  1. Hey Everyone,

     

    So we got some pretty sad news that our Fiance Visa was denied.  We were denied because we told them about our unofficial wedding in Australia. We stated very clearly that the ceremony in Australia was unofficial we can provid paperwork stating that we are not married , they are confused and state that they think we are getting married in Australia. They ended up saying although we did meet the requirements for intention to marry they felt that our implied marriage barred us from the K1 Process. I did read on this site of some people receiving denial due to being "Too Married" in the USCIS eyes.

     

    We were given the option to appeal for the fee of $675 USD. So Im wondering if its worth appealing, we can provide a certificate of single status to show that we are not married and a letter from the person performing our commitment ceremony stating it is not an official ceremony but is this

    really going to help. Would it be better to apply for a spousal visa and get married here in Australia?

    It's just a notification of approval. You won't have to send anything back unless you get a second RFE which I think is highly unlikely. The letter doesn't really say anything except that you have to wait to hear from the NVC and then the consulate. You should have no problem. Just make sure the neighbor holds on to your mail! I think you need this document later on.

  3. My only issue is, my fiance and his mother are travelling to Australia to spend some time with me so no one is at the address that the letter is going to go to. His mum isn't

    going back for 4 weeks and my fiance is staying for 3 months. The neighbor is going to collect the mail for them. Will the hard copy have anything that needs to sent back with anything or is just a notification of 

    approval? Appreciate it guys.

    My fiance and I got an RFE sent to us on the 2nd of June asking for another letter of Intent to marry. Which we sent off and they received on the 14th June,

    just curious as to how long an RFE - approval takes, we are using the California Service Center. He is flying to me in a day for 3 months, so we are really hoping most 

    of it can be done so I can go home with him "Wishful Thinking" haha. Any advice would helpful. Thanks in advance.

  5. It is a commitment ceremony, the only reason we are doing this is because of the large amount of family we have here that cannot attend a wedding in the States. We have had everything booked for the last year, so there will be no canceling of that, not to mention the money it has cost.....we are basically having a reception which is a dinner with all the family. We are not signing any paperwork of marriage of any sort.

    This is my first time using this forum, I checked our case status randomly last night and it had changed to requesting for additional evidence, my fiance

    still hasnt received the hard copy of the letter yet, they stated it was sent on the 2nd June. We are having an unofficial wedding here in Australia in July and he is due to fly over

    to Australia in 2 weeks. Curious as to how long it takes to receive the hard copy of the RAE as he wont be there to collect it if he is here. Hoping we can send the additional evidence 

    before he leaves America. Any ideas of how long you guys think would be reassuring?
