  1. I have filed for my wife this April, 2013 and got approval on Aug 27, 2013. I received case number on September 5, 2013 and complete DS 260, Sent AOS and Fee $88 by 10 September. I called NVC today to check the status for DS-260 and get to know they required 30 business day to review DS-260. Its already been 3 weeks. Does it really take that much time for DS-260?

    Isn't ds260 you completed or the ds261 (choice of agent). I think you filled up the 261. Ds260 can only be filled up once the iv fee is paid and the IV fee gets generated only when the ds 261 is accepted. I can see from your timeline that you filled it up last sept 7. Hopefully you'll get yours this week because our ds261 was filled up last sept 13 and we were just able to pay it yesterday oct 4. Good luck and God bless :)

  2. Thanks so much! I'll do my best not to mess up completing all the forms. Time is crucial for us. :D I'm done gathering all the documents needed and all I have to do is wait. Btw, did you call/inform NVC before your brother turned 21?

    After taking a long time for our case to arrived at NVC, I tried requesting for a expeditious process for our case 'cause of the lost time plus my brother was turning 21 last month. But it was rejected. So I guess in this way I was able to inform them that my brother just turned 21:)

    It's also good if you give them a call and ask if you need to do something like writing an email. Good luck

  3. Wow! Good luck to all of you! :) Getting an attorney for us is also not option because his PF is way expensive. I know this sounds silly but I am also hoping to finish everything by January so I can go before the first quarter of 2014 ends. ^^,) I've been reading and following F2A timelines here in VJ and it seems that the average time from cases received by NVC until issuance of visas is 3-5 months.

    That doesn't sound silly;) as long as you already prepared you aos documents and the documents for iv, pay the fees right away when you get them and send the paperworks, I think you'll be able to finish it too before the year ends. Just be careful in answering the forms and your documents because if you get a checklist (correction/missing documents) that's another month of waiting:) God bless you:)

  4. That's a relief! What's his status now? I have 16 months to finish everything. Did you guys have an attorney to assist you? I'm still worried about CSPA's "seek to acquire" phrase since it is vague. I read that it varies from getting an attorney to submitting or finishing DS-260.

    We are still at NVC. Waiting for our ds 261 to get accepted. We already paid the aos fee and submitted the AOS papers and documents. Just waiting for the ds261 to be accepted so the iv fee will be generated and then be paid. We are hoping we will be able to finish this before the month of October ends or even November and if the visa bulletin will not retrogress before our priority date, we might get an interview by December or January.

    We don't have any attorney and we just did this process by ourselves:)

  5. all that stuff is bypassed if there's attorney attached to the casefile, with a G-28 filed with the I-130.

    I'm thinking that's the case for the OP, fwiw all correspondence goes to the lawyer. Sometimes the petitioner will get stuff, when a lawyer is attached, but it's not the norm.

    Ultimately, the interview letter will get emailed out , so that's a plus, but also the end-game, final result, at NVC.

  6. your husband won't receive any notification for 'arrival'. there will be notification after fees are paid.

    Since he used an attorney, the good news is that the 2 fee bills are generated same day, so things will go faster for you, saving about 4 to 5 weeks of wait time.

    So if you have an attorney, don't they need to fill up the ds261 too? Since Sept. 3 there is this new form online for the choice of agent and it takes about 10-20 business days just to have it accepted. As of now, NVC really had gotten slow. There are two fees the AOS and the IV fee, IV fee is dependent to the acceptance of the ds 261 right? Unless the ds261 is filled out and accepted, no iv fee is generated . The call center rep at NVC had been saying too that the review of the aos and iv documents takes 30 business days...well some are not really per what our other members had experience. So there is still a long way ahead of you.....

  7. @ darnell the secretary of my atty said that my papers already arrive to the nvc. but my husband didnt received any notification about this.

    You will only get an email once NVC have a case number for you and an invoice identification number for you and your affidavit of support fee is already generated. This means they're able to enter and process your files from uscis. The only way for you to know what's going on with your file before the email is by calling them. Now, don't feel too worried or depressed because a lot of us here waited at least 1 year to get approved. For our case, my siblings files took 2 months just to arrive at NVC. Two weeks to get our case numbers and until now our choice of agents haven't been accepted which as what is going on here, it's taking 10-20 business days to be accepted. I do understand that you would want to be with your family ASAP, who's not right? But it really takes a lot of patience to finish this process. Just consider yourself lucky to be approved fast. Try not to linger here too much...it will just make you compare your case too much to other people's timeline and make you feel worst:) everything is in God's perfect time;) make your self busy by doing other stuffs or go out and enjoy the weather:)

    Don't worry even if you turned 21 you got a lot of extensions( get the length of time from your pd to your approval of petition at uscis. My brother's pd is march 16, 2012, approved last June 23, 2013and he turned 21 last month. We are fine because according to child status protection act CSPA,he got about 15 months extra when he reached 21. So you'll be just fine if your timeline is correct:)

  9. Hello everyone. We filled up our ds261 last Sept. 13. I called awhile ago regarding our ds261 'cause until now we haven't gotten our iv fees. I was told that he'll send our iv fee shortly. Now when I logged in at ceac, on the iv fee, before it was showing not available, now it is saying not paid. When I click pay, there is $0 iv fee and my sister's name isn't there(mom's the petitioner). We also didn't receive any email from NVC saying that our choice of agent had been accepted. Anyone who experienced this? Thank you and God bless

  10. seems that nvc started with priority dates of 2012, is more important than the order in which the cases were completed, yesterday they assigned cases wirh pd from 2011, and that gives me hope to soon reach May. This is worse than torture.

    That is what I noticed too. It does makes sense too because we are dependent with the visa bulletin and who knows what will be the next date for visa availability. So those who have earlier pds with complete cases get the I/L first.

  11. Yeah isn't that frustrating...I submitted my siblings ds261 last sept 6 but I edited it to add their middle names on the 13th, it was moved to the 13th as the date of completion. That was a mistake on my side..oh well..like you guys until now we are still waiting for the iv fee which is holding us to send our iv documents....just so long now just to generate the iv fee... Praying that everyone will get their iv fees already :)

  12. I am sorry to hear that your petition had been revoked. There is no category of petition for a married child of a green card holder. So when you got married ,your petition became void. Now, my question is did your mom apply for citizenship before you got married? Then your petition could had been moved to married child of USC. Now if not, the only recourse is for your mom to be a USC and apply for another petition for you. Again, I am sorry.

    This happened to the cases of my siblings. They got approved last June 26. I patiently waited for their files to arrived at NVC. The people whom I was following, their approvals are before and after ours, had already been at NVC and that was within a week or two after their approval. At 6th week of waiting I tried asking help from our congressman but our caseworker told us to wait for 8 week after the approval and to just contact her again next month. I was about to listen but I tried contacting our senator the next week. She called uscis and she informed me that our files are still there and told them to send them immediately because it's been more than 30 days since our approval date. Our case finally arrived at NVC on August 22. We waited again for the case number and in which it took about two weeks. Now even in the acceptance of ds261 and the generating of iv fee it's taking so long... For your case it's best to ask for your congressman and/or your senator....hope yours will arrive at NVC soon.

  14. Has st lukes resched her interview already? You can ask or you can reschedule her interview date yourself like what I did when my mom had her sputum too. I too, didnt have a job when I petitioned my mom and turned out okay. As long as your co sponsor passed the income requirement. If your dad got approved, there's a big chance your mom will be too. The questions will usually be as what they asked to your dad. I feel you, and the 8-week waiting period is like so slow. I pray that your mom may get through with this and doesn't need to have the 6 month medication if the result of the culture comes out positive. God bless you.

  15. this is my day 3 after sending my ds261 and have'nt receive my IV processing fee bill yet...about ds260 is it all applicant need to fill that again , how come is in not my checklist?

    I sent our ds261 last Friday. Haven't heard anything from NVC. Got the AOS fee though last Monday and sent the AOS form and documents on Tuesday. Hopefully tomorrow, we'll hear about our ds261 and get the IV fee....

  16. I think what had been predicted is right either 0 movement or further retrogression because of the influx of approved cases to Nvc. They might even slow down in approving of petitions at uscis. I remember back in 2011 or 2010, the visa availability for f2a was few months from the current date. Then by January it retrogress for three years then 2 years. There were many applicants who got interview letters but ended up not getting their visa due to retrogression and not having their pd before the cut off date. I wish and pray for the best for everyone. God bless:)

  17. I sent another filled form to my husband, because NVC requested us to bring it to an interview, instead of sending them.

    It was a second checklist for AOS, and they probably realized that it was their fault that they didn't say anything regarding this N/A at the first place. So thanks God, they didn't make us wait another 20-30 days to review this N/A thing.

    The first checklist was because the income of joint sponsor didn't match that on the tax returns.

    Shtu, you got checklist for not putting n/a? But isn't on the AOS instruction it says if the answer is not applicable of none, leave it blank? 'Cause that is what I did. I hope I'll not get any checklist due to that:(

  18. Thanks. I am assuming recent 6months pay stubs can replace employment letter and can i send only W2 &/or irs e-file signature form since i don't have the irs transcript yet.

    I am asking this because i am on my way offshore to work on the sea and when i go like that i go for at least 4weeks. So i want to see what i can send out before i go and won't be able to do anything for 1month.

    What advise can you give?

    I think if you have employment letter and no pay stubs that's okay. Vice versa. But because we have both of them, we just put them. For the itr and w2 ,did you file through turbo tax? You can just probably print them and sign them:) the signature is very important. Good luck and God bless your journey:)

    Hi! I just paid the AOS fee too last night and I just mailed the AOS forms and documents awhile ago. I think if you are ready for your AOS documents send it already so that they'll be able to start reviewing it then just send the IV documents once the IV fee get invoiced and paid to save time:) rather than waiting for the IV fee to get invoiced and to send both AOS and IV documents together:)

    Opppps my bad. Wasn't paying attention on what I was reading... So you still don't have the AOS documents... Hopefully we'll get our IV fees this week:)

  21. Hi! I've been on your shoes. I got my noa2 on June 26. After seeing so many cases before and after me reaching NVC within 1-2 weeks I got worried but I put my faith on uscis. After a month I contacted our congressman for help. No help at all. The case worker just told me to wait 8 weeks from noa2. A week after, I contacted our senator for help. It took about 1 week for them to send our files when my caseworker told them to send the files immediately because it is more than 30 days from the approval date. It reached NVC at Aug. 19, entered at 22. if i havent contacted our senator, my files might still be at the uscis and that's 2 months from the noa2.I just got my case number and invoice number last week Sept. 4. You better ask for your senator or congressman's help:) God bless you on your journey.

  22. Hello everyone... This is for my mom's petition with my 2 sublings. She was able to submit the ds261 for her 2kids awhile ago. When she tried signing in for AOS payment, this message, in red letters, shown.

    What's the meaning of this? We also got a message from our expedite request asking for phone numbers of my siblings in the Philippines and that it is still under review. Your answer is really appreciated. Thank you and God bless.
