    Good morning Everyone!

I filed my vawa case on May 2017 and I'm on second Prima Facie now. My case included 2 restraining orders ( 1 in family court and 1 in criminal court), Police report (were physical injuries were stated), Therapist Report, Letter from the shelter I stayed and pictures of our wedding and many other things that prove the domestic abuse, good faith marriage and other requirements. I feel that with all of this evidence I have a strong case, in God I trust that this will be enough for USCIS. However, I'm a little concern with the processing times. According to the USCIS web site on October 31st 2017 they were reviewing cases from September 12, 2016. WHY ARE THEY TAKING SO LONG??? Before, this was a process that took about 9 months. I check the website almost every day. I'm getting desperate. Are any of you in the same situation? Can you guys share with me how was your process and if you cases got approved or not?  Also, I see many people saying they filed for work permits along with form I-360. My lawyer said this wasn't possible. Any thoughts and comments will be appreciated.

    Thank youuuu!!

You can file c31 with just the i360 but won’t get approval until your Vawa is approved. If your spouse is a usc you can file i485 and i765 concurrently and get your work permit while you wait on a decision from uscis.

He could be a citizen, just don't know because he never discloses those information to me. He tells everyone he is a citizen but I don't trust anything that comes out of his mouth.

If you believe he is a citizen being born here, you can get a copy of his birth certificate from vital records. If he is naturalized I believe uscis will try to find his info in the system

Unfortunately, I don't have any document to attest to his citizenship, all I have is his social. I know for sure he is a green card holder though. I read on one of the post that there is a way to have USCIS check for me?

Since he is a green card holder I believe you have to wait until your Vawa is approved before you can file your work permit and once a visa number is available you can file to adjust your status. Hopefully someone can correct me if I am wrong

Thanks for your response, I see that, I am trying to find out who can actually file. Do I have to have been petitioned for something by my ex husband in the past? I will go back and check, I have seen a few post on it, but I don't know anyone's background which let them to file. I just need to make sure I qualify to file.

As long as your spouse is a us citizen you can file while your petition for Vawa is pending. You’re self petitioning so nothing is needed from your spouse. Except proof that he is a citizen which classified you as an immediate family
