Congratulation, when is your N-400 window open?
The N-400 interview is what triggered them to approve it. We had the N400 interview yesterday. He passed the exam and the form said they would recommend approval. Since the condition case was still there, I'm sure that caused them to also review that case. We sent in lots of evidence so I'm guessing it was enough to get the I751 approval without another interview.

hoping for an combo interview as the last update on n400 was fingerprints reuse on dec 2020.
The N-400 interview will come to you pretty fast we applied in September and he did his interview yesterday.

Yes, the requirements to prove automatic acquisition of citizenship are the same for both. Birth certificate is not enough to show legal custody, all it proves on its own is parentage. Would the mother be amenable to formalizing the custody agreement legally? If not then the kid will have to apply for himself when he turns 18 (assuming he meets all other naturalization requirements by then).
The legal custody requirements are as follows:
Legal custody refers to the responsibility for and authority over a child. For purposes of this provision, USCIS presumes that a U.S. citizen parent has legal custody of a child and recognizes that the parent has lawful authority over the child, absent evidence to the contrary, in all of the following scenarios:
- A biological child who currently resides with both biological parents who are married to each other, living in marital union, and not separated;
- A biological child who currently resides with a surviving biological parent, if the other parent is deceased;
- A biological child born out of wedlock who has been legitimated and currently resides with the parent;
- An adopted child with a final adoption decree who currently resides with the adoptive U.S. citizen parent;
- A child of divorced or legally separated parents where a court of law or other appropriate government entity has awarded primary care, control, and maintenance of the child to a parent under the laws of the state or country of residence.
- USCIS considers a U.S. citizen parent who has been awarded “joint custody” to have legal custody of a child.

Thank you so much for this information. We will work on getting the custody paperwork in order. I am glad you were able to help me understand this.

If the citizen parent does not have legal custody (joint is ok) then the preconditions for automatic acquisition of citizenship are not fulfilled. A court order showing joint custody would be sufficient. Or are you specifically talking about consent to get a passport? Different issue, but custody needs to be sorted out too.
Oh got it. I don't think a joint custody agreement was ever made. The only thing that they have is the birth certificate with both names on it. Would custody have to be sorted out for the N-600?

Yes, hopefully that push them. I’m assuming you didn’t get an interview date for the I751. That is even worse, because you don’t have an idea what will happen next. However, we can hope for the best. My status for 1751 changed on January 12 ,2021 saying that they schedule my interview. I filed my I751 on April 6, 2019. This year will be 2 years. So, I’m thankful for the progress and also grateful that they will be giving me both interviews. It’s been a long wait. I will update you.
I just checked the case and get the following message: "we approved your Form I-751, Petition to Remove Conditions on Residence".
I am super happy and excited. This journey is finally coming to an end. 😀

Look under "7. Show Parental Consent."
Mom will have to go the to US Embassy in DR to notarize DS-3053.Even though the mom is not a US citizen? I called the passport customer service, asked that question and was told that she could not go that route because she is not a citizen. I may have to call the US embassy in DR to see what they say. I am also going to the Dominican Embassy so that I can double check.

Thank you for the info. I did research and found that out via YouTube.
I am now trying to find out how my stepson can get a passport with only his dad in the US. The mom lives in Dominican Republic and he does not have sole custody. I called the passport office and they referred me to the USCIS office which is always a hassle to call.

I am doing research about the N600. My spouse just passed the N400. Is the N600 necessary in order for his 13 year old to get a us passport?

They called me yesterday and told me that my husband should accompany me to the N400 interview so that they can also adjudicate my I751 at the same time . So, seems like my I751 interview won’t be on March 03 2021. I will be getting a combo on February 01,2021.
They have to remove conditions before they can naturalized your husband. That’s what I was afraid of, doing my N400 interview and then I have to wait for them to remove conditions. It’s just time consuming. So, even if they don’t do the ceremony oath on the same day, I do not mind. As long as I do both interviews and get them out of the way. But I will update you on what happen.
Thank you. I tried to get both done at the same time. We called and was given the run around. We applied for the I751 interview June 2019 and applied for the N400 September 2020 and I751 is still pending. Now that the N400 is complete I'm praying that pushes them to make a decision. I'm praying they just approve it like I have seen happen to many 🙏.

Hello!!! I need some help. My interview for N400 was scheduled for February 1 2021 and my Pending I751 interview was scheduled for March 03, 2021. That is really weird. Please, anyone ever had this problem. Filed N400 April 2020 and I751 April 2019.
My hubby had his N400 interview today. His I751 is still pending. He passed and was given a letter saying that he will be notified via mail. I'm praying with all the evidence I sent him they will remove the conditions without doing an interview.
You can also call USCIS to see if they can do them both together.

Just wanted to give an update on my two applications.
I submitted my I-751 in October 2018, and my N-400 in September 2019. Had no activity on my I-751 after my biometrics appointment in November 2018 - almost two years. Got an interview scheduled for my N-400 in April 2020, and was immediately de-scheduled because of the pandemic.
Fast forward a few months, and I got my N-400 interview re-scheduled for November 3rd in New York City - Election Day.
Everything I had read, and even after speaking to my lawyers, indicated that it would be a combo interview. But when I was called for my interview, the interviewer said she only did N-400 interviews, and the I-751 was nothing to do with her, she had never heard of anyone doing combo interviews, and that it would be a different office processing that. She could not even tell me if I would need to come in for another interview or not.
Interview went fine, and at the end she was like "I can't give you a decision because of your pending I-751". I asked if they could call that office, as it was in the same building, and it was my understanding that combo interviews were fairly common when the I-751 had not been processed. She said she had never heard of that, and she could only give me a "no decision made yet" piece of paper, and said I could go home.
I was really dejected. I had hoped to become a citizen that day, or at least get a date for my oath ceremony (everyone who got approved on November 3rd was given a December 18th date for their Oath Ceremony), but still felt that I was in limbo. She then must have escalated my I-751 case because it was approved that same afternoon, and I received my approval letter the following day, on the 4th.
The I-751 approval letter stated:
We have approved your I-751 Petition to Remove Conditions on Residence. Our records also indicate that we have approved your Form N-400, Application for Naturalization. Because we also approved your N-400, you will not receive a new Permanent Resident Card (also known as a Green Card). Instead, once you have taken the Oath of Allegiance, you will receive a Certificate of Naturalization, which will be proof of your U.S. citizenship. If you have questions regarding this process, please contact the USCIS Contact Center at 800-375-5283.
So, that was great. But since then I have heard nothing.
The estimated case completion time stated January 2021 - 2/3 months after the interview, but last week, that estimated case completion time was pushed back a further two months to March 2021.
When I check my USCIS status both online and via their automated phone system, it says that my "Interview Has Been Scheduled". There is nothing about it being completed (which it was) or approved (which the letter says is the case).
I called USCIS and spoke to an agent. They said that did seem strange, and that they could not see anything on their end, but that they could not investigate my case until at least 60 days had passed from my interview (which took place 55 days ago).
So, overall, I guess I should be happy that my citizenship seems to have been approved? But it looks like it is stuck in their system because of an error, and keeps getting needlessly delayed. And I do not have either a new Green Card with conditions removed or my certificate of naturalization.
Thank you for sharing this. I am on the same boat. I pray that my hubby only has to do the N400 and with all the evidence I sent in, they approve the I751 without and interview. I have called and they instructed my hubby to go to the interview for the N400. I will be outside waiting just in case they decide to do the other one at the same time.

You can call and ask if the I-751 is at the local office with the n400 and the likelihood of having both interviews together.
Thank you I have called about 3 times and they keep telling me that they would not know. I tried to escalate it but I was told that a Tier 2 has to call me back. I pray that the interview is waived and my hubby only has to do the N400 interview.

My spouse just got his citizenship notice interview but the I-751 is still showing pending. Should I call to see what will happen with that case? We have not received or know if they will do both interviews at the same time.
-
From MSC, does the case get transferred to a different service center. Where is that service center (MSC) located. I feel like it's not moving at all.
-
For those who have received approvals, did you first get an interview request and instead of going to the interview just got an approval instead? My case is at MSC and still waiting for an answer.
-
Has anyone who originally got a "Ready to Schedule Interview" got a notice saying that the card was approved? I'm hoping that maybe due to this virus they may just skip that step so that the cases are not delayed any further. Also hoping that our case doesn't have to be dragged out any much longer.

Hello guys, I am not a May filer but will be filing my ROC this August. Just a Q, what did you guys use to send your package. I noticed that if I send thru express USPS it would be a PO Box. Is someone going to sign it there? Thank you!
Hi:
I sent my package using USPS Priority mail and it arrived in 2 days. When filing just be careful with the addresses. If you use USPS it goes to one address and if you are sending UPS or Fedex then there is another address for it. Overnight I feel is too much money. Priority gets there fast and its half the price in some cases.

Good Afternoon:
Not sure if anyone has an answer to this but my stepson was issued an IR2 when he came to the US. Since he does not have any conditions to remove, do I still have to mention him on the 751?

It is really up to you.
I asked family and friend members if it is okay if they write affidavits, and I just wrote affidavit based on my interaction with people, but just have them sign with their photo ID scanned with "under the penalty of perjury" so that USCIS knows this affidavit is not just coming from "Copy and Paste", but from actual people who are writing this under the penalty of perjury with the evidence of their photo ID, if they wish to verify whether or not the affidavit is US citizen and go further in case they want to interview.
This way, it doesn't take more than a week, but 2 days (since I already wrote affidavits, all they need to do is their signature and photo ID). If they are uncomfortable, then I go next.
I read the below article which says it is not required. I am not planning on doing one.

Good Morning.
According to my calculations, I will be filing sometime toward the end of May for my Husbands renewal. My first questions is regarding my stepson. He doesn't have any conditions to remove from his visa and it is good for 10 years. Will I have to mention him anywhere on the 751 form or do I just focus on his dad (hubby)?

Finally wrote my interview. I saw that the July and August Forum are close but I found this one....
http://www.visajourney.com/reviews/view-dos-cis-reviews.php?entry=22277 (This is the link) Hopefully this helps those who have interviews schedule in Dominican Republic.
My husband Stepson and I all arrived at the Embassy around 6am. Our interview was at 7am. There were already a lot of people there. My husband's uncle dropped us off at the front since there is no parking at the embassy. There are parking areas a little bit east of the Embassy. Cellphones are not allowed at the embassy so we wrote down phone numbers we would need at the end. Since we had a minor child with us we were placed in a line that would go inside first. We first had to do a security search at the first building. They make you remove everything out of your pocket and you also need to take your watches off. After the security check was complete, we were instructed to proceed to another building.
I checked the time entering the 2nd building. It was 6:45am. My husband stood in another line while I sat down. When he was called we all proceeded to a window where a lady reviewed all the papers that were sent from NVC. She first asked for both appointment letters. She then asked for the sealed medical records, police record, original birth certificate, original marriage certificate, and passport from my husband. She asked if I was the petitioner and I said yes. For my stepson she asked for his passport, medical records and and original birth certificate. She handed both my husband and I both a pamphlet about domestic violence. She stapled #107 to both appointment letters then we sat back down and waited again. At this time is it about 7:25 AM.
Once we sat down we patiently waited as numbers were being displayed at different window. When our number was called my heart jump. The interview was done by a man. I first swore my husband in. He asked the following questions.
What is your name?
How did you meet?
When did you get married?
So you got married on (date)? - No that is the date we met....(trick question)
So you met and got married right away? Tell me more about the relationship?
Question for me: What made you attracted to him? I answered
He asked me to elaborate more since we had only met in person and married 2 months after.
I told him in English and I am in love with him and that I love his sense of humor. I then elaborated that in 2016 we both lost our moms within 6 months of each other and during the entire time we were supportive of each other. He said sorry about that and the questions ended. He made my husband place his right had on a fingerprint scanner and then he finally said the magic words.....Congratulations your visas are approved.
I was so relieved when I heard those words. By around 8:15 we were out of the embassy. Outside there were a lot of people waiting. My advise is not to go too early because during the day they don't even let you wait right outside the embassy. There were people with 9 and 9:30 appointments all the way down the street waiting. I guess they do that for security but it was alittle bit crazy. On the corner there are people with flip phones where you can make a phone call and they just ask you for a tip.
The whole process was very organized and since I sent so many proof to NVC. I did not have to show them proof of anything during the interview. We had chosen to have the passport picked up at the office where the fingerprints were done and in 2 days the passports were ready to go.

N-400 and I-751 Combo Pending -- Part 2
in Removing Conditions on Residency General Discussion

My local office is Miami. I applied electronically for the N400. That may have helped speed up the process.
