    "Executive Orders do not require Congressional approval to take effect but they have the same legal weight as laws passed by Congress. The President's source of authority to issue Executive Orders can be found in the Article II, Section 1 of the Constitution which grants to the President the "executive Power."

    I am concern too my friend. My wife is also in the process. I am aware of that definition of EO. Google gives it to you. However, Immigration laws are hard to change. What they are doing is to find out how they can interview people in a way that they can be sure bad people are not coming to the US. processing of issuing visa will be harder, but they cannot eliminate it. Mostly they are more concerned with Interview waiving program.

  2. whatever this is he CANNOT prevent US citizens to be with their families. I am not optimistic, my wife is also in the process of immigration visa. Remember, these are EOs and for putting hold on procedures. These are not laws. It might affect people for a period of time. But in order to make them law for issuing visa it needs to through congress. Immigration is a US federal law. it cannot be changed that easy.

  3. To me it is kinda tactics, it is my assumption though. US government knows for sure that a country like Iran will not provide any information for US immigrants. Iran and US do not even have diplomatic relationships. So, they know they cannot stop immigration visa for those 7 countries. Specifically they cannot tell US citizens not to bring and meet their wives or their close relatives. It is against human rights and US is #1 country for following human rights. Hope, I made my point.

    i believe these countries are what the order describes as "countries referred to in section 217(a)(12) of the INA [Immigration and Nationality Act], 8 U.S.C. 1187(a)(12).

    that is what I meant, "visa interview waiver program".

     

    Iran is kinda in a gray (my own word) list. They do not know if it is yes or no for Iran. (based on my best of knowledge, not 100% sure. I am Iranian -American myself)

This NEW screening program must include - an in-person interview, a database to make sure that duplicated documents aren't provided, NEW forms to weed out frauds, as well as make sure that the applicant will be a contributing member of American society, and make sure that the applicant isn't a terrorist.

    What does this all mean for IR1/CR1 and K1 applicants?

     

    If you are a citizen of Syria, Iraq, Yemen, Sudan, Iran, Libya, and Somalia:

    Regardless of whatever visa you might have (IR1, CR1, K1, B2), you will not be allowed to enter the United States for the next 90 days. What does this mean for existing visa applications? Hard to say, but it seems very likely that they will be held up or delayed.

     

    If you are from another country:

    Within 30 days a new list of "problem" countries may be released. These countries will be ones which were found not to provide "sufficient" information (whatever the hell that means) to adjudicate a visa petition. Such countries will have 60 days to "fix" these problems and if they don't they will also join the banned list.

     

    On top of all this a new screening program has been ordered to start. It's hard to say what exactly it will mean for existing applications or even when/if it may be implemented (a lot of what's being asked for seems to already exist). But this NEW screening program will apply to people of ALL countries (whatever it is and whenever it may start). 

    I skimmed the EO which Trump signed few hours ago. There is nowhere it mentions Yemen, Sudan, Iran, Libya, and Somalia. At least what I read I guess.

    I am a US citizen and my wife scheduled for CR1 interview on February 2017. Here is our scenario and my concerns. I met my wife on November 2015 via Facebook. I went to my origin country and April to met her personally and based on our culture and tradition (I am Iranian-American) we got married. Because I am working for federal government and I am so busy, I had to return to US after 15 days. Also, I needed to apply for her. Since our first contact, we are in contact every single day and we also have a shared  account in Iran. Everything has gone through very well so far. 

    My Concern is that can out short meet lead to denial? Also, my wife's family are so traditional in wedding process. Therefore, we have not had intercourse yet. (Tradition says we should start living together and then we can have intercourse). Actually her father is so picky about this. Could this be a problem ?

     

    P.S. we have a very complete document package.

     

    Would you please help me? I am so worried. I need to be relax.
