  1. I really hope you're right... Although i do believe in the whole "cycle" thing. It is true that service centers repeatedly break the law and process in cycles instead of by date the way the INA and the CFR's state.

    Another idea although it is horrible.. is that it might be even longer than that... some speculate that VSC is dedicated to N400's (for the election) and wont stop until it gets to a certain deadline.. perhaps the deadline to get a voter registration number. Whatever that is...

    This is interesting and thanks for sharing the optimism! I hope you are right.

  2. is there maybe a way you can send us the details of what you told your congressman? I've had my congressman, and 2 of my senators call, and the Congressional Liaison's just tell them all the same #######. "He has to wait like everyone else, we're currently processing from date ...da..da..da." and they really get nowhere. How do i push harder? I've sent letter to ombudsman and they told me the same thing.

    Thanks again everyone...but my heart still hurts for those of you who are still in limbo :( Of course we are happy, but we still have you all in our thoughts.

    I am continuing my correspondance with my elected representatives to try and help the process of family based immigration as a whole, as I do understand that it is not just about me. I am also considering drafting a bill to present to Congress to try and help the process and if I go forward with it, I will come here for feedback and suggestions on things that we may want to include in the bill. Nothing would make me happier than to help others to not have to deal with some of the problems of legal family based immigration.

    I really do wish for everyone that our processes will ALL go very quickly. See y'all around!

    OMG OMG OMG!! I just got e-mails to say that APPROVAL notices were mailed to me today!! I am so happy I want to :crying: Man, I SO hope to be together for our first anniversary!

    I'll update timeline as soon as I get the paper in my hands.

    Oh man, I know its not over yet, but THANK you all for your support during this trying time.

  4. Did you or your husband get an expedite request? Or did you just get approved very fast?

    Good is great! he gave me a sign last night. Let me share this to everyone who's reading my post. I had a dream last night, in my dream it was early in the morning when everyone are sleeping i checked my the uscis site and i got an email from CRIS then i ran to my dad and hug him so tight and cried and cried and i told him i am approved.

    To got a call from my husband saying about the approval wow! i feel like i'm still dreaming..hahaha

    God is soooooooooooooo great..

  5. WHOA!!! Congrats... First of all... both I129F (K3) and I130 (CR1) are still both valid options. Your K3 with probably get an interview about 45 days sooner than the I130 or you can wait for the I130 and get a much better visa.

    Either way, please add a new or update the timeline feature so it can help us with our calculations.

    What is your I129F NOA1 date (the I797 notice they first sent you at the very beginning after you filed)

    what is your NOA1 date for the I130?

    I got mail from USCIS CA Service Center stating that my I130 was approved and sent to the NVC. Does this mean that my 129F is no longer an option?

    My understanding is that once the I130 is approved before the 129F, the 129F is no longer an option.

    Advice please.

  6. I'm not asking for complete advise. I'm scheduling time with a lawyer. I just want to know if its possible without my wife having to go back to her country for some time or if she would be allowed to stay here with me

    I would say not to get crazy worried just yet. More than likely she might be eligible for some sort of asyllum due to the LIFE Act. You should read up on it. This might be your way out. As far as what form.... i honestly have no clue, but definitely look into the LIFE Act.

  7. Of course you do? however you wont have the same date as for the K3 appt. Just follow all of the steps you need to get your CR1 out of the NVC and onto the Consulates interview list.

    we are approved CR1 an K3 at the same date. now i got a letter from us embassy manila to call for an appointment interview date for K3. but we want now to pursue our cr1 since we dont need to file for Adjustment status w/c cost a lot! do we still have time to change? im just confused.

    This thread is in response to a thread I saw requesting the Delicia add K3 filers to her spreadsheet. I understand the reasoning behind keeping CR1/IR1 and K3 separated. Therefore, I have started this spreadsheet for K3 filers, like myself, who are waiting for their NOA2. I am a numbers person and I like to see when people near my filing date are getting approved.

    So, thank you Delicia for showing us how Google Docs can be used. I have never tried this before but am always interested to learn new tools. So I figured I would give this one a shot...

    1. For all the California filers, I plan to add those spreadsheets tomorrow.

    2. Both California and Vermont filers can send me their updates/changes and I will be happy to update the spreadsheets.

    3. Cells highlighted in GREEN refer to approvals that have occurred over the last month.

    4. Cells highlighted in YELLOW refer to recent touches. (Disclaimer: We all have seen that approvals sometimes happen with or without previous touches. But this is just another indicator that I was curious to track.)

    5. If anyone has any suggestions for changes to the layout of the spreadsheet or additional columns, averaging wait times, etc... I will gladly take those suggestions also.

    5. Lastly, If anyone would like to volunteer to share the updating responsibility, you are always welcome to do that also.

  9. Yesterday the Message in my TIMELINE said that my estimated approval date would be between Aug 16 and September 4. Today it says between September 28 - Oct 28th.. What a change!

    Then i say to myself... what could possible have happened for an almost 60 day increase? i look at the individual timelines and i notice 2 people with NOA1's from July 07 and Oct 07... just got approved...

    Does this mean that estimated date relies so heavily on just one or 2 people... i mean.. it was just 2...

  10. She lives in LA VEGA now... we want to move her to Las Americas or somewhere in the capital... a one bedroom will do just fine.... she says to expect to pay anywhere from $125-$200 a month. Is that likely?

    Me and my wife have been discussing the "moving" of her and the baby to the capital sometime in September-Early Oct (in hopes of living nearer the consultate + much cheaper flights to the capital). Will this affect the Interview in any way, will this affect where her passport is delivered after approval of the visa? Would it be a good idea to acquire the POLICE REPORT before she moves?

    Moving to the capital close to the consulate is going to hurt your pocket, rent an apartment/house close to that area is very expensive.

    No, it is not going to affect on any aspects, since you haven't received your NOA2, All what you have to do is to inform USCIS her new home address so they can deliver the packet once you get approval and later on the passport when she get the visa approved.

    The police report has to be requested where you have lived last 6 month. The Procuraduria located in La Feria is the one that is providing the police reports now, close to the Passport offices.

    Where does she live now??

  11. i wouldnt go crazy just yet... i mean... if you're worried about infection and all from a vaccine, i'd say you're wife would have to be a super ill/bad health type of women with extremely low immunes system and STILL an act of god to disturb the preganancy at such an early age. The womans womb believe it or not protects the baby from drugs, many diseases and even alchohol for quite some time throughout the pregnancy ESPECIALLY in the early stages.

    Ok, So here is my situation and my question.

    Wanting to stay ahead of the game, my wife started working on her vaccinations early. As I imagine most people are in the same boat, she did not have her vaccination records from when she was a child. So around the beginning of May, she went to the doctor to begin getting her vaccinations that were required for the visa process. And she recieved a whole host of vaccinations that were appropriate for her age.

    We had discussed having children, and we both want to have children. Our ideal situatuation would be for her to get pregnant after she arrived in the US. Well, at this time, we were not trying to get pregnant, but we also were not trying not to get pregnant.

    Then she had her period the 12th of May. Well, I visited Buenos Aires from May 22nd to May 27th. This is the time that she became pregnant!!!

    Well, the first or second week of June, while she did not realize that she was pregnant. She returned to the doctor and received two more vaccinations. The Pneumococcal and the Varicella vacines.

    Then, we got the test results from the doctor on June 23rd, positive that she is pregnant!!! :dance:

    Well her doctor is concerned about the vaccinations that she received in June, after she had become pregnant. And said that we would have alot more information at the 3 month check-up. Of course, this worries my wife alot, as well as myself.

    With all of the research that I have done on the internet. Here is the information that I have found regarding receiving vaccinations while pregnant or within a month before becoming pregnant:

    Doctors say there is no problem with the vaccines that are dead vacines. The ones that they are concerned about are the live vaccines. Varicella being one of them.

    However, this is only a concerne of the doctors because they feel that there is the POSSIBILITY of a problem. There have actually never been a reported problem to mother or child from receiving a vaccine while being pregnant or within a month of becoming pregnant.

    So it is my take that there is really nothing for us to be concerned about with my wife receiving the vaccinations. And this is what I am telling my wife.

    So, my question would be: To anyone who has maybe been in this situation, or has more information, or maybe there are even some doctors out there that know better than I do. Is my research pretty accurate, or should I be more concerened about this than I am?

  13. Visit USCIS Registration, create an acct and then ADD your EAC# to the porfolio. That should let you know what's going on.

    I filed an I-130 for my husband at the Amsterdam consulate in November 2006. In January 2007 I requested it be transferred to Germany, where we were moving, but never when through with contacting the Frankfurt consulate to transfer it.

    I have a case number, but I'm not sure how to find out if the I-130 is still 'pending.' I want to cancel it, but I'm not sure how to go about this. Any advice?

  14. Believe it or not things in the DR Consulate have improved for the better... for cases that have been approved after March 2008, it takes less than 90 days for an interview. But if you want real specifics and a great knowledge bank go to www.dominicanstotheusa.com there are thousands of you out there all scattered but on DTTUSA there are over 200 members present and past that can tell you EXACTLY what to expect.

    I just married my dominican boyfriend of two years on Monday. We are really happy. We have been thru a lot and know that there is more to come before we can be together here in the U.S. Last year I sold my house and car, quit my job and moved to the D.R. in hopes of getting residency there and then marrying there and directly filing with the Embassy. First my initial approval for residency was denied here in the Dom. Consulate in NYC with no reason three days before I moved down. That made finding a decent job down there very difficult for me. There is a lot more to this story but to sum up, I decided to move back here to the U.S. in February and work for a while and we decided to get married and file here in the U.S. We went with marriage over fiance because we want to start having kids and I feel more comfortable being legally married and starting this. Also it felt better to both of us to make the commitment as well as the idea that he could start working right away when he entered the U.S. Back here in the U.S. I am about to start the paperwork and filing. A woman in Senator Leahy's office has offered to help me but I was wondering if I need more that that? Has anyone used the companies on the internet that offer to do it for around $500? I have a friend here who used a great attorney but she costs $5000 and doesn't seem to return my emails now. I should also note that my husband has been denied a tourist visa renewal (he was here 4 times before, never overstayed, never broke any laws) and also denied a work visa. Does this mean I need a really good lawyer? The Embassy in the D.R. has made me cry because they accused me of fraud when I called to ask about how I go about doing a direct consular filing so I could move down there with all documents and be informed as to the order of the process. I haven't heard any good things about the people that work there. Sometimes I wonder if I should try to live there again if this process is going to take so long. How did the other couples manage so much time apart? Thanks for any advice out there, K

  15. very simple... some workers in the world, believe it or not... get away with EATING SH-I-T all day and being unproductive, while some people take pride in responding to challenges and being hardworkers.

    it really is helpful to have a rough estimate of when the noa2 would be issued based on other peoples timelines. though at times it isn't really encouraging. i feel for those who have been waiting for an approval since last year. i can't imagine having to be apart from my husband for a very long time. i know it seems melodramatic, but each day without him is really a struggle. =( anyway, what do u guys think of the erratic timeline? why do u think a lot of those who filed last year are still awaiting approval while those who filed this year get approved first?

    Yes i agree... i find it extremely hard to believe that there have been more days in the month than approvals.... it's just unlikely... people arent posting or updating their timelines... so our estimates are always off...

    Hey all of you fellow K3 applicants... especially those of you waiting for some action from the VSC. When you get NOA2 'ed , can you please update your timeline so the rest of us know what's actually going on ?? That's the whole purpose of this site, isn't it?

  17. Your file will probably be adjudicated within the next 5 days. Longest one month.

    We received a letter yesterday from CA service centre, saying that our request to expedite our I-129f petition has been granted. Does anyone have experience of how quick they expedite the petition now? Do they just expedite it through the intial approval stage at the service centre or is it expedited all the way through?

    Also for the interview in London, do i need to have the orginals of certificates and also an official copy of them or can i have just the orignals and a photocopy?

    When your filed gets expedited it is basically it is adjudicated and all goign well approved at the service centre your at then it will be passwed to NVC to go through the rest of the process and then onto the Embassy in your fiance's country.

    If you dont mind me asking on what grounds did you get your file expedited ?

    My hubby's Senator said we had strong grounds for applying to get our case expedited since our situation has drastically changed in the last 3 months. Hardship for his 15yrs old son and financial hardship. Just wondering why yours was granted and how long did u have to wait to hear the news ?

    I NEVER RECIEVED MY NOA1 FOR THE (K3) I129F... TO THIS DAY I STILL HAVENT RECEIVED IT... WHAT I DID WAS 15 DAYS AFTER THE DELVIERY CONFIRMATION DAY.. I CALLED THE VSC AND SPOKE TO AN OFFICER AND TOLD THEM THAT ITS BEEN ABOUT 45 DAYS SINCE I SENT IT... AND LIKE THE DUMBASSES THAT THEY ARE THEY ACTUALLY DID SOME WORK AND LOOKED ON A COMPUTER (WOW!) AND THEY EASILY FOUND MY PETITION BY SEARCHING FOR MY BENEFICIARY'S LAST NAME AND FIRST NAME THEN THEY VERIFIED MY INFO AND THEY TOLD ME THE EAC#... I THEN GOT ONLINE ADDED IT TO MY USCIS PORTFOLIO AND VOILA... IT WORKED. (i did the whole online thing with the officer on the phone) THEN SHE APOLOGIZED SAYING THAT "IT MUST'VE BEEN LOST IN THE MAIL" BULL!

    GUYS FOR REAL IF YOU REALLY WANT YOUR EAC#, THEN DO WHAT I DID AND YOU'LL GET IT...

    hi all! quite new here.. i'm just going to add myself this list. I sent the I-130 April 30, but wasn't received till May 8 in Chicago. Since then, i have checked online to see if my check has been cashed. Sure enough, on May 15, check cashed. But i still haven't received my NOA1. So i waited and waited. Finally, May 19, i got it in the mail.. Said that the Received date was May 8, Notice date was May 13. It took 5 days to get to me? CSC is in southern california, where i'm from.. sheeesh.. I then signed up online on the USCIS website. Said there that my petition was updated May 14. That means "touched," right? i'm so clueless..

    now i'm deliberating on whether to go ahead and file for a K3 or stick with this CR1.. don't understand too much of the CSC timeline and the Manila consular office.. any advise out there pls? thanks...

  19. Toughen up.. grow some balls and use another man (voice) to call as the petitioner and start GRILLING them for questions... you should know your husbands info by now.. Get to the bottom of it because it could've been lost in the "mail" or some #### like that... you never know.

    I feel helpless, and start getting emotional breakdown. I've lived apart from my husband for over two years since a few days after our honeymoon. It took over three months until the USCIS received our I-130 petition. As soon as we finally got the receipt of I-130 petition in January, we filed the I-129F petition. The USCIS finally approved our I-130 and I-129F petition on 05/05/2008 (about three months for the approval). I checked the status of our case every day online, and when I saw that it's been approved, I was so excited and happy. I thought I could come to see my husband soon.

    I didn't know that the NVC took such a long time just to receive our approved petition. It has been 6 weeks since the USCIS approval, but the NVC hasn't received it yet. NVC operators just repeat that I should wait up to 90 days. Does it seem to be so easy to be away from the one you really love? They asked me to call the USCIS, so I did. I didn't know only the petitioner could call. Since I am the beneficiary, they can't talk to me. Right now my husband is extremely busy, but I have to ask him to call anyway.

    Is there anyone whose case wasn't even received by the NVC over 6 weeks? Is there anything I can do? The mean NVC operator I talked to said nothing but to wait. I just feel so sad. :crying:

    If CFC followed normal procedures, they approved both petitions the same day and sent only the I-129F petition to NVC. NVC's automated system never has any information on an I-129F for spouse. If you are giving NVC the I-130 case number, they may never get it. Have you checked the case number for the I-129F?
