You are fine but bring evidence you filed I-407 in case CBP discovers you were an LPR. This is to avoid a fine

Could you tell me where I can see info about the fine?

I have yet to find any official information about an LPR applying for an ESTA or the I-407 process in general aside from the short explanation on USCIS website and a couple embassy websites around the world. I haven't seen anything about fines.

    Turn off the TV.

Wasn't the TV, I just noted that all the threads I have seen about it on VisaJourney or other similar forums seem to share the experience that their ESTA got denied, often even after the I-407 was processed.

  2. Hi,

Some weeks ago I sent off my I-407. I left the US several months ago at this point and decided it was time to finally and formally give up my GC.

Then shortly after my new job told me they'd like me to visit the US in September and October of this year to meet the team there. The postal tracking for my I-407 hasn't been updated so I don't even know if the GC and the form got lost or if they are still on their way.. (should have been delivered by now). Either way, I have no confirmation.

The company had a quick chat with their lawyers and said I could try still applying for ESTA to see what happens. My ESTA got approved in a matter of ~2h -- everyone on this forum state that if I have an LPR status then the ESTA would get denied. The ESTA application didn't ask anything about current or previous legal statuses in the US.

Am I good to travel in this case or will the Border Control send me back? My passport does show that I was admitted as an LPR back at the beginning of the year (last time I traveled back and forth to the US). I tried to contacting the Border Control as well but no luck so far. (I am obviously not looking to remain in the US and can provide proof of that if needed; these would be ~4-5 day visits only.)

The lawyers and the company will also do some further research but I was hoping to hear if anyone has any first-hand experience.

  3. I believe once you apply for a K1, you can no longer use your ESTA, even if it would be valid time wise. I was the same. They were probably just not authorized to talk about rejections in general on the phone, regardless of how trivial the reason is.

B2 might just take time for the same reason, you already had a K1 visa in process.

Finally, the current administrative processing can take time for a number of reasons. Whether or not it is the FBI does not seem to matter anymore as the relationship is over anyway, no?

If it is FBI, you can't really "clear your name", it would be up to them to decide and no way for you to find out.

If it's not the FBI, you don't need to have your "name cleared". Just contact the embassy to get your passport back and let them know you are just canceling the application because you broke up (no need to explain the FBI whatever to them of course), you should be able to get an ESTA or least B2 in a little while. (I don't remember whether previous K1 visa applications remove you from ESTA..)

  4. Hi,

so a random question. I have received my NOA2 and we are waiting for the package to reach Tokyo. I am going on a trip from Japan to the UK mid-August for just a few days. If I am lucky enough to get an interview date by early August (and normally it takes a week for them to process the K1 visa if approved), what do I do if it takes longer? As in, can I get my passport back mid-AP? Do I then have to reschedule the interview or is that an automatic denial? Reason being, I have to go on the trip to the UK and if I have the interview and K1 visa before I go, I could go to the US in September. If I were to schedule the interview after my UK trip, I wouldn't be able to go until October. I really want to go in September though if at all possible. If there's no extended AP, I should be fine but if there is, I may not have my passport back in time for the UK trip. I don't see it taking longer as I have basically all of my docs ready and Tokyo does not normally put people on extended AP but I am afraid to risk it in case this ruins the K1 visa altogether.

Of course, if I can't get an interview date by early August, then there's no issue and I have to go in October anyway. The trip to the UK came up suddenly and sort of messed up our plans. (If anyone knows how long it currently takes to get visa interview dates for K1 in Tokyo then that would be helpful as well!)

I am also asking this now so I can make plans as September vs October makes a pretty big difference for us/me at the moment.

I have tried to contact the US embassy here in Tokyo before and I can't seem to get through to anyone who actually works at the embassy and knows the deal (the lady I spoke to seemed like she worked at a call center and she was reading the answers on an unrelated topic from the web page which I saw myself already).

I would appreciate any input you have!

  5. Hi,

I just received my UK police certificates that I ordered for the K1. I got 2 copies just in case but they are both in the same envelope (I thought they would be sealed separately so I could open one just to see there are no issues. To be honest, there shouldn't be, but I just wanted to be sure).

I know the certificates for some countries need to be sealed (e.g. Japan). Do I have to keep the envelope sealed for the UK ones as well? Or am I allowed to open it?

    Thanks!
