    I legally entered but they said I shouldn’t have forgotten to give my AP since that means I abandoned my 485.

    For my understanding about your story that USCIS already adjusted your 485 based on vawa approved when you used the pervious 485 and they denied For not respond RFE . let say new you filed New 485 , When you going to send New 485 you need to submit a copy for denial decision which you just got , Let Say they accept your new 485 later on they going to send you other RFE for the same thing and they might denied the new 485 too .

    I think you need first to file waiver before anything then you can file new 485 .

    That's just my opinion , Not sure .

    uscis denied 485 because I can’t get my AP stamp from CBP and CBP is not gonna back date and stamp it. The abandonment was for the old 485. I wonder if I file a new one is it gonna affect it.

    Even tho you are physicaly in the country but in their data base considere that you still out of the country but how come you get in the country and at airport without inspection.

    My visitor visa was valid then so I presented my passport like I usually do and they stamped me with visitoovisa and let me In

    I explained to USCIS that CBP will not stamp it because it was expired document (2016) and I explained it in my declaration. They denied it

     

     

  6. Timeline: 

    • March 2017- mailed VAWA package to VSC
    • April 18, 2017 - receipt notice of I-360 fee waiver received 
    • April 19, 2017 - update on website that request for RFE was mailed.They were requesting Good moral. 
    • April 28, 2017 - sent RFE: Police report, live scan, clearance from all the places within last 3 years before VAWA application & declaration of good moral character
    • May 10, 2017 - Vermont received RFE reply. Update on May 11, 2017 that they will start to continue on my application 
    • August 25- interview on marriage-base I-485 . Requested  i485 to put on hold. 
    • 9/14 - sent EAD request to Vermont & NBC - written with AR11 to NBC and i765 to VermonT
    • 10/16- NOA receipt of EAD
    • 11/15 - update status that work card was mailed 
    • 07/10/2018 - EAD card was mailed to me for approved VAWA  (I never applied for c31) I got c9
    • 07/18/2018 VAWA approvaL
    • 12/13/2018 - green card interview again. I went alone.  
    • 02/06/2019- rfe for i485 delivered. Rfe to stamp the previous AP w/c the CBP didn’t therefore I-485 denial

That is really odd and you need to have an experience lawyer analyze the denial and make sense of it because without the entire letter we will be unable to really tell what your next step should be.

    When I attended the interview they gave me 88 days to go to CBP office and get the parole stamped but CBP didn’t because it was expired document. I explained them my situation and the uscis sent me a denial.

    No I attended the second interview after the VAWA approval. 

    If I apply for a new one I was wondering what will happen to this old i-485? The letter gave me 30 days to leave the country. Do you have an idea?

Why did they say it was abandoned? Did you miss an interview or a correspondence they sent asking for additional info?

    It was abandoned because I forgot to present my AP when I re entered.

    congratulations dear!You are very lucky and that was really quick!

    I don’t have an attorney. It was filed by my ex spouse and it was kept on hold. I messaged Sandra already. Just waiting for her reply

    I already have my EAD C09. I applied for c31 just to be safe because I don’t know the status on I-485 yet and God forbid if it doesn’t get approved my c09 category will be cancelled and I lose the job. Although I’m wondering why I was charged $410 for EAD c31. Isn’t it exempted from the filing fees?
