec. 1" to "We've sent you an RFE"

    I just read the sponsor form instructions again today, and it said you only need to submit the most recent one. But if you think submitting the last 3 years worth of tax returns would help your case, you can submit 3 years worth.

    After all I think we actually goofed on my initial AOS application, so it wasn't considered a complete copy of tax returns. So y'all should be okay if you did everything they asked for! 

    I don't think they'd be that brutal to ask for newer returns just because they didn't open our application envelopes until now lol Sorry for making you guys a bit worried. 

  11. Has anyone else received an RFE for AOS application?

    I've received a request for tax returns...I've sent the 2016 ones with my application that I filed on Dec 1 (so, the 2017 weren't available yet). Wondering if they lost the 2016, or just want 2017 anyway (which I don't understand why they couldn't work with last year's at that point)...

    I also called them today and it said my estimated waiting time was 2250 minutes...LOL

    I applied for my ap only 9 days ago I'm really wondering if it will come on my EAD card. Should be interesting to see! If so maybe that helped push it through. I'll keep everyone posted ! 

     

    I'm happy to see that approvals have been coming through lately closer to the 4 months mark !

    Did anyone have any issues with their driver's license? Was at the DPS just now to register for the application of a driver's license since I got a car recently. The driver's license from my country is only valid up till 90 days after entry.

    Anyway, the staff pointed out that my I-94 is only valid till 04/22, which is next month. I told her that my I-148 & I-765 are pending still. She said something like I would have to come back and renew it again once immigration update my status. I didn't have a chance to ask more as I was ushered to the next station. 

     

    The question here is will my license be valid up till 04/22? There is nothing else to do whilst waiting for the reply from USCIS right?

    Great! My appointment is on the 28th. Received the letter a few days ago.

    In CA they gave me a paper temp one that's valid for 3 months. They told me I'll receive a card one in the mail in 3-6 months (which I'm not sure what the expiration on that one would be) once it's "cleared by legal" (something they told me over the phone). 

    I had an issue with the DMV at first too, as I guess they've never dealt with anyone whose green card was pending. I showed them my AOS NOA1 too, and finally after I've asked them to find someone who knows the process in the office, they went ahead and processed my request.

    I think at this point the best bet is to wait until you get your EAD, they seem to do better when you have documents that have an expiration date on them (unlike NOA1s).

    I-693, Medical Examination of Aliens Seeking Adjustment of Status.I-693, Medical Examination of Aliens Seeking Adjustment of Status. If you are a K-1, K-2, K-3 or K-4 visa holder the I-693 instructions state that you are not required to have another medical examination as long as your Form I-485 is filed within one year of your overseas medical examination. If you are missing any shots from your overseas medical a I-693 vaccination transcription is required to be completed by seeing a Civil Surgeon to have certain portions of the I-693 completed and have the Civil Surgeon certify the form (sealing the original in an envelope and giving you a copy).

     

     

     

    You don't need the form to be filled out again if your visa medical was within a year, I believe, from the AOS filing date. So he shouldn't need to see the doctor again, if he did it for his fiancé visa interview already. I don't know how India does this, but the embassy in my home country sent me a sealed envelope with my medical and other documents after my interview, which I had to hand to the customs at the airport when I entered the US. And I believe they sent those docs straight to USCIS on my behalf.

    The vaccination form was also supposed to be filled at the fiance visa medical, so unless he's missing anything, he shouldn't have to do it again?

    Long time no see! But I'm happy it's all for the good reasons, I hope everyone is doing well and life is so much better next to your sweethearts :)

     

    Has anyone had any developments with AOS (or more like EAD?) The 87 page thread is overwhelming, so I hope y'all forgive me for asking without reading LOL

    I didn't prepare a letter for co-sponsorship. I just had my uncle (co-sponsor) fill out the I-134 Affidavit of Support and attached his supporting documents. I also filled out an I-134 and attached whatever I could attach with it as supporting documents, because I know the petitioner is supposed to fill one out as well. 

    I'm sorry for this delay. Hopefully this is useful to other people. I think just as long as you do that, you're good. My uncle gave me a letter of employment, his W2 for last year, two pay stubs from his most recent check, his bank statements, and his last 3 years of IRS transcripts. I know I went overboard, but I wanted to be safe with having a co-sponsor.

    Do you and your uncle have the same last name? Neither my fiancé or I are related to our co-sponsor, that's why I was wondering if they're going to question what's the co-sponsor's motive to sponsor some random person :)
