  1. Can someone point me to information about stipulations, if any, on a marriage-based Green Card. As much as I hate to say it, I think my wife is being dishonest in our relationship and I truly don't believe out marriage is going to make it. If I lay out an ultimatum, I need written proof that our her status here may still be revoked and she can be deported if she was deceiving about her intentions of immigrating to the US for the purpose of marrying.

  2. Ummmm....yes, that's why I asked.....We WILL be filing this month. I was just hoping we could still file her AOS with no repercussions and it will still be accepted and approved. Thanks for your reply..... :thumbs:

    Is your signature correct that she entered in September 2007? Hasn't her visa expired already?

    She will be accumulating out of status days. If something happened where she was identified by CBP she could face deportation proceedings.

    The safest thing is to apply for AOS as soon as possible.

  3. Not true, not everyone gets their green card within one year. We filed more than 9 months ago and they just now, after 9 months sent and RFE which we have not received yet. Given their untimeliness with our case we will soon be having to file for another EAD as I doubt he will have his green card prior to this EAD expiring.

    As to the question, it is my understanding that you do not have to pay for a renewal if you have AOS pending. perhaps this is what the prior response meant.

  4. My wife, here in the US on a K3/Spousal Visa, received NOA on the EAD we sent in. We received another notice of the Biometrics Appt this coming Friday. My question is this. We have not filed her AOS. Will they still proceed with the EAD so we can get my wife a SSN so she can work or will they require us to file the AOS first? :unsure:

  5. My wife is here in the US on K3/Spousal visa. Can she work right away? We filed EAD and recieved our NOA. If she can't work right now how long must we wait? If she CAN work, what do we need to do before applying for a job here? This is so confusing and I can't find a direct answer....Grrrr!!! :wacko::help:

  6. My wife was approved for a K3 Spousal Visa and entered POE on September 2, 2007. Does anyone know waht the stipulations are for her returning there for any reason in the first few months after she has arrived here in the US? She is in Manila today. She had a return flight back to the US at 6:40am this morning. The guards stopped her and reviewed her passport/Visa and didn't understand something about it. They contacted the US Embassy at 5am. Keep in mind her departure flight is 6:40am.... The US Embassy spoke with my wife on the phone and told her to come to the embassy when it opens at 7am!!!! GRRR!!!! OK, NOW she misses her flight and we will need to pay a re-booking fee because she missed her flight. Does anyone have any insight on this or enlighten me on why the stopped her and did not allow her to board the flight back home? She is at the embassy now and, of course I am looking for answers coz I'm so MAD! I can't contact her while she's at the embassy.....

  8. My wife is here in the US now on a K3 Visa. We went to the Social Security Office to apply for a SSN#. They told us that the Alien Number on her Visa does not match with the name the have on their computer???? Who do I contact to recifty this problem?

  9. I was wondering if anyone knows the limitations or restrictions on a K3 beneficiary once they have arrived in the USA. My wife's K3 Visa was approved in July 2007. She is here now but we had to leave our daughter behind who was born April 18,2007. My question is....Can my wife return to the Philippines to attend the CRBA Interview and await the process of our daughters passport? Or does anyone know where I can find the answer?

  10. My wife gave birth to our daughter in Kabankalan, Negros Occidental in the Philippines on April 18, 2007. We have had a hell of a time obtaining an NSO copy of her birth certificate in Manila. Has anyone experienced this before and could someone give me some insight on how long it takes for the NSO to release a birth certificate. We have had to refile the CRBA papers because the deadline had passed before we could obtain a certified NSO copy....Any insight on the process would be much appreciated. Thanks.

    Try this, get the certified copy from Kabankalan Local Civil registrar's office and bring it to the NSO for Authentication. i dont think you have to go to NSO in Manila, im sure theres an NSO office somewhere in Negros Occidental.Since your baby is new born she doent have record on the NSO yet. Sometimes records from provinces in the philippines takes forever to reach the Manila Office.

    You DO realize that would take a plane trip to Negros, a 2 hour bus ride and then a flight back to Manila? That would cost me about as much as it cost me for the refiling fee at the Embassy? I mean, I can see if one of my wifes relatives can do that on her island but, does it have to be one of the parents to get a certified copy form the Registrars office? I don't know if the Embassy will take anything other than a certified 'NSO' copy???

    Local Civil Registrar's policy (that includes Kabankalan, Negros Occidental) submits/forwards documents (BC, MC, DC, others) to NSO after 6 months that it has been filed at their office. Since Your child was born April 18, 2007 it will be around October or November before LCR will forward it to NSO.

    What you can do is to request for an (1st) endorsement letter to NSO from the Civil Registrar of your town. There will be fee for this including LBC courier (the documents to NSO and your copy). Once you receive your endorsement copy and the LCR's BC document, you will have to go to NSO in Quezon City (not the main NSO Office but the Vibal Building at corner EDSA in Q.C.). You will need to show them the endorsement letter (and the LBC copy that the 1st endorsement has been submitted to NSO). If NSO already have it on their file (manually-> you maybe asked to proceed to the 2nd or 3rd floor and their personel will have to look for it manually if indeed they received the LBC endorsement). If yes, then you will be asked to go back to the ground floor, may take only few minutes and you will receive the "unconverted copy" of the BC (p60.00).

    I emailed the LCR General. She emailed me back and stated she would try to expedite the document. In addition, the US Embassy contacted my wife and told her that she needed to RE-FILE the passport and citizenship papers for our daughter because the deadline had passed! Well, I am confused AND mad! Not only do have to pay another fee for filing...How do I know the deadline on THIS paperwork won't pass before our daughters birth certificate is released!!! My wife is there NOW at the US Embassy 'RE-FILING'!!! GRRRR!!!!!!!

  14. My wife had her interview on May 17, 2007. She needed to submit additional paperwork and had it all turned in on May 22, 2007. Delbros website is NOT working and I have contacted the the embassy twice in 2 weeks and they just tell me to wait 6 weeks and if she doesn't get her visa by then to call back again. HMMMM???? I see others receiving their visas who has interview before her and on same day!!!! It's just frustrating. I miss them so much and I am dying without them, my wife an our daughter. GRRRR!!!!!!!
