One of the most regularly created threads in this section is "Can I visit the US while my application is pending?" So I thought I'd create a thread on it with the aim of reducing clutter and having all of the information in one place. Currently there are hundreds of individual threads in this section on the question!

The simple answer to this question is that if you are from a VWP country or have a tourist visa yes, you are allowed to visit while your visa is pending, but you may well face extra scrutiny because of the pending CR1/IR1. The CBP officer at your point of entry has the final say on whether you will be admitted. If he/she feels that you are not going to return home then they may deny you entry to the United States. It's up to you to convince the officer that you will return home. Make sure you only answer what you are asked and never lie to the officer.

Sometimes you will get asked for proof of ties to your home country to help convince the officer that you are going to return home after your visit. Great examples of ties to your home country include:

    - A letter from your employer stating when you are expected to return to work

    - If you are in school/college instead of work evidence that you are studying in your home country

    - A copy of your NOA1 to show you are following the process legally

    - A printout of your flight itinerary showing your return flight home

    - Evidence of ongoing home ownership/rental in your home country

Nobody wants to be turned back at the airport/border. Every visit is different depending on your circumstances (amount of previous visits and length of visit etc) and the CBP officer you get at the point of entry. Why not share your experience here as the visit can be stressful and it's great for people to see others previous experiences. Have you ever been denied and why? What questions have you been asked?

Does anyone happen to know if my husband can fly from Morocco to Germany for a layover then a direct flight to the USA. I know he cant fly to Canada without a Canadian visa so I want to make sure before buying a ticket.

hello guys,i hope everyone is doing well, so i am soo mad , beause its been well over 60 days since my husband had delivered his requested documents. i do understand that NVC in islamaba

d pakistan dont count weekends or holy days in "60"days process, but his interview was 1/4/18 and document were droped on 1/5/18, as of today no answer, the file was updated at 6 times(last update was 1/27/18) been calling islamabad no one answers the phone. when i emailed the responce i got was we can not disclose the details( maybe itwas an automatic respond) i just dont no what to do.

Not to upset you more but my husband had his interview on Sept 27, 2017. We still are in administrative processing. This is a difficult time and all I can say is communication and visits will be important during this time to help you push through. We are still waiting and hoping for good news. My husband is from Morocco and apparently they are still working on people with August interviews and starting to work on September. We only wish we are given good news soon.

  3. I wish everyone the best of luck but my heart is heavy right now. I really can't believe this process. We submit all the necessary documents, wait almost a year then get the approval, wait some more, then get an interview and now wait Lord knows how long. This process is so stressful and honestly seems racist. Why is it that the Arabic spouses and family members have to wait longer because they are Arabic. My husband has a clean record and sat in the embassy watching people who don't speak a word of English get approved where as the officer questions why his English is so good. Makes no sense to me and seems to be making me crazy based off my rant.

Everyone goes into AP after interview. It is administrative processing. If they asked for nothing it will change in 1 to 2 days then to Issues.

I would like to know any ones opinion on our situation.... They collected my husband's fingers prints and civil documents. They returned his passport and told him they will email him with what they need. The called him this morning and sent Jim and email requesting information that is in the paperwork. Employment, siblings names and bdays, my info, his addresses for the last 15 years. Do this sound hopeful or should we begin to get worried?

  5. My husband had his interview today. He was given the white 221g. No boxes were checked. The only item highlighted was admin review. Before the letter was given to him the officer collected all the documents he brought with him and returned to him all the documents I originally sent. My husband answered every question honestly and correctly. The officer said many times in the interview I don't believe you because he has been married before. The strangest question asked was if me and my sister fight. When he asked what he should do because this paper doesn't state anything he was told by the officer wait for an email with things I need from you. He asked the officer what should I tell my wife. He replied the same thing I told you. We are beyond disappointed and are extremely disappointed and have been crying all day. I have reached out to a lawyer and the senator to see if anything can be done. Does anyone have any advice? Does anyone have any knowledge of this happening to others? Should we be concerned? Do you think this will be denied? Any help is appreciated.

  6. I am looking for support. My husband's interview was today. The interview took a little over one hour. He answered every question correctly. In the end he was issued a 221g, asked to give all the documents he brought with him, he was given all the documents I submitted and they didn't take his passport. On the 221g nothing was checked they only highlighted the admin review section and told him they will email him what they need. At this time we are freaking out completely. In the interview they kept saying they didn't believe him. He was given the letter about social security but given the 221g. Help us. I need advice I'm about to have a breakdown.

  7. Our case was closed over a week ago and we still don't have an interview date assigned. I was told it's generally 7 to 10 days from the case being closed to the interview being assigned. Does anyone habe an idea of that. I went off the checklist and only saw one case from Morocco and they found out extremely quickly. I know there are 2 of us from Morocco awaiting out interviews. Does anyone have any assistance on this. I also feel no one has been assigned yet because there hasn't been many changes on the checklist. Help I need some information because I'm about lose my patience again (like during uscis steps).

Oh My! Why didnt i read this before :( I didnt put N/A or None to the part about Interpreter or Something. Almost 4 weeks at NVC now and looks like i am gonna have Checklist because i messed up the I-864EZ.

Don't worry about not putting n/a on your paperwork. I didn't our scan date was June 3 and case closed date is 7/21. Best of luck to you.

i called.  they are scanned generally within 2 days of recieving them.  but my understanding is.. the 11 week wait doesnt begin until the other steps (fees and such) are paid.  mine were paid before i sent mine.  so they gave me my acceptance date last thursday after my documents were scanned on wednesday.  i could be wrong but you should ask.  the rep made some comment about "your profile, including fees are complete so you can assume the 11 week waiting from wednesday when your documents scanned"..so sounded like to me.. all has to be complete before the clock begins..

That is true. They informed me they won't review the papers until the other steps are complete. It looks like several people are going through challenges with the payments. It looks like it cleared and is no longer in process. I am going to attempt to make the payment again this evening.

they cant seem to fix the spelling of my husbands name either.. they put it in as Yinod instead of Vinod... they assure me the typo wont cause any issues later on, and they will get the error corrected when they do his paperwork.. but who knows.  seems like when they have a problem they get confused easily and they cant fix it😐 i hope everyones approvals, come soon so this nightmare can end.. its been 1 week now since my documents were scanned.. but still a long time waiting.  8-10 weeks😔

does it inform you on the site that ur documents have been scanned? Or did you have to call to figure that out?

you sent in your papers before you finished paying the fees?  i would have been afraid to do that.  the site says to send in the documents after your cleared fee payments.  i hope it doesnt confuse them.  they seem to get confused easily lol.  i pray everything processes smoothly😊

I spoke to two different agents and they told me to send it since there was a problem with the site. They said they won't look at the paperwork until the other 2 steps are complete. There is a glitch they don't seem to know how to fix.

Did you get any sort of an error message while using it? I wonder if it was something just on Saturday with the site. How many official business days did it take for the payment to clear? With the Holiday on Monday it technically is day two today for me. I used my laptop with Google Chrome too.

It is a known error. I processed the first payment successfully and have waited over a week and the second payment hasn't processed. It hasn't come out of my account and was given the error message. I tried to process it again like the agent told me to and it says there is a payment in process. I spoke to the agent and they advised me to send my documents and I did yesterday and they should arrive today at the NVC. I am honestly frustrated because I feel this will slow our process down. We will see fingers crossed it won't happen.

Congrats! I was wondering if you called them and got your case number? My file was sent to the NVC at the same time and they keep telling me they haven't received it yet...

I don't know if the person I spoke to is just misinformed or something since they are saying it takes 6 weeks to get in the system and another 2 for a case number. The woman this morning also said "well we only let you know when there is a visa available, so it could be awhile". After I just explained we are filing CR-1.  Things like this make me really doubt their entire system haha

I called them and asked if they had my case number. The first time I called they said they just received it but a case number hasn't been given. The person I spoke to said once they receive it the maximum for them to assign a case number is 2 weeks from that date. I called yesterday morning and they said it wasn't assigned but I called last night around 11pm and they assigned a case number. There is nothing I can do until they email me or send me what they need. So I can't even pay the fees yet. I'll keep you all posted on these steps.
