We are trying to decipher how to file for a visa for my step child.  I am the U S citizen, my husband has his green card and his daughter is under 21 and was 15 when we married.  We would like to bring her here from Australia.  If I am reading correctly, since she is under 21 and I am her legal step parent,  I can apply for an immediate visa for her as a US citizen?  Has anyone gone through this that could give us some advise on the best way to go? 

  2. Has anyone recently had to file and EAD I- 765 extension ?  My husbands EAD expires on January 1st.   

    We had our AOS interview on November 5th, and our I-485 was  "recommended for approval"  but we still have not received anything beyond the letter that we got at the interview, which is not a legal document.  We are still waiting for the "official approval letter" .   However, his EAD card expires on January 1st and so does his drivers license!  He has to have something showing he has been extended. 

     

    We called the USCIS and asked about case status and was told we should file the I-765 - again.   The agent said we just had to send a copy of our previous approval and no fee was required.  BUT.. I can not find anything official that tells me what is required to send in the pack to apply for this extension.  When I searched visa journey I see where it says we have to do passport photos again and attache marriage certificate etc..  Has anyone recently done a renewal or know what we are required to send with the I-765 form to apply for an extension besides a copy of the first approval??  

     

    I read the form I-765 directions and it really is not clear.  Time is of essence as it expires soon so I need to get in the mail.  Any direction would be greatly appreciated!!

    I am getting ready to send in my I - 485 (c9) change of status packet which is based on a K1 visa.  I am also sending in the I-765 and I-131 at the same time.  Are we required to do another "package" for the I-765  AND the I-131 ?  Example.. including more copies of the  I-94 and passport photos, etc ?  They are already in the packet ?

Jamiekr08 did you get your interview date ?  We finally got ours yesterday but only because we contacted them!  Says their wait time is 24 days, lol, not sure what that's for!   We estimate they got our packet June 28th, we never got anything saying that it had been received.  We finally called a couple of days ago, and yesteday we go the interview date, August 8th!  So much for 24 days.   Never dull in this process. 

     

    Moral of this story to all, you really have to stay on top of this process and watch the processing dates on VJ to make sure you keep moving forward.

Soooo just an update from my post yesterday.   I called back today to see if they had received my packet yet AND not only had they received it, it was sent out to the Sydney embassy TODAY!  I told her I had called yesterday and was told they had not received it yet, and it could take up to six weeks.  She said, "not everybody knows the new system yet".  So this validates the reply comment in my post yesterday and a note to those of you calling in to see if they have received your approved I-129f, make sure the person who answers is checking the NEW system for your status.

Wondering if I should be concerned or just offer a heads up on processing times.  We got our I-129f approval and NOA2 date on May 18th,  2017, said being sent to NVC.  According to the processing time graphs here on VJ the NVC is processing NOA2 dates of June 1, 2017.  So I called today and was told that they have not even received my packet and that is can take up to 6 weeks to receive.   What am I missing?  Should I be concerned my packet lost somewhere ?  Anyone else have NOA2 dates around the middle of May receive anything from the NVC yet ?
