You should also include the I-130A form if you have sent the new I-130 since it says on the USCIS website under instructions for filing I-130 .Did you also send in the most recent paystubs too and if you did then you might be fine regarding the financial part of it ,but you may receive a RFE regarding the I-130.

I had filled up the old I-130 form, but I made a mistake, so I printed out the new one. I didn't even pay attention to the date of the form, so I just redid the I-130 and kept the G325A as it was. I didn't send any paystub, only the W2 and tax transcripts. Do you think they'll ask for it?

Quick update on our end - NOA1 hard copies came in the mail today, all 6 of them. Now to wait for Biometrics letters.

Congratulations! Things seem to move forward for you. It's still silent at my side. Btw, can I ask you something. I've just realized that I sent the new I-130, but I included the G-325A instead of the I-130A. Additonally, I only send the tax transcript and W2 of my husband and tax transcript of the co-sponsor. Will I get an RFIE for that? Or they'll send the whole package back?

I think it's because our spouses are from Vietnam and/or we live in CA and it's taking longer.  That's the only thing I can think of that we have in common and why it's taking so long.  Hehehe.

There should not be any type of discrimination here... I'm adjusting my status from F-1 Visa thou. The worst scenario is I made some mistake, so they couldn't process it. I hope that's not gonna happen.

They sent me messages 12:30am this morning, I saw them after I got up. Stay positve and stay strong!!!! I hope you can hea from them very soon!!! Good luck!!! If you put everything in the package, it should be ok, just wait patiently!

Thank you, Cynthia! This wait is not fun at all. It makes me so frustrated. I'll let you know if I receive anything.

Still nothing yet. Driving me crazy.

Same here, Denis. I know I shouldn't, but seeing people getting their texts/messages makes me feel more and more frustrated. I've been trying not to compare my case with others' in order to feel more relax; however, one side of me's still worried that I made a mistake on the form and they're gonna send it back. Anyway, I hope both of us will receive something soon.

I forgot to include a letter from my husband's employer as well as some of his pay stubs. We only submitted his 2015 tax return for the I-864.

Do we need to include the pay stubs and employment letter? I only sent my husband's 2016 W2 and Tax Return (along with my co-sponsor's Tax Returns for 2013, 2014, 2015). Is it sufficient enough? Or they will ask for RFIE?

Thank you so much for your reply! I haven't heard anything yet, no email, no text. I saw some people got their emails like after 5 or 6 days.

    Hi Cynthia,

I have heard there is some delay for those who file mid to late March thou. I suggest you to join this thread; people, who are March filers, are sharing their information and experience here.

You can browse through the thread and see their timelines, so you can estimate yours.

It can take anywhere from 7 days to 21 days. I had to wait 21 days until I got the emails and text messages.

    You should receive something soon.

Thank you, Becci! I'm trying to be positive. I'm just worried that something is wrong with my package, and they need to send it back to me. That's the worst scenario that I could think of. Anyways, I hope everything will be ok for all of us!

i already sent my AOS at Chicago lockbox from New York on March 15. They received my package on  March 16th noon.. but i still haven't heard from them yet..

Are you guys has some similar situation?.. :)

We are on the same boat. Sent mine on 3/15, and it was delivered on 3/16. I haven't received any texts/messages yet. I'm a little bit worried, but I still hope everything would be alright.

Please let me know once you get the texts/messages.

please remain strong and positive, they will get back to you soon. good luck.

Thank you for your kind words, atuegwu! I understand that some of you might have waited for more than 20 days for texts/messages, but I'm still worried. This wait is not fun at all. The longer it takes, the more I'm afraid that something is missing or wrong with my package, and they'll send it back to me. For now, I'll just keep praying to receive their texts/messages soon.

Hi Pinkielicious, I am facing another situation now, I had an interview with a local company, they said this job would probably begin in June, do you think I will be able to get my EAD of AoS by then or do I need to apply for OPT now, but I don't know if I apply for OPT now I would get my EAD of OPT by June. Thank you!

    Hi Cynthia,

As USCIS removed the guarantee of processing AOS EAD card within 90 days, we can't be sure when we're gonna get it. And as el_greco mentioned in previous posts, there is no point applying for OPT now since the processing time will be the same. Since you already filed for AOS, you'll receive your AOS EAD before OPT EAD for sure. So don't waste your money. I know it's frustrated to miss an opportunity on employment, but there is nothing we can do. Just wait for your AOS EAD, and I believe there will be more opportunities for you.

Btw, have you received texts/messages from USCIS yet?

  12. Hi guys,

I'm adjusting my status from F-1 Visa. I sent out our package on 3/15, and it was delivered on 3/16. It's been 9 days, and I haven't heard from USCIS yet. I've browsed through the thread, and I've seen a lot of you waited for 2 weeks or even more than 20 days for the texts/messages. So I'll be patient waiting for mine.

I hope everything will be alright for all of us!

USCIS doesn't care about your education plans since you're applying for AOS due to marriage with a USC. I didn't even know that graduating from community college offers OPT based work authorization to be honest. In general keep in mind that your AOS-based work authorization, and, eventually, the actual green card, are way stronger and broader than the F-1 OPT authorization.

Thank you (again)! I was actually planning to apply for OPT next week if I still don' hear anything from USCIS. I now realize that since I already sent out the AOS package, there is no point applying for OPT. And yes, I can apply for OPT after graduating from community college.

I sent out my application last Wednesday, and it was delivered last Thursday. I thought I would received the text/email notice after a week or so, but I still haven't got anything. It took you 6 days to receive their text, didn't it? This wait just makes me feel so uneasy.

Thank you very much for your reply! So what do you think? Do you think I should still apply for OPT?

    Hi Cynthia,

So everything is clear now. All we can do is patiently wait for the notice from USCIS. I hope everything is going well for all of us.

Regarding the change of office, I don't think they'll let you do that. But you can call USCIS office to confirm.

Assuming you have already applied for EAD as part of your AOS package, probably not. If you are going to be graduating in May, you will already be in an AOS-pending status, which guarantees your lawful status in the country. Depending on your filing date though (3/20 shipping) I am afraid you won't be receiving your work authorization card (EAD) before some time in July, so you have to keep this in mind -- you won't be allowed to work before you have received the EAD.

Thank you so much for the information! I was confused at first, but after reading your post, everything is clear now. However, I have another question. I will be graduating from community college in may, but I do not plan to transfer due to financial issue. Will it be fine? Will they question why don't I transfer?

  16. People said USCIS had already removed the 90-day guarantee for EAD, so I am not sure how long it is going to take. I also wanna go for OPT, too, but we need to pay for the EAD, and I do not know if it's ok for us to apply for OPT and AOS EAD at the same time or not. Some people say we are allowed to stay in US for 60 days after our I-20 is expired. And with the AOS thing, I think we should be ok. Or I'll wait until next week, if I still havent heard anything yet, I will go for OPT just in case.

Hi,I am sorry,I mailed on 3/20. I am confused because a lot of people say so,but I am still hesitant about applying for OPTOPT

Me too. I actually planned to apply for OPT this month, but I haven't since I some people suggested me to wait for the EAD through AOS. I am still confused whether I should go for OPT or not. Are you going to be graduated soon?

Hi,I am facing the same problem. We just mailed out our forma on 3/30,I am not sure if I should apply for OPT,also my school told me to remain my F-1 status while I am waiting.

    Hi Cynthia,

I have heard a lot of people said that as long as you are married to a USC, and you send out the AoS application, you will be fine. Some of them even said that once you received the first notice from the USCIS, you can stay here even though your status is expired. You can carry the notice with you just in case someone wanna check on you. When did you send out your package? 3/3? Have you heard anything from the USCIS? I sent my on 3/15, delivered on 3/16. I am still waiting to hear from them.
