    Read your post and thought of my own situation. Not sure if it'll be relevant (different countries) or help you in any way but I'm hoping it might.

     

    We were married in South Africa. We submitted the I-130 with a hand written marriage certificate (not processed from the SA Home Affairs) and we were fine. Our names were correct but my line of thought is that we submitted the I-130 with a different marriage certificate, which made me think you could use your Acta de Matrimonio or Libro de Familia as proof of marriage? (Are these correct at least??) Also, when my interview came around, I had the correct processed marriage certificate in hand. It took me 9 months to get!! So if you are willing and able to wait 3/4 months for your corrected marriage certificate, then perhaps do that. This is also if you and your spouse can prove enough income to meet the new public charge  inadmissibility rules.

     

    Just my thoughts, hope it gives you some guidance.

    I landed Dec 2017, received my green card in just under 4 weeks. I also noted on my DS260 to have the SS number issued upon my arrival, but it never happened. We went to the SS office and they had me on record and issued me the SS number, no problems. The SS card arrived in the mail after 10 days. I would advise to go to your SS office upon landing and apply for the SS number.

     

    I did not need my SS number for my drivers license: I went for my drivers license (before receiving my SS or green card) and the drivers license office issued me a drivers license that was valid according to the wording on the visa. When you get your visa, it'll state "upon endorsement serves as temporary I-551 evidencing permanent residence for a year". This meant my drivers license was only valid for a year and I had to go Dec 2018 and have my drivers renewed. I realise this will cost a bit more but you can get your drivers license without the SS number.

    I've noticed exactly the same! Id like to know too. Our AOS fee has been paid Friday, so I give it till Wednesday to show "paid".

     

    I have asked hubby to see if he can log on and pay the IV fee - he'll try later today. I was thinking maybe it's because my IP address is outside the US. Lol. 

     

    I'm sure one may pay both fees right after each other? Or will the system wait till the AOS fee is "PAID" then open the payment circle for the IV fee?

     

    Any suggestions anyone / info?

    Just saw your question.

     

    Perhaps ask your wife if she wants the father to be named? Maybe she did not add his name for a reason. Maybe there is another type of birth certificate she needs to get which shows both parents' names? All depends on her situation.

     

    My son has no father named on his birth certificate either but it was my choice. 

     

    I am not sure of the laws in Vietnam either.  

     

    Hope you find some good info - these are just suggestions from my side.

    I'd suggest to phone again and see if you speak to a different person - sometimes they're sticklers at helping out. My husband recorded his conversation and didn't even ask for the case numbers. They lady on the phone was nice enough to ask him if he wanted them. You can just try phone again and ask very nicely if they can check if your case number has been assigned.

    Has anyone been expedited by NVC and had their case processed at their respective embassy? I have 2 questions.

     

    1. I am unsure of payment for the AOS fee - I've noticed NVC states, on their fee schedule, the AOS fee is not required "if reviewed domestically". Does this mean domestically in the US (i.e. at NVC) or one's home country? Am I understanding this that if your case is expedited, then no AOS fee would be due?

     

    2. If your case is expedited and sent to your embassy, how long did it take before you were given the interview date?

     

    Any help/ advice would be appreciated.

Besides this letter I haven't received any e-mails nor there have been updates to my case made online on USCIS website (still says case received). 


    How long should I wait till I hear something from NVC? Would NVC contact me or beneficiary for my case? At what point should I call them to request my case number?

    We were approved 21 Sept. My husband phoned NVC in a week or so after this and got our case numbers and Invoice ID's. You should receive an email too if you added it on your G-325 form.  It's been a week so your case numbers could be available. My uscis case also showed "sent to nvc".

     

    I'd suggest you phone the NVC and find out.

    My dear sweet husband writes me this morning.

     

    "Our case is updated!"

     

    Nothing more. 

     

    My response - When, How, What? Is it approved? LOL

     

    I saw the email too from USCIS. All it says is "Your Case Status = Post Decision Activity" and that our case has been sent to the Department of State for Visa Processing.

     

    Happy happy!!!! Waited very long for this!

     

    I would like to know - why do they say Post Decision Activity? I did not get an approval notice with an NOA2 date, only this. So I'll use this date as my NOA2 date. Correct??

     

    Hoping all other Dec 2016 filers do get approved soon!!

    This is incredible information. So we have the forms for the amendment and we will make copies of those and the original single transcripts. We will put both in our package to NVC along with a cover letter explaining that we will have the amended versions processed by the time of the interview!!! 

     

    Reading a lot of people's stories on it, it seems like people get the amendments around 8 weeks which is the same time as CC! So I feel a huge weight lifted off my shoulders knowing we can continue with our NVC process as usual!! 

     

    Oh my gosh this process is such a huge test! 

     

    Lets all have a huge party when we become immigration lawyers after all this :P Ahahaha !! 

     

    But honestly - thank you again from the bottom of my heart! <3

    No worries! We're all in the same situation. Kinda have to stick together! Only a pleasure.

    We have decided to keep positive. Take a day today to relax and gather ourselves.

     

    we have discussed a few possible ways that we can possibly help this situation.

     

    1) any way to pay for it to be specially delivered / amended quickly 

     

    2) any way we can write a cover letter and have proof of submitting the amendments declaring that we will have the amended documents by the time of interview 

     

    3) speaking to NVC / IRS about any other options. 

     

    4) just staying positive and loving each other through this process!

    Gonna send the documents later and try calling to ask if there's no speedier way... or simpler way... in this case maybe its easier for us to file other things like really old W-2 or I don't know >_< 

     

    This is so upsetting because we have everything else in our IV AND affidavit of support packs ready to send and JUST paid the IV fee today... meaning when I travel to the US this weekend I was planning to collect his docs to put with mine ready to send... now it might be 3 months before we can send anything !!! so crazy! 

     

     

    Might be an option. The 1040 I submitted with the I-130 was from early last year - we were not married yet.

    Long story short - he spoke to someone on the phone and they provided him with papers that he needs to mail to correct the single to married AND THIS CAN TAKE FROM 6 WEEKS TO 3 MONTHS!!!! omg :( I feel like crying right now....

     

    Has anyone had this situation before?! Is there any way we can pay or request for this to happen faster?!!

     

    Is it really that much of a red flag if he provides his tax transcripts for the past 3 years as single?? we were married 30 dec 2016.. if it has been a few days later this would not be an issue... AHHHHHHHHHHHH!!!!!

    Wouldn't it help to file as NRA? Or go in person to an IRS office and change it on the system? Or obtaining some type of document from the IRS that states changes are not yet made but in process...

     

    I'll let you know what hubby says about this. There has to be an easier & faster way. I'm hoping for those 6 weeks though. :)

     

    (On the tax return, where it asks for the spouse's SSN, you would put 'NRA' for Non-Resident Alien. Continue filling out the rest of the return as normal.) From the earlier post you made? Won't this help?

     

    My husband filed in March this year, we were married Sept 2016. I would also like to know from other members if this might be a red flag at the interview - someone?? I have yet to find anything on a tax return stating single being an issue.

     

    @lanrar1309 I've found since submitting the forms and getting all my paperwork ready, birth & marriage certificates etc., that most of the time things work out in time. Be patient and everything will be fine. But push for what you need! (Yes we can chat off topic too.)

    Yep SA has only 1 time zone but we're on the same time as the UK. But I think there might be an hour difference?

    LOL!!!!!!!!! I agree! Laughed so much right now. I am also 8 hours ahead of my husband. He told me a few days ago I navigated uscis so well and all he did was make things more confusing. :)

     

    So we're on the same time zone - I am in Johannesburg, South Africa.

    Precisely! I am still reading through uscis and nvc even though I have read and read and read again!

    Did you also file IRS transcripts?

     

    And regarding the AOS info above - I think there was some confusion. There is an AOS meaning "affidavit of support" for i-130 CR1 visa applications which is what I meant to refer to! :) 

    No worries- it's all new to me! I'm reading up as I go along, finding my way.

     

    I'm sure if he filed his taxes for the US even from Japan, it'll be accepted. Perhaps have him phone the IRS? I'd think have as much documentation you could find.

     

    We only sent hubby's 1040 tax return with the I-130. Couldn't find the W-2 in time. I'm new to the terms still - what is the IRS Transcripts? Is it the same as the returns?

     

    Ah yes - I refer to the aos (affidavit of support) as being the I-864 form. Less confusing this way. 

     

    Please keep in mind I am not an immigration lawyer and only know what I have read up so far. Do not take my word for it - find out all you can too!
