  1. Hi. My wife (CR-1) and my two stepchildren (CR-2) are in the Dominican Republic for a few weeks (they have their green cards). Sadly and unexpectedly, my mother in law is very sick and my wife has to stay behind to care for her.  We want the children (ages 2 and 4) to be back in the US while my wife remains in her country.

     

    My question is whether someone other than my wife can can bring the children into the US, or is only my wife authorized to do so?  My wife has cousins (I believe they are US citizens, but at a minimum green card holders) that are returning to the US in a week that, if permitted, could escort the children through immigration.

    Call everyday.  It’s a free call. You want that case number as soon as it’s available. You should call USCIS and ask if your file shipped out to the NVC. I did and within a few days the file was assigned it’s number as I called the NVC everyday after the USCIS confirmed the file had left the service center. Without the NVC number you can’t start the next phase of the petition.

    My i130 was recently approved and now moving to NVC, i understand that at NVC i will have to show supporting documents of income. Now that 2017 is almost gone and it will be tax filing season in the US. When its time for me to send my tax transcripts? W2's? (Most likely in January 2018) For the past 3 years will i have to send 2016, 2015 and 2014? Or would i have to send 2017, 16 and 15? I mean i probably wont even have filed my 2017 taxes yet?

     

    Anothers questions my wife is abroad, does not work abroad, has never been to the US but i've been reading posts about people having problems filing married separately because they are asked for a ssn or ittn? Itn? Number. Is there a way to not claim her? I feel like doing so would make it more complicated to file.

    It is technically the earliest date that the beneficiary is eligible to have his/her petition for entry reviewed by USCIS. Spouses and children (a few others; check the rules) get immediate priority for visas, while others stand in line and wait for their priority dates to arrive.  Non-immediate relatives could have a priority dates that are years away.  The USCIS publishes monthly the visa priority dates that it is adjudicating.  If  you're petition is for an immediate family member, in reality PD means nothing, except to measure against how many days you've been waiting for your case to be approved.

    And also would it be any difference? i''ve asked and have been told Miami is tougher on these things but why would it matter right? she's legally entering the US with me.

     

    She can legally enter the US in Miami, which will be her point of entry, and continue with you.  With her passport stamped she will be able to travel from Miami to New York. Not sure why she would be given a hard time if you're there to meet her after she's entered.  She just needs to let the officer know she's in transit to New York and that you're in Miami waiting for her.

    It depends on the country.  I would suggest looking at timelines for the country of origin of your spouse, which should give you a sense for timing.  You first have to go through the NVC which is a 1-3 month process before the file is even sent onto the embassy.

    2-4 weeks after you submit your RFE response, you will hear from USCIS.  They will either approve your petition or deny it.  Usually if you fulfill the RFE you are approved.

    GigiJamacia: The I-130A is an updated I-130.  I sent in the old I-130 (the form had actually expired) and a G325A and was approved as a good chunk of the old G325A was basically merged into the new I-130A.  Usually the USCIS has a transition period for forms, but perhaps given how long your case has been sitting, the agent may have not given you the benefit that I was afforded.  Each has his/her own way of reviewing files.  Good luck.

    Did you submit a request for a name update or did this update generate on its own?   The latter indicates that an officer has opened your file for review.  Search the internet on the topic USCIS Name was Updated.  Does not mean something is imminent though, it just means your file is in a queue somewhere rather than in a storage box.

    You won’t know what they need until you receive the letter.  It could be one of a number of items. Once they receive your response it can be a week to a few weeks until the case is approved.  The wait is not like what you’ve been through to date.

    You should not be depressed.  Potomac of all the centers is THE fastest insofar as petition approvals.  Most everything I have seen has petitions being approved (or with RFE) in about six months plus or minus; Nebraska is taking nine months and longer.  You can file an inquiry, but if any earlier than six months you're most likely wasting your time.

    If you download an app such as Case Tracker on an iPhone, I am pretty sure that you will see that your attorney does not know what s/he is talking about.  The app allows you plug in USCIS receipt numbers and see how cases are progressing.  The slowest of the service centers, Nebraska, is approving I-130s in less than one year.  Unless one is petitioning a loved one who lives in a country that the US government has flagged as requiring "super-vetting", your loved one should be in the US within 12-15 months, if there are no issues with your petitions.  Your attorney says 11-15 months for a NOA2, because better to be happily surprised by an approval before that window than to be disappointed by an approval after the window when most normal petitions are being approved.  Find a USCIS tracker for your phone and you will have a much better perspective.

    Is this attorney advising you of how long it is taking at USCIS for NOA2 or through issuance of a visa?  Sounds to me to be the latter, not the former.  It all starts with the service center where your petition lands.  Once out of that queue, the process is fairly homogenous for everyone, unless you have an expedited case.

    Caution about inquiries before your normal processing time has passed.  What you may have done is have your file pulled out of the queue, and put on a potential 60 day hold.  Because no one knows the order in which files are reviewed, you may have had your file removed when it could easily have been on deck for review or on lined up to be approved prior to the 60 day hold your file may now be in.

    They gave me the same story about chrome. Absolute lie.  Unless Microsoft is paying the government, the number of people with IE 11 is negligible.  You should all them on this as it’s not true.  The website isn’t hosted by the NVC. You need to ask if there have been issues with the host and what’s being done to resolve them.

    You have to keep calling.  It’s busy during the day.  Keep calling. They don’t know if there is an issue unless you call. The website isn’t managed by the department of state so unless you inform the nvc, they don’t know you’re stuck.

    You have to call the NVC everyday not USCIS. 603-334-0700.

    Call everyday.  Call at night.  The representatives are much nicer to speak with.  They say six weeks for it to arrive, but it takes less than three.  Just keep calling.  When you get your case number, ask the representative for the invoice number.  It is the invoice number that helps kick off the next step in the process.  You can't appoint an agent or start paying fees without it.  Don't wait for that to come in the mail too, as you will just incur more delays.

I am calling NVC but they said they haven't received my case and keeps telling me it takes up to 6 weeks to receive case from USCIS. Has everyone who has been approved and received NOA2 have received e-mail/text from USCIS? Did your online status change? I don't know if I should call USCIS to find out if they have sent my case or not!

     

     

     

    If it has been two weeks then call the NVC directly and inquire. That is when most people do so.  Call in the evening as the wait during the day is quite long.  Once you have a NOA 2 the process is out of the hands of USCIS.
