    Normally I would agree.  I-90 is no charge if it is a USCIS mistake.  In this case it is NOT USCIS that made the mistake.  If the visa was issued in the wrong name, there were two mistakes, first the Consulate and second, the immigrant who didn't get the Consulate's mistake corrected.  You will likely need to pay the I-90 fee.

    I don't believe it's my fault. I reviewed all forms that were submitted to both USCIS and NVC (G-325, I-130, DS-260). There were no mistakes from my side.

    When they asked me to review the information on the yellow package, I thought they put her middle name to the front in purpose just exactly like her name on her passport biographic page. So I didn't think it was an error.

    What's more, I had gone to USCIS 2 weeks before the card was produced and was told that the mistake on her visa would be corrected on her green card when it arrived. I had him scanned all documents and he provided me an inquiry form explained the mistake clearly, he signed and dated it.

  2. My wife arrived in the US on April 16 2018.

    We didn't pay attention to her name on her visa til we got home. Actually it's not a big mistake, it's just backward. Department of State put her middle name to the front so it was  M. J-E instead of J-E M because her actual first name is J-E and her middle name is M.

     

    I reviewed all of the documents that I submitted to USCIS and NVC to make sure that I did not submitted any wrong information to them. After searching through all documents, I'm 100% sure that I provided them correct information. Because my wife just came and had not received her green card yet, so I made an infopass appointment on 05/04 and brought the copies of all documents, telling an officer to make sure that she would receive her green card with a correct name on it. He took and scanned the documents and gave me a form to sign. After couple weeks, on 05/21 my wife received her green card and social security card with the same error of the name.

     

    I went to social security office to make the correction, but they refused to change it and told me to back to USCIS to make correction on her green card first.

    In couple weeks, I tried to make another infopass but I could not. The website is always saying no appointments are available. I tried to call USCIS, the representative took the information again and told me to wait couple weeks to get the response.

    Last week, I received a letter from USCIS saying that I need to submit the form i-90 to correct her name without saying that's their fault or my fault and did not say that if I had to pay the fee or not.

     

    The processing time of i-90 is about 8-12 months, I'm not sure if I can ask USCIS provide me a letter letting Social Security department know that they are processing the i-90 form and her correct name should be J-E M instead of J-E?

    Is there anyone experienced this situation? Not only Social Security, now DMV also refuses to change her name and asking me to change her name on the green card first.

    I don't know what to do now. Everything seems too complicated.

  3. For all of you guys, if you didn't read what I wrote on the previous page, I quoted it here for you guys, please read:

     

    "Let me share with you this. I'm the original poster of this thread. Meaning I had been stuck in background/ name check for a long time just like you. I did research and tried a lot of things to push my case forward too. Unfortunately, nothing worked. It's hard to accept this but if you are stuck, that means you are STUCK, you can't do anything until the FBI finish their job. I guarantee with you that no matter what you try, it's not gonna work, so don't waste your time.

     

    Here is the truth, there are only 2 scenarios here:

    1. If you are stuck, and have not been stuck for a year (count from the date you submitted your application). So you are fine, nothing you can do but wait. Your case is gonna be automatically cleared when it approaches 1 year. This happened to most of cases ( > 90% )

    2. If you have been stuck for more than a year. Meaning you are so unlucky and having 2 options:

    ----- Continue waiting until the case cleared. Nothing guarantees when it occurs, normally 1.5 years to 8 years, or more, this is what a USCIS officer told me when I had my infopass.

    ----- Take your action: file a lawsuit against USCIS . This works most of the time and really push your case forward by forcing USCIS to pay attention to you. But this does cost money. According to people who recently filed the lawsuit, they spent around 3k upto 7k for a lawyer to do this."

     

    Also, if you are one the people in case #1 above:

    DO NOT TRY TOO HARD FORCING USCIS DO SOMETHING FOR YOU.  THEY WILL NOT AND CAN NOT DO ANYTHING BUT GIVE YOU A FLAG IN THEIR BACKEND. THAT MAKES IT WORSE AND DELAY THE REVIEW PROCESS.

  7. I have 2 questions.

     

    1. After the petitioner and beneficiary received emails from NVC regarding the interview appointment was scheduled (P4), does the beneficiary need to wait for any physical letter from the local US Embassy or that's it, just print the P4 from email out and bring it to medical exam and the interview?

     

    2. My interview will be March 26th, is the tax return 2017 required? So far I know that as long as the interview date doesn't pass April 17th, we don't need to show the latest tax return.

  8. I know your feelings. But please, calm down, it takes time.

    Everyone has to wait and you must wait for people have been inline before you.

     

    There is NOTHING you can do to SPEED UP your case except:

    - Upgrade visa category from F2A to CR1. So your husband must apply N-400 to become a USC as soon as he's qualified.

    - Naturalization and upgrading never slow you down. No worries. It boost the processing time twice faster than F2A.

     

    I'm the one who passed this process and I know how it works. If you don't believe me, just go with F2A and see that eventually your whole process take you at approximately 2 years 4 months to get to the interview (Last step).

    I have the same problem, unfortunately there is nothing you or me can I do but wait. I recommend your husband to apply for USC. I guarantee with you it's gonna give a push to your case. For me, I filed F2A first, then I upgrade it after I became a USC. It's at least 6 months faster than processing with regular F2A.

     

    Normally, most people gonna go even faster than me. I was stuck with background check before naturalization interview for more than a year. Only 10% people have extensive check like me so no worries.

     

    Just process your case under F2A category than upgrade it later. If the naturalization process goes smoothly within a popular time frame (4-7 months), there is no differences between your F2A and CR1.

    It depends on where you are in the progress. If NVC hasn't touched your case yet, so you need to wait 2 months for it to take effect. If NVC is processing your case, so yes, it takes only couple days, 2-5 business days to upgrade the visa categories.

    99.99% standard service fits your timeframe. No worries. But if you need something 100%, pay $60 go with expedited service.

If a person filed as a Single status versus to MFJ, IRS is not going to penalize you. In fact, since the OP filed Single, it just means he paid a higher tax as opposed to filing MFJ. However, if the OP's spouse has income outside the US and the OP did not report that because he filed single as opposed to MFJ, the OP will be slapped with Under reporting and Negligence penalty if IRS finds out.

     

    But back to your point #1 - a simple amendment could fix this as there's no penalty for this error as long he didn't under report the spouse's income outside the US. IRS has bigger fish to catch 

    Point #2 - I believe providing tax return is to prove that you have means to support the person you're petitioning and that they won't be a charge to the public.  I don't think the CO are expert in reviewing taxes or even understand the forms. Heck as an accountant sometimes I get confused with the forms myself. The CO are just interested in verifying the income.

     

    You are putting too much emphasis on the tax return rather than giving some alternative advise on how to prove their bonafide marriage. Obviously, if the OP's spouse is here in the US  and he filed Single and not included their spouse, then yes, I agree with your argument.

    First, I tried show him another view of the problem. I'm not a tax or immigration expert. I can't provide the outcome of this situation. I never mentioned the outcomes.

    Second, no matter what, anyone look into this problem can easily see that it might affect the case adversely.

    Third, I just suggest anyone having the same problem to fix it as soon as possible. It's easy to fix by contacting IRS and doesn't hurt to do so. On the other hand, it benefits you a lot.

    Fourth, if you are petitioning your spouse, you don't know the probability she or he passes the interview. Would you accept to lose 5-10% of success rate? For me, I wouldn't.

     

    Again, it's up to you, your life, your choice.
