Once he got it turned in they officially approved him and he picked up his visa on September 6th. :) Hope everything is going well for you!

    Hi,

I am applying for my mother to come to USA as I am an American citizen.

I do not make enough money to "financially support" her.

My wife and I file taxes jointly. My wife makes more than enough to support my mom to come here.

Do I fill out form i-864 and my wife fills out I-864-a?

or do we both fill out I-864 each and my additionally my wife fills out I-864-a?

or can my wife just fill out I-864 and I fill nothing out?

what is the simplest method to prove financial support?

I'm a little confused so I need your help guys!

You fill out I-864 and  my wife fills out I-864-a

My husbands visa got approved!! He said it was a smooth process. The CO asked him about 4-5 questions. Didn't look at any pictures or evidence of relationship. And surprisingly did not even ask for the updated AOS and 2016 W2 that we had received a checklist for. Will post a detailed review shortly.

    Congrats! KaurN

    1. Yes. She just need to show proof of re-establishing domicile in the US.

    2. Your wife will still fill out the I-864 and then your MIL fills out another I-864. Your MIL have a household size of four when you include the intended immigrant. That means she needs a salary of $30,750 to be the joint sponsor or if she wants to supplement her income with assets, she needs five times the difference. So in your case, the MIL need at least $66,250 in assets plus some change for good measure. So yes, sounds like she can but please be aware that assets are not always accepted. She needs to prove that the assets have been in her possession for at least a year.

    thanks.

If her MOM Yearly Salary is more than  $31,000...It should be fine i guess

NO.  It is not correct.  Not only is it not correct, it is actual nonsense.  There are no questions about year to date income on the affidavit.

    Let us take this Scenario:

Petitioner Submitted AOS & All Docs to NVC in Jan 2017 with current Pay stub He last Job in Feb

He Got job in June , Spouse Interview Scheduled this month Last week .What would be the CO decision?

In a visa case there is never an actual RFE regarding an affidavit of support, because RFE is something USCIS does.   It would be interesting to know then, what you actually mean by RFE.  NVC sends what often looks like an RFE but isn't.  They're just saying they can't make the determination and it will be up to the Consular Officer.  In my experience, if the requirements have been met and it's reasonable for the Consular officer to make a positive decision regarding public charge, then they will.

Because this is a public discussion, it is not necessarily appropriate to think responses that quote you are directed, in full at you.  While what you wrote, prompted my response, my response is directed to "the reader(s)" of the thread, for THEIR benefit.  It is not a personal discussion between you and me.

An earlier poster, clearly had no clue about the current income issue.  Whether other "readers" will benefit from my explanation is something we may or may not ever know and it doesn't matter.  Consular Officers receive fairly consistent training on these issues, but policies of evaluation definitely vary with different IV Units, and tend to change somewhat when a new Unit Chief rotates in.

Bottom line is Petitioner Year to date Income should  be above Poverty Line during Interview time ( CO makes the decision ).

    Is it correct @pushbrk

You only use AGI if you are self-employed or if you will file a 1040ez. If you have will file a reg 1040 you will put what you anticipate will be your total income end of 2017, ie what you believe you will put on this year's 1040 line 22 (total income).

I explained this to you already in another thread.

Now , I understood what you are saying and checked my previous year's tax returns. Thanks, Suss&Camm.

It's not your AGI that you need to compare to the requirement. It is the anticipated total income. Your filing status doesn't matter - but why are you filing single? If you are married you should be filing MFJ, MFS or in some special circumstances HOH.

    Poverty Guidelines for I-864

Above  Youtube Video he explained AGI.Now am little worried W2 Income or AGI

Yeah, We have to file MFJ ( Then AGI Would be less).

Employment letter can document that there are no forseable changes in the current employment or salary. Even with paystubs this can be beneficial for a newly established income.

Also it should be the ANTICIPATED income for the year. Which is the current uncome only for an already established job. So no, if you start a new job today paying 50k you would not make 50k this year. There have been MANY rfe's for ppl in that specific situation.

In 7 months I make $29,400..this Amount is not sufficient after filing 2017 taxes as a SINGLE. Adjust Gross Income would be around $24,000 this Amount is below the poverty line for only 3 People...I am correct @Suss&Camm

Are you making a statement or asking a question?  Anyway, no.  Current income has nothing to do with year to date income being over the poverty line by the time it's sent in.  Current income is the gross per pay period times the number of pay periods in a year.

If you lost your job today, your current income is $0.  If you start a new job today making $50k a year, your current income is $50k a year, which can be documented fully with one pay stub showing a full pay period's earnings.  There are no questions about YTD income on the affidavit of support because it's irrelevant.

The reason I mentioned year to date income is to illustrate why only one pay stub is needed.  Decades ago, before computers and pay stubs showing YTD income, is when USCIS recommended multiple pay stubs.  It's a decades out of date recommendation.  In the old days six months of pay stubs would show you had the job for six months or more.  Today, the YTD income on ONE pay stub show how much of the year you've had the job.  If it was January or February, it would be good to send the year end pay stub along with the most current one.

@pushbrk If I  start a new job from June 1,2017 making $50k a year, my current income is $50k a year,                      which can be documented fully with one pay stub $4200. In July i will send All Docs to NVC .

The supervisor from  NVC will Schedule Interview? this type of case.Average, I would get Interview after 5 months ( May be in Dec 2017) . In Interview, I can show All 7 months paystubs from June to Dec 2017.CO accept this ? What are your thoughts ? Thanks for you time and help  Pushbrk.

    Hello ,

I have filed my tax for the last 3 years. but last year (2016) is the only year that I made above 125% poverty line. which is around $ 31000 . In  2015 I made $15000 and 2014 $12000 , both below the requirement.

So, Should I just send in the transcript from last year (2016) alone ? or do I send all 3 years ?

I make about $36000 a year right now and I have an employer letter stating that,    Should I find a co-sponsor or for my case is not necessary ?

Anyway, you will fill 2014,2015 & 2106 tax returns info in Affidavit .Even if you don't have Enough Income for those years its fine.

No need co-sponsor for you.. Current Paystubs shows Year to date Income and Employment letter..
