  1. We live in Michigan and my wife is ready to take a written knowledge test. My question about getting driver license, she have her valid driver license from Peru which that mean she should waive second test for driving test. Her new resident friend who is from Poland had her driver license there and she only need to take a written test and got license when she passed. However I went to secretary of state office to ask that question to lady at desk and she said that she they don't do that but I told her what the point to take second test of driving skills if my wife already have license and she drive all the time? She just need to take a written knowledge test to know the signs and rules. I even told her that Michigan accepted other countries valid driver license and only need to take knowledge test but she shrug and told me that my wife need to take 2 tests but I am having feeling that she have lack of knowledge about foreigner. Can anyone have strong source that show the Michigan does allow that or unless there is limit of what countries that Michigan law allow foreign driver license to only take written test to get Michigan driver license?

  2. Our interview is this Thursday and we are very anxiety to prepare to make sure we have enough documents to bring for my wife AOS interview.

    So far we have,

    1. Her photo identification
    2. NOA 1 and 2
    3. Copy of USCIS medical exam and original Spanish medical exam
    4. My 2017 W-2 and tax return
    5.  My letter for proof of employment and last 2 months of my pay stubs
    6. Her proof of lawful permanent resident status (My wife mail address bills, health insurance added under mine and her state ID)
    7. Her EAD/AP card
    8. All USCIS NOA documents
    9. Her Birth certificate with certified English translated
    10. Photos of our relationship including wedding.
    11. state marriage certificate
    12. Her passport

My questions is that do I need to bring copy of completed Affidavit of Support I-864 and medical examination with sealed but it said " unless already submitted" which I already submitted the original ones?

Second question it said, "Original and copy of each supporting document that you submitted with your application. Otherwise, we any keep your originals for our records.". Does that mean I need to bring extra copies of all forms even though I already submitted to USCIS which they should have copy of it?

Is there anything else I should bring?

  3. Hello everyone!

I am using TurboTax Premier version to file my 2017 tax return. Me and my wife got married on August 26 2017. She have SSN for work purpose, EAD/AP card, and state ID. She is going to have her green card interview on February 8. She doesn't have job yet and is not earning any income except me giving her allowance every month. She hasn't open her new account in bank yet. My questions is should I add her Married Filing Jointly or Married Filing Separately? Should I apply her as resident or non-resident? Does she is considered dependent? Does she need to declare her previous employment salary from her country in early 2017 before she came here on August?

I've heard that rev.com is a good one though I don't have first-hand experience using it.

If either of you are fluent in both languages there is also the option to do it yourself. I translated my husband's with no problems.

I am not fluent in Spanish and my spouse is not fluent in English. So I do not want risk to translate ourselves. It obviously said it required certification English translation on document so we can't do that.

  5. That is something your wife need to handle it and find her own way to make to be happy. I really hope she already understood the sacrifice before move to new country with you.  Usually spouse get homesick in first few months, not first few days. My advice for you is be patience and be supportive for her so that she doesn't feel lonely or stress of doing nothing at home. Encourage her to find hobby or volunteer if she doesn't have job yet so that she can stay busy and keep her mind away from being negative. Is your wife eligible to work? If so then strongly encourage her to find job. Also encourage her to make a list of goals she want to do in 2018 to accomplish which it might motivate her a bit and she won't forget. My wife doesn't have job yet but she just start looking for it because she just got EAD. She found things to do without work is taking English course with tutor at home to continue improving her English, read business book (So she can prepare to work relate to her business field), study driving law book to get driver license, joined international book club, and attend international women club for her to meet new people and hang out. We don't live in big city but that doesn't stop her for finding something to do.

I think it will show any mail being delivered to your address. I just got my first Informed Delivery notice yesterday, and all of the mail that I was able to preview was under my mom's name (we live with her), even though I signed up using my name.

Informed delivery shows every mail that's arriving to your house/household. It doesn't matter whose name is on the letters, once they're coming to your address you will be able to see it. I've been using mine for over 50 days now since I filed in October 2017. However, I must say sometimes you're not shown all the mail thats coming on a particular day.

    Alright thank you!

I finally signed up for Informed Delivery today. Now I'm taking tracking the mailbox to an extreme. :jest:

I signed up for mine too. It pretty useful. However they mail in my wife name instead of my name, will I be able to get informed under my account even USCIS put down my wife name? If not then I will need to add second address with her name or she will have to create her own account?

It's been taking anywhere from 75 to 120+ days for EAD/AP approvals. Yours could be coming soon!!

We have a similar timeline and are hoping that our RFIE for the AOS petition doesn't slow us down too much. Still holding out hope that we'll have EAD/AP by the end of the year, but I'd try no be too disappointed if that doesn't happen.

Ok that is good to know. Hopefully anytime soon! My wife is eager to work and travel! :D

But how do you get a SSN without a ead

You do not need EAD to have SSN. You can apply for SSN after you arrive US as K1 visa holder. You will need to get i-94 number from online and bring to SSN office. It take about 2 weeks for my wife i-94 number to show up in database(SSN office require i-94 number). After that, she went to SSN office to apply for SSN and it take about 2 weeks for her to get SSN card by mail. So it take about 4 weeks total.

  10. Does that happen to people who been pull out during security checkpoint for questions of their immigrant status but they waited too long for question or to finish it and then they missed their flight? If that happened do they demand them to rebook next flight available at no charge? I asked this question because I know there will be so many people flying for Christmas and the TSA and security will be so busy.

What did you submit originally? Did you submit W-2s with the 1040EZ?

I'm guessing the problem is the fact that it was an electronic return. Given that you e-filed your return, chances are it doesn't have a signature on it. Since there is no distinction in the I-864 instructions between a paper-filed and e-filed tax return, this link may be helpful:

    http://lawandborder.com/i-864-affidavit-of-support-help-center/#71_Documents_to_File

    I submit with only W2 form. I didn't submit 1040 originally.

They snatched us out of line and asked if my husband is a USC, he replied no and then was asked to show papers proving he was here legally.
A state ID would not have been sufficient and border patrol will randomly call out people in line traveling domestically.
The advice "just bring your ID" is no longer sufficient.

Wow state ID alone is not enough? Ok I will make sure she will bring her Peru passport, NOA letter for AOS, and our marriage certification.

The K1 is a one time entry and expired the day she arrived.

She should travel with her passport, state ID, marriage certificate and NOA 1 from filing AOS, especially going to TX where

they like to pull people out of line and ask randomly if they are a USC as happened to us.

Ok so having all these requirements for her to bring that you mentioned should be okay to fly? Is there something we should be aware of in case one of TSA are dumb enough or rude regard about her immigration status?

As long as you are only traveling domestically all you will need is a form of ID acceptable to the TSA as there be any dealings with immigration officers. I promise you however rude they may be they will not snatch you out of line and deport you.

Ok that is relief to know! Thank you!
